The items reviewed are as follows: 1. The owner agrees two only two access points from the lot. As of December 22, 1997, only two access points exist. One on Biscayne Ave. and one on gun Club Road 2. No outside storage would be allowed. There is a certain amount of outside storage at this site that includes car pants, a trailer, fork lifts and other debris 3. The owner shall provide adequate dust control measures on the gravel surface on a regular basis as approved by the City. There is no indication of any type of dust control currently been used However, the ground is frozen which eliminates the current need in addition, the driveway from the back of curb to the overhead garage doors has been paved with concrete. 4. At the time the area is served by utilities, the lot shall be upgraded to comply with current zoning requirements. This is an item that should be addressed by the Community Development Department. (called Owner) of 776 Golden Meadow Road, Eagan, MN 55123 , (address); WHEREAS, the owner has submitted an application to the City for a building permit for an industrial building on Addition, Dakota County, Minnesota; and WHEREAS, the owner has submitted an application to the City for variance from the City requirements for the installation of curb, gutter and paving requirements, and utilities in streets adjacent to Lot 1, Block 1, Halley's 1st Addition; and WHEREAS, the Eagan City Council considered the application of owner at its regular meeting on May 1, 1984; and WHEREAS, the Owner desires to have the installation of such improvements and the levy of assessments for such lateral improvements postponed until such time as such improvements are installed in Halley's Addition; NOW THEREFORE, upon the consideration of the mutual covenants herein, the parties hereto agree as follows: 1. The City agrees to grant owner the variance request until such time as the Eagan City Council decides to install such improvements, including streets and utilities in Halley's 1st Addition, including the streets adjacent to Lot 1, Block 1, thereof. 2. The City and Owner mutually agree that assessments for such improvement connection shall be made at the prevailing rates in existence at the time of the installation of such improvements. 3. The Owner, for itself, its heirs, executors, administrators, successors and assigns, hereby waives notice of any and all hearings necessary and waives objection to any technical defects in any proceedings related to any future assessments for such improvements and further waives the right to object to or appeal from any such future assessments made pursuant to this agreement. 4. The City and Owner mutually agree that only two access points from the lot would be allowed to City streets; that no outside storage shall be allowed; that the owner shall provide adequate dust control measures on the gravel surface on a regular basis as approved by the City; and that at the time the area is served by utilities, the lot shall be upgraded to comply with current zoning requirements. 5. The undersigned hereby agree that this agreement may be recorded with the Dakota County Recorder and that the owner shall provide and execute any and all documents necessary to implement the recording of this agreement including the delivery of the Owner's Duplicate Certificate of Title to the affected lands if necessary. i ~ i 6. Mr. Ingraham and Tom Colbert detailed the application and Mr. Laurent was present.
