My elevations indi- cate the newly constructed drainage will drain the areas it did be- fore, except the north portion of said Lot 3 and along the souther- ly lot line of the Art Mulvehill property. The City will require you to widen and properly slope and establish vegetation on the slopes of the newly constructed drainage ditch so it will not fill in with silt and become blocked. The City will require you to construct a drainage swale along the common lot line of the Art Mulvehill property and your Lot 3 to pro- vide drainage of the low unfilled area of your Lot 3 and low area of the Art Mulvehill property. The swale is to terminate where the existing drainage ditch now terminates. This drainage ditch will replace the existing drainage ditch which crosses Lot 3 diagonally. Kirscht, This is in response to your registered letter of August 26, 1983 to us on "Drainage Across Lot 31 Block 1 Halley's 1st Addition'". We first wish to state some facts so they get on record. The ditch which drains the water was a man, made ditch and was prob- able a temporary thing at the time. Also, the county has no drain- age easement on the property, nor has Eagan. We propose to do the following so as to make our lot buildable and useable. We will dig an open (temporary) trench along our south property line going from east to west leaving the water go at the same place as the old ditch. We will grant no easements or access on our land to the city of Eagan. We will hold Eagan responsible for all the water going on the other peoples property. The open ditch will only be till the road is upgraded such as blacktop or raised in any way. At that time it will be the responsiblity of the city of Eagan to get rid of the water another way. We reserve the right to close the trench till such time as up- grading with a suitable and sizeable pipe necessary for drainage. If acceptalbe, please make a copy of this letter, sign it, and send it back to me. We will have work completed on the open ditch in less than 10 days after receiving this letter at our cost. Our records indicate you are the owner of said Lot 3. You have been doing some filling and have partially blocked a drainage ditch which drains public right-of-way. The City cannot allow you to block drainage that could cause public right-of-way to be flooded and wants the situation cor- rected. The City will require you to submit a grading and drainage plan for approval indicating how you are going to provide drainage for the existing public right-of-way before you proceed with any further filling. The City is requesting that you take the initiative to try to resolve this drainage problem by, first of all, reopening the filled portion of the ex- isting drainage ditch. You also have the option of submitting a grading and drainage plan to the City for approval by relocating the drainage ditch, or you can submit a petition to the City for a storm drainage system to be con- structed by the City. The City could invoice the cost to you and/or also the City could assess it against said Lot 3 and/or, if other property owners sign a petition, the City would hold a public hearing and the City could assess the cost of the said drainage system against the benefitting properties. The City will not allow any further'developement in this plat until this drain- age problem is resolved. HEFTI, ASSISTANT CITY ENGINEERL`4 DATE: MAY 10, 1983 SUBJECT: BISCAYNE AVENUE DRAINAGE, ~T5EV & FIRST ADDITION As per your request, elevations have been taken to determine if the drainage across Lot 3 may be diverted overland, since the property owner wishes to fill this lot for building purposes. Currently, there exists a very shallow ditch running diagonally across Lot 3 from approximately 25' south of the northeast cor- ner of this lot to approximately 40' east of the southwest cor- ner of this lot. Furthermore, there was water sitting in this ditch when we took these elevations. From the elevations we took, it would be possible to provide drainage along the south lot line of Lot 3 to the west. However, it would be rather difficult to provide drainage to the south along the west line of Lots 2 and 1 due to a slight ridge loca- ted approximately 50' south of the southwest corner of Lot 3. Therefore, in order to maintain drainage within this Addition, it would be necessary to construct a temporary ditch approximately 40' east and parallel to the west border of this Addition. This spot elevation of 98.36 is the high point of a slight saddle, beyond which the drainage is towards the south.
