Dear Jerry:
The above-referenced property owner is pursuing an objection to
the assessments associated with the above-referenced project. At
the Special Assessment Committee meeting of June 30, 1988, the
property owner complained about the quality of the restoration on
the backslope area from the trailway into their lot. The
property owner complained about the "rough" grading that was
performed prior to the hydroseeding limiting their ability to
maintain and/or sod this area.
As a part of the resolution of this assessment objection, the
Special Assessment Commission recommended that the City perform
some additional work with a bobcat to provide a more "finished"
status. 'I'herefore, would you please arrange a bobcat or
appropriate piece of equipment to backdrag this area to remove
the existing vegetation that has been established and any rocks
of significant size to bring it to a condition compatible with
sodding or seeding. The property owner was informed that upon
completion of our work that a certain amount of handraking will
still be necessary.
I would appreciate it if you could arrange to have this work
completed by August 1. If you have any questions regarding this
recommendation, please contact me for further clarification. Any
costs incurred should be charged to the above-referenced project
number.
Also, you may want to review other similar lots to determine if
the restoration performed by the contractor is acceptable.

On June 30, the Special Assessment Committee reviewed your
objection to the assessments of $735.20 associated with the
above-referenced project which was originally considered at the
Final Assessment Public Hearing of September 15, 1987. Enclosed
with this letter is a copy of the minutes from that Special
Assessment Committee identifying their recommendation which will
be forwarded to the City Council for formal consideration on
October 6 (Thursday), 1988.
It is anticipated that the City Council will take formal action
regarding this special assessment at that time based on the
review and recommendations performed by the Special Assessment
Committee and staff during the past year.

Janet Sazzachini appeared as a landowner objecting to the assessment.
Ms. Bazzachin3 irxlicated that the upgrading o£ Che road had made 25 feet

restoraCion darie was to control erosion and that any salding that would be
needed would be the obligation pf the landawner but that it may require

Max Steiner, Parcel 010-26, objected to the assessments. He
stated he had a problem with the ten inch water line and felt there
would be no benefit to his property as he would not use it. Mayor
Ellison asked if he had an objection to the layout. Mr. Steiner
stated it did not make sense. Mayor Ellison state8 he should object
to the assessment at that hearing.
Marv Rahn, 3050 South Lexington, objected to the project.
Bob Worthington (Opus) supported the project.
E9an moved, Gustafson seconded, the motion to close the public
hearin9 and approve Project 552 (Eagandale Center Industrial Park 3rd
Addition, Phase 2- Storm Sewer and Watermain). Al1 voteri in favor.
POLICY 86-3 AND POLICY 82-2/SPSCIAL ASSESS!lBNT
Public Works Director Tom Colbert explained Policy 86-3 (Large
Unplatted Property - Postponement of Special Assessments) and Policy
82-2 (Existing Land Use Versus Zoning) to the Council.
Wachter moved, Egan seconded, the motion to close the public
hearing and adopt Policy 86-3 and revise Policy 82-2 as presented.

Public Works Director Tom Colbert stated that based on the
improvements completed which intercepts the public drainage and
conveys it to an underground storm sewer system instead of the
previous situation where drainage was discharged directly onto the
property, the staff felt that the assessment was properly levied at a
uniform rate equally over all similar zoned properties and provided a
benefit in the amount proposed. He f urt6er stated that it is staff's
recommendation that the original assessment be reaffirmed.
Mayor Ellison cautioned the public about rehashing the subject
before the Council,
Mr. Colbert stated there were three options:
1. Reaffirm the original assessmentf
2. Accept the special assessment recommendation; or
3. Establish a new plan.
