Eagan hereby grants a conditional use permit for truck terminal on Lot 4, Halley's First Addition. 2. Mulvihill agrees on his behalf and on the behalf of any heir, successor or assign of Lot 4, Halley's First Addition, that he will not object to his fair share of assessments being levied against Lot 4, Halley's First Addition at such time as the Eagan City Council orders the installation of street improvements and utility improvements benefitting said Lot 4. In addition, Mulvihill, his heirs, successors or assigns, agrees to pay all special assessments levied against such property for the improvements mentioned above at such time as the improvements are ordered in and assessments are levied by Eagan. 3. In addition, Mulvihill agrees to all of the conditions imposed by the Advisory Planning Commission on July 31, 1979, and the Eagan City Council on August 21, 1979.
