THIS UTILITY EASEMENT, made this ? day of
1998, between TODD M REID and CONSTANCE A. REID, husba and wife,
herein referred to as "Landowner." and the CITY OF EAGAN, a
municipal corporation, organized under the laws of the State of
Minnesota, hereinafter referred to as the "City".
W I T N E S S E T H:
That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, a permanent
easement for ponding and flowage purposes, over, across and under
the following described premises, situated within Dakota County,
Minnesota, to-wit:
A permanent easement for ponding and flowage purposes over,
under and across that part of Lot 3, Block 1, JOSEPH A. SPANDE
1ST ADDITION, according to the plat thereof on file in the
Office of the County Recorder, Dakota County, Minnesota,
described as follows:
Commencing at the southeast corner of said Lot 3; thence
North 88 degrees 24 minutes 36 seconds West, assumed
bearing, along the south line of said Lot 3, a distance
of 136.31 feet; thence North 1 degree 35 minutes 24
seconds East, at a right angle to said south line 30.00
feet to the point of beginning of the part to be
described; thence North 21 degrees 34 minutes 46 seconds
West 75.82 feet; thence North 52 degrees 35 minutes 51
seconds West 89.76 feet to a point on the north line of
said Lot 3 distant 245.95 feet west of the northeast
corner of said Lot 3; thence South 43 degrees 53 minutes
36 seconds East 155.16 feet to the point of beginning.
Said permanent easement contains 2,233 square feet more or
less.

The grant of the foregoing permanent easement for ponding and
flowage purposes includes the right of the City, its contractors,
agents and servants to direct storm water flowage into and through
the easement premises. Landowner is prohibited from diverting or
blocking the ponding and flowage through the easement premises.
And the Landowner, its heirs and assigns, does covenant with
the City, its successors and assigns, that it is the Landowner of
the premises aforesaid and has good right to grant and convey the
easement herein to the City.

repair or removal, the City shall restore the premises to the
