The home is located at 1367 Berry Ridge Road and is owned by Steven Pokrzywinski, who is the owner and operator of Midland Electric, Inc. A petition was received by residents early this year asking that the City enforce City Code Section 11.03 and 11.20, Subdivision 5, with regard to acceptable home occupations within an R-1 district. These people were in violation of using their home and garage as a home occupation and, specifically, vehicles parked on a residential street were creating a poor image and creating a safety problem for the neighborhood. The Assistant Planner notified these people that they were in violation of the Eagan City Code in a letter dated March 26, further stating that the Eagan Police Department will be monitoring the premises to ensure compliance with the home occupation ordi- nance. To date, I have observed no action on the part' of the residents to disband the home occupation or bring their property into proper compliance. The neighbors have been patient and I have informed them many times that action is being taken by the City. However, the problem is still existing and I am questioning the course of action that was used to resolve this issue. Please review the file and share notifications, citations or any other information with me so I can provide some assurance to the neighborhood. A home occupation shall not be interpreted to include beauty or barber shops, tourists homes, restaurants or similar use; however, these may be allowed as permitted under Section 11.20 of this Section. 29. The planner briefly reviewed the application requesting 10 feet closer to the front property line than the ordinance mini- mum. Topography is the reason for the request for variance with the property dropping sharply to the north side toward the pond. There were no objections to the application and all owners within 200 feet of the property are expected to sign a petition indicating no objection. Smith moved, Wachter seconded the motion to approve the application subject to compliance with all other ordinance requirements and submission of the statement from all neighboring owners within 200 feet indicating no objection to the application. UNITOG RENTAL SERVICES - INDUSTRIAL REVENUE FINANCING The request of Unitog Rental Services for final resolution for industrial revenue bonds in the amount of $1,815,000.00 was then brought before the Council. KINDER CARE LEARNING CENTER - CITY CODE INTERPRETATION A letter was received from Midwest Builders Realty requesting City Council interpretation of the City Code to allow a free standing building for day care center within the planned unit development in the Pilot Knob Shopping Center area. The Council had indicated that the ordinance requirement that a building of at least 20,000 square feet be installed in the shopping center before any other buildings, must be complied with before approval of the application. This construction vehicle is used in the business known as Midland Electric; and, WHEREAS, complaints had previously been received in the form of a petition from the residents of the Hilltop Estates neighborhood complainilAg about the business being operated out of the home of 1367 Berryridge Road and notice of the complaint was sent to the owner, Steven Pokrzywinski, on March 26, 1985; and, WHEREAS, Eagan Ordinance Section 11.03, Subd. 2, prohibits the carrying on an ele,;trical business out of a home in a residential district and further prohibits the parking of vehicles used in a business in front &c a home in a residential district except for three parking spaces for the occupant and visitor's vehicles; and, WHEREAS, Eagan Ordinance 11.10, Subd. 19 (E), Parking Limitations on Large Vehicles+ Provides that the Council may direct the removal or otherwise limit the parking of any large vehicle upon or adjacent to any resici-itial use where a detrimental effect Pon residential it is determined that said parking has use; and, WHEREAS, the parking of a construction vehicle such as that described in a residential district constitutes an attractive nuisance and a danger to children in the vicinity, limits parking space available to other residents, and it is considered to be unsightly and a nuisance to neighboring residents. f r t NOW THEREFORE, upon motion by Smith , seconded Thomas , it was RESOLVED as follows: 1.
