Dear Ms. Nyeggen:
In response to your call on June 30, 1992, regarding Leroy Berg, Weed Inspector, and your
complaint regarding weeds/establishment of lawns near your home; I asked Superintendent
of Parks, John VonDeLinde, for a chronological report on actions taken in regards to these
lots. In addition, I visited the area to make my own visual inspection.
The home at 1559 Lakeview Curve, has chosen to use a wooden mulch blanket on their
property, preparatory to the establishment of shrubbery. Given the sloped back yard, this
use of a wood mulch blanket seems appropriate as a measure to control erosion. There are
numerous situations like this throughout the community, particularly where there are steep
slopes and turf establishment is difficult when seeding is the chosen method. From the
City's prospective, this is not a violation of the City turf ordinance, as noxious weeds are
effectively being controlled. Further, it appears that appropriate measures are being taken
to control erosion with the intent of establishing shrubbery and landscaping.
The lot at 3703 Blackhawk Lake Court is, as you know, under construction. Sienna
Corporation, which has owned the lot for some time, has been asked to cut the remaining
patch of weeds in the backyard area; this has not been impacted by construction thus far.
Assuming this is done, the lot would then be in compliance with the City Ordinance.
Hopefully, the new homeowners will follow through with establishment of their yard once
the home is completed.
You had also mentioned the lot at 3707 Blackhawk Lake Court, this lot was issued a weed
violation notice in May, of 1991. The second official notification was issued on June 21,
1991. Inspections reveal that the front and rear yard areas of the lot have been fully sodded
and the property appears to be well maintained at this time.

The last property that you mentioned was the installation of landscaping rock on one of the
lots which face Lakeview Curve. From my observation, it appeared that the individual was
putting down an underlayment for this rock, which is an appropriate measure for
landscaping. While landscape rock may not be the preference of many, it is an acceptable
practice and one that we do feel is within the City's regulations in regards to erosion, weed
control and landscaping in general.
I hope this response answers some of your questions and concerns. I am satisfied that all
appropriate actions have been taken by Mr. Berg in the fulfillment of his responsibilities in
regards to these lots, and that given the conditions of the lots, they meet city requirements.

SUBJECT: ANGIE NYEGGEN - WEED COMPLAINTS
This memorandum is provided as a follow up to our recent discussion concerning a series
of weed complaints/sodding violations which have been raised by Ms. Angie Nyeggen, 1571
Blackhawk Hills Road. It is my understanding that she has been in contact with the Mayor
alleging that the city has been ineffective in it's follow up and enforcement of several weed
violations in the Blackhawk Glen Addition.
On Tuesday, June 30, 1992, I visited these sites with the city's Weed Inspector Aide, LeRoy
Berg, to determine the current status of these complaints. Based on my observations and
discussions with Mr. Berg, it is my understanding that there are four related issues which
Ms. Nyeggen is concerned about.
Issue 1 - John Friel property - 3707 Blackhawk Lake Court.
Mr. Friel was issued a weed/sodding violation information notice in May, 1991. Failing to
cut the weeds on his property, a second official notification for eradication was issued on
June 21, 1991. That letter essentially required that Mr. Friel eradicate all noxious weeds
on his property and that he establish suitable turfgrass within one year. My inspection
revealed that both the front and rear yard areas of the lot had been fully sodded and that
Mr. Friel (who I assume to be the current owner) has been mowing the right-of way portion
of his backyard which affronts Blackhawk Hills Road. It is that right-of-way area,
incidentally, which is in direct view of the Nyeggen front yard. (Map is attached identifying
property.)
Issue 2 - 3703 Blackhawk Lake Court
This property which also backs up to Blackhawk Hills Road, is similarly in view of the
Nyeggen residence. A house is currently under construction at this address and should be
completed within the next four to six weeks. Mr. Berg has been in contact with Sienna
Corporation and asked that they cut a small remaining patch of grass in the backyard area
which has not been impacted by construction thus far. Assuming that this is done, this
action will bring this lot into compliance with the city's ordinance. Hopefully, the
subsequent new homeowners will follow through with sodding of the entire lot, and this will
effectively address any further concerns that Ms. Nyeggen may have.

Issue --3# - 1550 Lakeview Curve
Shown on the attached quarter section map, this property lies three or four houses to the
east of the Nyeggen property and backs up to Blackhawk Hills Road. It is my understanding
that in this particular instance, Ms. Nyeggen is upset about the property owners' use of wood
mulch on a side slope area which faces Blackhawk Hills Road. Here again Mr. Berg has
been in contact with this homeowner who indicates that he chose to use the wood mulch
blanket as an erosion control measure, and has plans to establish shrubbery within this
landscape bed. From my perspective I do not view this as a violation of the city's turfgrass
ordinance. Noxious weeds are being effectively controlled, there is no grass over six inches,
and appropriate measures are being taken to control erosion and sedimentation.
Presumably, the installation of shrubbery may help to diffuse Ms. Nyeggen's perception that
this is an "eyesore" for the neighborhood. While that may be the case from her own
perspective, I do not see the current situation as a violation of the city's ordinance. Frankly,
there are numerous situations like this throughout the community.
Issue 4 - Minnesota Department of Transportation Property between Federal Drive
and 35E
Ms. Nyeggen on several occasions has contacted the city's weed inspector concerning
MnDOT's management of their property between 35E and Federal Drive south of Violet
Lane. As I understand, Ms. Nyeggen's contention is that MnDOT should be mowing this
entire right-of-way area from Federal Way down the side slope to the fence paralleling 35E.
Currently, the city is mowing a six to eight foot wide swath along this section similar to other
rough cut areas along city streets. As I perceive it there are several problems with her
request. First, unless the city is prepared to maintain it's right-of-way areas, in a groomed
condition, it's hardly fair to ask MnDOT to do the same. Second, the state's pheasant
protection laws do not allow mowing of roadside or ditch areas prior to July 1st. Third, the
MnDOT outlot property contains no physical improvements nor is it developable property.
The city's weed enforcement/sodding ordinance has been more literally applied to
developed and developable lots within the community. Fourth, and finally, leaving this area
in a non-maintained condition for wildlife enhancement and visual buffering of the freeway
from the adjacent neighbors would appear to be it's highest and best use. Consequently, it
does not appear to be in the community's best interest to pursue this matter with MnDOT
officials.
I trust that this memorandum has helped to clarify the issues surrounding these weed
complaints as I understand them. If you need any further clarification, or if my comments
do not meet the satisfaction of Ms. Nyeggen or the mayor, please be sure to let me know.
