I spoke with Mr. John Denny regarding a claim he has presented to
the City of Eagan for water damage to his property that occurred
in approximately January 1988. Apparently, he has spoken with two
(2) adjustors, both of whom are no longer working on the case and
there is now a third individual assigned to the Denny's claim.
I would appreciate your reviewing this case and expediting
settlement discussions with Mr. Denny as soon as possible.

The City Administrator has informed me that Mr. John Denny who
resides at the above residence is continuing to have problems
associated with settlement of his yard, driveway and trail as
well as structural cracks occurring in his basement.
While I realize that the City's insurance company has worked with
Mr. Denny to try and repair the problems associated with the
watermain break that occurred last winter, I would like to have
you be the City's representative on Mr. Denny's behalf in working
with the insurance company to insure that all repairs are
performed to his satisfaction.
Please let me know if you need any assistance or direction in
bringing a satisfactory resolution to this unfortunate situation.

Dear Mr Mayor,
For the past sixteen months my property has been in one state of
uproar or another due to either the Mooney Lake Drainage project,
begun in the early summer of 1987, or the bursting of a water
main under the street in January of 1988. May I make the
following requests:
1. Due to the fact that the street, the boulevard, the sidewalk,
and my basement are buckling and falling, can someone from the
city PLEASE check to make sure that the water main in not still
leaking.
2. If it is not leaking, can my gutter, boulevard and sidewalk,
be raised in some way so there is not a depression there.
3. If everything is determined to be OK under the street, can the
boulevard and portions of my yard that the steam roller drove on
be resodded.
4. When all of that is done, can the street in front of my house
finally get swept.
5. I would very much appreciate an explanation of why only half
of my driveway got fixed.
6. Can anyone give me the name of a landscaping company that will
take on the job of fixing the massive erosion of my terracing. So
far, no company in possession of a telephone will even extend the
courtesy of coming to have a look. I need immediate help on this
one.
7. I will be happy to sign the RELEASE from GAB Business Services
once I am assured in writing that 1.) the water main is no
longer leaking 2.) my house is not ready to collapse due to
erosion from previous or existing water main leakage.
8. For their own protection, the Park Dept my want to put a fence
across the end of Berry Ridge Road, simply to keep errant copies
of the Eagan Newspaper from blowing into Patrick Eagan Park,
(whereupon I go in and pick them out of the trees and bushes.)
I do realize that you are all busy people, but on the other hand
I have had to look at some sort of city-caused disaster every
morning for over sixteen months. For your own information, the
kindest word that can describe the city's treatment of this
matter (with several notable exceptions), is unresponsive. It has
had me feeling for a long time that maybe my requests were out of
line.
I keep bugging my neighbor Tom Hedges about this and I'm sure
that more important things keep taking precedent as far as he is
concerned. I would be more that happy to take the time to
personally explain the entire situation to the person whose
authority can help resolve this ongoing problem. Please let me
know how I can help.

Dear M.L.Politte,
As regards GAB File Number 56542-05035, a claim made against the
City of Eagan, for property damage due to a broken water main,
please let me call the following to your attention.
As of the end of February, enough springtime has occurred to
reveal that I have been correct: in my suspicions that support in
the form of sand, rocks and dirt, for large sections of the
driveway at 1251 Berry Ridge Road have indeed been washed away.
This conclusion is supported buy the fact that several sections
of the hard surface have collapsed, and several others have a
distinctly hollow sound when tapped.
We have three mains areas of concern: Cleanup of dirt, sand and
rock on the driveway - Repair (quite possible replacement) of
large portions of the driveway - and repair of a brick walkway
around the house. I built the walkway and will repair it myself,
quite probably with material from the large sandpile that
currently resides on top of the driveway.
The main point of this letter is that the construction of Eagan
City Project # 473 a.k.a., Pilot Knob Trunk Storm Sewer, a.k.a.
(locally) The Mooney Lake Disaster, required the tearing up and
replacement of the sidewalk in front of 1251 Berry Ridge Road.
The reconstructed sidewalk has collapsed and been repaired
several times.
It would be worthwhile and economical for all parties concerned
to consider the repair of the street, the repair of the driveway
and the repair of the unrelated sidewalk as one project since
they are in placed physically connected and in other places only
removed by several feet. Driving by this property will make this
fact immediatly apparent.

In regards to the wall problem in your garage at 1251 Berry
Ridge Road. I stopped and inspected the wall and saw that it had
slipped in at the first joint above the floor. The slippage
appears to be about 3/4" at the widest. We propose to leave the
block wall as is and pour the cores full of concrete with 1 - #5
rebar every 32". This will hold the wall from moving in the future,
after that we would straighten the wood wall by sliding it over on
the concrete and refasten it to the concrete wall.
Please let me know if this would meet with your wishes.
