On or about January 18, 1983, the Eagan City Council granted a Conditional Use Permit for the outside storage of no more than 40 tractor-trailer trucks on the parcel. The Council also granted variances from the setback pro- visions under Eagan's Zoning Ordinance No. 52 to authorize a 10-foot setback along the East side of Mike Collins Drive from Apollo Road to 120 feet South; from that point to the southerly boundry of the parcel there was to be the normal 20-foot setback. The concrete contractor hired to install the parking lot curbs measured the setbacks from the City curb along Mike Collins Drive; rather than from the right- of-way line and laid the parking lot curbs and paraile1 pad in accordance with his measurements. As a result, the setback from the right-of-way of Apollo Road to 120 feet South is approximately three feet and the setback from there to the southerly boundry line of the parcel is 13.1146 feet. My clients propose to remove all curbing and pad from Apollo Road to approxi- mately 120 feet South, to remove two improperly placed concrete spillways, and to relay the curbs and pad to conform to the 10-foot (from right-of-way) setback. They further propose to obtain an amendment of the original variance to allow a 13.1146 setback from a point approximately 120 feet South of Apollo Road to the parcel's southerly boundry. According to the conditional use permit, North Star Transport Inc. was allowed to store 22 tractor trailers on the premises. As indicated co the site plan which ac-- =Tpanied the conditional use application, there is nothing in the conditional use permit to allow additional tractor trailers to be parked or stored co the stub street portion of Apollo Road. In reviewing this situation on April 30, 1981, it was apparent to staff that there were app=dmately 9 trailers stored on this por- tion of Apollo Road. It has also been the staff's understanding that the Building Department has con- tacted you in regard to parking the tractor trailers stored on the stub portion of Apollo Road, because on May 10, 1982, a detour will be provided through this area with the iuprovement project for T.H. 149. The City just wanted to inform you that the parking of the tractor trailers on the stub portion of Apollo Road is in violation of the conditional use permit, and hopefully this problem has been resol- ved. In the future, when the T.H. 149 project has been completed, there should be no parking of trailers on this section of Apollo Road. If you have any questions regarding the parameters of the conditional use permit for storage of tractor trailers, I have enclosed a copy of the staff report and conditions placed on North Star Transport Inc. North Star and 789 shall notify Eagan upon the conveyance of any of the lots referred to in this Agreement or if the Lease between North Star and 789 should change significantly or terminate. 2 5. Eagan may, at any time, subject to ninety (90) days written notice to North Star and 789, require that North Star and 789 abandon the use of said Apollo Road right-of-way, including the removal, at 789 and North Star's expense of all improvements placed on the road right-of-way so as to restore the road right-of-way to a condition satisfactory to Eagan for the construc- tion of an improved roadway with boulevards over and across said right-of-way. It being understood that such request by Eagan for abandonment of the roadway by North Star and 789 will be made in the event that a motorized vehicle crossing is permitted or allowed across the existing Milwaukee-St. Paul- Pacific Railroad right-of-way lying easterly of the extension of Apollo Road, whether such permission is granted by vacation of the Milwaukee Road right-of- way, grant of a permit by any public authority authorized to do so, or for any other reason determined by Eagan that Apollo Road should be improved and/or extended across the railroad right-of-way. 6. North Star and 789 agree to comply with all setback requirements of the City in the event of the abandonment of the Apollo Road right-of-way by North Star and 789 at any time in the future. 7. The APC recommended approval with certain conditions. It was noted that the Church Board of Beautiful Savior Lutheran Church had no objection to the application. Smith moved, Parranto seconded the motion to approve the application noting that the 300 foot distance between the church and liquor estabishment is being waived because the Church Board approved the waiver; that the restaurant faces away from the church building, and further that there is a grove of trees between the buildings. All voted in favor except Wachter who voted no. Parranto further moved, Smith seconded a motion to grant the 3.2 beer license conditioned upon meeting all City requirements. No more that 22 trailers and 6 tractors shall be parked on the premises at any one time. ; 2. The parking spaces shall be expanded to a 10 x 20 foot dimension rather than 9 x 19 feet. 4. The driveway entrances and auto parking areas shall be blacktopped and concrete curbing shall be provided around the perimeter of these areas. 5. Mr. O'Toole and Mr. Torgerson were present as was C. E. Dahlgren on behalf of the applicants. Mr. Dahlgren stated that. the right- of-way on Pilot Knob Road is now required to be only 50 feet and that all lots can now be corrected so that no variance is required for frontage or setback purposes. Several neighboring property owners appeared and strongly objected to certain aspects of the proposal including one owner on the south side objecting to the location of the cul-de-sac street entering upon skyline Drive. It was noted that the south 30 feet of Skyline Drive is dedicated and that the City maintains a part of Skyline Drive to Highview Park. An objec- tion was raised that certain lots had less than 60-foot frontages on the street and further objections to any accesses to Skyline Drive or Pilot Knob Road. C Parranto moved, Smith seconded a motion to approve the application for preliminary plat approval subject to the conditions imposed by the Advisory Planning Commission that the plat be revised to provide for 60-foot frontages on all lots on the cul-de-sac street and with the understanding that no variances would be permitted. Eagan may, at any time, subject to ninety (90) days written notice to North Star and 789, require that North Star and 789 abandon the use of said Apollo Road right-of-way, including the removal, at 789 and North Star's expense of all improvements placed on the road right-of-way so as to restore the road right-of-way to a condition satisfactory to Eagan for the construc- tion of an improved roadway with boulevards over and across said right-of-way. It being understood that such request by Eagan for abandonment of the roadway by North Star and 789 will be made in the event that a motorized vehicle crossing is permitted or allowed across the existing Milwaukee-St. Paul- Pacific Railroad right-of-way lying easterly of the extension of Apollo Road, whether such permission is granted by vacation of the Milwaukee Road right-of- way, grant of a permit by any public authority authorized to do so, or for any other reason determined by Eagan that Apollo Road should be improved and/or extended across the railroad right-of-way. 6. North Star and 789 agree to comply with all setback requirements of the City in the event of the abandonment of the Apollo Road right-of-way by North Star and 789 at any time in the future. 7. It is further agreed that North Star and 789, hereby waives any right to object to or appeal any special assessments levied by Eagan for the improvement of said Apollo Road right-of-way at any time in the future as determined by Eagan. 8. It is understood and agreed that this Agreement may be recorded with the Dakota County Recorder's office and in the event that Eagan requests that North Star and 789, its successors or assigns vacate the Apollo Road right-of- way, that North Star and 789 execute any and all documents, including a Quit Claim Deed necessary to transfer all interest in said right-of-way to Eagan. 9. There was some discussion regarding one or two design features of a cosmetic nature. Because of this concern, it was suggested that the plans be only preliminarily approved, noting that the layout and basic structure were completely satisfac- tory to the Council. Wacter moved, Egan seconded the motion to approve preli- minarily the final design of the City Hall project as reviewed to date and direct the Architect to prepare the final cost estimates before the final design is approved and bids are authorized for the new City Hall building project. NORTH STAR TRANSPORT CONDITIONAL USE PERMIT Dennis Briguet appeared on behalf of North Star Transport and 789 Company in regard to the conditional use, variance and easement requested in regard to truck terminal operations on'L`ots 1 and 2, .Block 4, Eagandal6-Cent er_Indus- '/trial Park 7i3,.,iThe proposal is- fora conditional use permit for the outside storage of tractor trailers and tractors, a reduction of setback variance and an easement for the use of Apollo Road, east of Mike Collins Drive, due to the lack of a crossing over the Milwaukee-St.Paul-Pacific Railroad. Council was advised that an Agreement had been drawn up between North Star Transport and 789 Company, and the City of Eagan. Egan moved, Smith seconded the motion to approve the request, subject to the conditions: 1. Those imposed by the Advisory Planning Commission, including: a. That the applicant abandon the easement to the City when requested by the City, specifically, if, 1) The railroad should abandon the Milwaukee Road right-of- way to allow a crossing for Apollo Road, 2) The Public Service Commission grants a permit for such railroad crossing, and 3) A crossing of the railroad right-of-way is authorized for Apollo Road. b. That no more than 40 tractor trailers shall be allowed to be stored on Lots 1 and 2, Block 4. C. That the applicant shall provide adequate dust control measures on crushed limestone surfaces on a regular basis. d. That a detailed landscape plan shall be provided and a land- scape bond of an adequate amount shall be provided and not released until one year after, the landscaping has been com- pleted. 5 Council Minutes December 7, 1982 e. That the applicant comply with all other City Ordinances. f. That the applicant is responsible for any assessments that may accrue for the extension of Apollo Road, and g. That the applicant is required to comply with all the existing setback ordinances upon abandonment of the easement. 2. Those imposed by the City Council, including: a. That the applicant is responsible for the reconstruction of Apollo Road upon abandonment, for whatever reason, of the easement. b. That detailed site and drainage plans be approved by staff. C. That the City be notified of a conveyance of any of the affected parcels or a change in the contractural relationship between North Star and 789. All voted yes. CABLE TELEVISION JOINT POWER AGREEMENT The Council then reviewed the Joint Powers Agreement proposed by legal counsel for the Cable Commission. There was some discussion regarding Article VI, Section 2, requiring that one of the members of the Commission from each City be a council member. No change was recommended at this time. Thomas moved, Egan seconded the motion to approve the Joint Cooperative Agreement for the administration of a.Cable Communication System. All voted yes. SEE AGREEMENT FILE CONTRACT #82-14 - BIDS Bids for Contract #82-14 were received and reviewed by the City Council. Appearances were made by a second low bidder, Chicago Bridge & Iron Co. and the low bidder, Nebco, Inc. It was pointed out that there was a cheaper cathodic protection system than the Wallace & Tiernan anode system requested in the bid specs. However, it was pointed out that neither of the low bidders had used the alternate system in their bids. Therefore, the bids appeared comparable. Egan moved, Wachter seconded the motion to receive the bids, authorized the Mayor and City Clerk to execute all the required contract documents and award the contract to the low bidder, Webco, Inc. in the amount of $531,190.00. All voted yes. 6 00235 Council Minutes August 16, 1983 SCHWANZ LAKE TRUNK STORM SEWER - PROJECT #383 The next public hearing convened by the Mayor concerned Project 0383 consisting of Schwanz Lake trunk storm sewer. The hearing had been continued from August 2, 1983 in order for staff to research additional information. Staff indicated that they could find no evidence of a 24 inch storm sewer from the Northview Meadows project being installed during 1983 and indicated that a 24 inch storm sewer will be discharged in the vicinity of Schwanz Lake upon completion of Phase 2 of Northview Meadows. Some erosion has taken place as a result of the trunk sanitary sewer lines installed north of Wilderness Run Road, but it did not appear to be carried into the lake by run-off from the area. It was also recommended that the drainage diversion from Northview Meadows directly south to Pond LP 61 would not be economically feasible and recommended the utilization of Schwanz Lake. Mr. Hefti reported on behalf of the staff and stated that the Northview Meadows developers are attempting to pond some of the water on their own property. Mayor Blomquist suggested the Park Director have direct input concerning the pond and Mr. Vraa was not present. He had had concerns about the potential loss of trees and the Park and Recreation Committee's input in the entire process. A number of neigh- boring owners were present with concerns about assessments and also the impact, on the proposed park, erosion control from Northview Meadows and stated that in their opinion, significant erosion has taken place in the area. Councilman Smith stated that it is important to proceed because of the high lake level. Some owners recommended that the Council forstall the project for another year because this is a high water level year and only two significant trees allegedly were in danger. It was noted that the consideration of the item was inadvertantly left out of the information column in the Chronicle, although, the continuation had taken place at the last meeting. Smith moved, Egan seconded the motion to close the hearing, to order in the project and autho- rize the preparation of plans and specifications. Mayor Blomquist recommended a continuance for additional information. Those in favor were Smith, Egan and Thomas; those against were Blomquist and Wachter. NORTHSTAR TRANSPORT - VARIANCE The application of Northstar Transport, Inc. for amendment to the origi- nal variance to allow a 13.1146 foot setback for the Northstar Transport property on Lots 1 and 2,~Block 4, Eagandale Center Industrial °ark 03 was subitted for-review. In January of 1983, the City Council granted a condi- tional use permit for outside storage and variances from setback provisions. It was noted that the concrete contractor installed the parking lot curbs incorrectly and the request for variance was brought to the Council. Dennis Briguet, attorney for the applicant, was present and indicated that contacts had been made with all neighboring property owners and consents have been given. There were no objections.
