We have tried contacting you via telephone to discuss drainage with you in the past. Currently, the line from your sump pump drains onto the immediate back yard of the subject Lot, and caused delays for the scheduled final grade. Your line from your sump pump should be directed to the back of your lot, following the natural drainage flow. * To our knowledge, after contacting our sub-contractors, we are not aware of any electricity supply conflicts. * We questioned our carpenters, and have absolutlely no reports ofharrassment from Eagan police, and cannot imagine any situation to which you vaguely indicated. It is normal for young children to be wary of strangers, but we have never k-.own our sub- contractors to frighten children. (One of our framers did yell a Greeting to the school bus, directed to HIS NEPHEW, who rode the bus. Other instances, we repeatedly told kids to get off our dirt pile and not to play in our lumber.) * As for the electricity lines, the landscaping around the electric tranformer is on the Lot line, and interfered with the process for connection. * Gopher One was contacted, and it is their responsiblity for the cable TV line. * As for your one sprinkler pipe damaged by the surveyor, we would like to point out your sprinkler pipe was on the Lot Line, and in some parts, well over your Lot Line, instead of inside your Lot parameters. It would not have interfered with surveyance had it been properly installed on your property. It is also possibly against the Law to remove a surveyor stake, with up to a $700. fine. Traffic shall be allowed to pass and to be protected at all times. If it is not possible-.;to allow traffic to pass, a suitable detour must be provided and plans submitted to the Director of Public-Works 72 hours in advance. 2. OPERATIONS. 1. Provisions and Specifications--These general provisions, specifications and Std. Plate P-1 shall be considered as forming an integral part of. each and every permit issued for operations with Eagan. The work authorized by this permit shall be done at such time and in such manner as shall be consistent with the safety of the public and shall conform to all requirements and standards of the City. If at any time it shall be found by the City that the work is not being or has not been properly performed, the permittee, upon being notified by the City in writing, shall immediately take the necessary steps, at his own expense, to place the work in condition to conform to said requirements or standards. 3. Execution-The permittee shall use diligence in the execution of the work authorized under this permit in order not to endanger or unnecessarily obstruct travel along any roadway. Operations shall be so conducted at all times as to permit safe and reasonable free travel over the roads within the limits of the work herein prescribed. All safety measures for the free movement of traffic shall be provided by the permittee at his own cost. 4. Conformity to Laws--The installation shall be made in conformity with all applicable laws, regulations and codes covering said installations. All installations shall be made in conformity. with regulations of governmental agencies for the protection of the public. a. The applicant shall furnish a bond in the amount of $1,000 which" is required to insure adequate & timely completion of street repair. Except for the negligent acts of the City, its agents and its employees, the permittee shall assume all liability for, and save the City, its agents and its employees, harmless from any and all claims for damages, actions or causes of action arising out of the work to be done herein and the continuing uses by the permittee, including but not limited to the placing, constructing, and reconstructing, maintaining and using of said utility under this application and permit for construction. 5. Existing Facilities--The utility facility and installations shall not interfere with any existing utility facility on the City's right-of-way. 6. Private Property--The work permit or permit for construction as issued does not in any way imply an easement on private property. 7. Quality of Work--Finished surface, base and sub-base of road upon completion of work shall be at least equal to or better- than specifications of original road in accordance with City Standard Specifications. Surface shall be finished within 48 hours upon completion of backfill. 8. Cutting Trees--The permission herein granted does not confer upon the permittee the right to cut, remove or destroy trees or shrubbery within the legal limits of the roadway or relieve permittee from obtaining any consent otherwise required from the owner of the property adjacent thereto. 9. Drainage--All waterways and lines of drainage shall remain operative. 10. Pole Anchors--No pole anchors, anchors, braces or other construction to be put on roadway shoulder, except by permit authorization. 11. Driving Limitations--No driving onto highway from ditch or driving on shoulders or over curbs where damage will occur. 12. Lugs on Equipment--No lugs shall be used on equipment traversing road which will damage the road surface. 13. Clean-Up--Street surface and roadside shall be cleaned after construction is completed and left in a neat and presentable condition. 14. Trees and Vegetations--Burning or disking operations and/or the use of chemicals to control or kill trees, brush and other vegetation is prohibited without prior approval from the City. 15. Replacement of Sod--Wherever top-soil and sod are disturbed, they shall be replaced and maintained satisfactorily until the turf is established.
