As you properly surmised, many different individuals were involved in completing this difficult construction project. Since so many different individuals have been involved with this project and its impact on you, I will try to consolidate their understanding of the situation in this letter. The attached letter from Dave Keller to you dated October 12, 1988 explained the City's position that the Easement Agreement does not include a guarantee for the transplant of trees. It is my understanding that the compensation paid to you for the easements necessary to construct this project included the value of the land as well as the trees within those construction limits. The basic premise of City policy regarding easement acquisition is to compensate property owners for the value of the property taken rather than to provide negotiated improvements which are many times very difficult to complete in a satisfactory manner to the property owner. With the monetary compensation to the property owner, the property owner then retains the flexibility of performing whatever comparable improvements are to their desires, advantage and/or time frame. THE LONE OAK TREE ...THE SYMBOL OF STRENGTH AND GROWTH IN OUR COMMUNITY Page Two November 14, 1988 Therefore, when the City negotiated with you for an easement, it included compensation for the taking of the trees in question. The agreement to move the trees should not be considered as a part of the value of the easement agreement. Unless verified to the contrary, the compensation paid to you for the easement acquisition included the presumed loss of these trees. Tree transplanting is done as an option by the City to try and minimize the impact of the public improvement and to try and aesthetically enhance the project through this conservation measure. The mention of the tree location within the easement agreement was to assure you that it would be done at the expense of the City. However, transplanting trees of this size is very risky and, subsequently, guarantees would not have been appropriate. We believe that the attempt to try and save the trees was in concurrence with the Council directive and was worth the initial expense and effort as is evident by the many trees which were relocated as a part of this project. But because of the limitations and ability of the City to satisfactorily replace trees in like kind, initial direct compensation is more appropriate than guarantees. However, it is not our intent to burden you with any additional expenses with the removal of transplanted trees that did not survive. Therefore, if you would like to have the City remove these trees, I will provide that service upon receipt of a written request from you to do so. I am sorry for any misunderstandings or confusions that have resulted from this project. We had hoped that we had addressed your concerns during this project. Hopefully, this letter provides you with the formal position of the City that you have indicated a difficulty in obtaining. Please let me know if I can provide any further information as appropriate. It concerns part of the easement agreement for Hugh and Judy Stewart under that project. The part we are concerned with at this time that has been ignored by first the city attorney at that time, Dave Keller, who worked on the easements, then the engineer on the project Gary Kristofitz, American Tree Movers, Denny Seiz, who moved the trees, the public works director, Tom Colbert and last the mayor Vic Ellison. The problem here is two evergreen trues that were moved by American Tree Movers, Denny Seiz, in October of 1987. The trees were in the agreement to move because they were in the way of the tra.ilway. So we had the tree mover move them to another location on our property. We are not professional -tree movers so we expected their expertise on these matters. We do not know what the city of Eagan paid them, but Denny Seiz the tree mover, was timing every move he made down to the minute on his watch. He dug a hole then picked up the 30 foot tree with a 13 inch trunk and put it in place. He dug another hole and picked up the 20 foot tree with a 10 foot trunk and planted it. He also planted a smaller tree for us that we paid $50.00 cash for him to transplant. He wouldn't take a cheek. The one large 30 foot tree was taken off a side hill and transplanted the opposite way so the roots were sticking out, plus it was sitting up high so the water would run away from it. He told us to fill- dirt up Oh the side the roots were sticking out, but then we would have a hill on one side and our yard would not be at an even slope to cut with our lawn mower. We wanted him to dig the hole so it would fit the hole better or turn it around but he wouldn't do that. So we let it go and we put fertilizer stakes around the trunks and hooked up a pipe to our hose and watered them down to the roots, every other day that fall of 1987. Page 2 When spring came we started watering again, but saw signs of needles turning brown. We called Dave Keller the attorney that had worked with us on this agreement, but after several calls in March got nowhere. Hugh then went to his office, talked to him about them and said he would help. Hugh called the tree mover Denny Siez but got no help. "Then one day in April 1988, Tom Schuster the forester from Eagan came by to give his opinion of the trees. He felt they were dying because they were sitting to high up and the water could not sit around the trunk and soak in and the roots were sticking out, because they were Planted too high. No one ever got back to us so we called Dave Keller again in April and May and got nowhere. Talked to people working on the Blackhawk project and Gary Kristofitz the engineer on the project, but got nothing. ThenHugh finally called our new mayor Vic Ellison in May of 1988, and asked him what could be done. He said he would talk to the city engineer, Tom Colbert about the matter. Just for the record we would like to say our former mayor Bea Blomquist, said when this project on Blackhawk was in the planning that she wanted to save all the trees they could for the people on Blackhawk. Anyhow, to go on the mayor now, Vic Ellison talked to Tom Colbert and Tom came one day when we were not at home and said to Hugh by phone, that tie looked at the trees and felt they were dying because we had not watered them properly. We had watered all fall and spring. We have photos to show how there was moisture around the trees because of the growth of the weeds. Nothing else was done. Then, about the first of June 1988, we received a letter from Vic Ellison, stating he checked with Tom Colbert and he was working with us on this matter and hoped it would be taken care of soon and that was all we have heard since. We are wondering why no one will come out to our home and talk to us and discuss this problem, we are very disapointed in the city about getting no cooperation and having to fight the city on everything that happened with this project on Blackhawk. Now summer has come and gone and no one has done anything for us and the trees are definity dead, after doing everything we could do to save them. Now we are trying again this fall of 1988, to get some action. On about September 20, 1988, 1, Judy Stewart went to the city hall and talked to Tom Colbert's secretary "Judy". I asked for the Street Easement Deed and the notes on what we had signed in regarding our easement and moving these trees. She called Dave Keller and he located the Street Easement Deed and sent it to us. She also called Jerry Bourdon the other engineer on the Page 3 project and he told her he would head a committee with the city to see what could be done, but no one had contacted us about the matter and now it is November. I also called Dave Keller and asked for the notes on our agreement and he sent me a copy of them and a letter stating that perhaps the tree mover is at fault here and the city of Eagan should go to them for some help. This letter we received was sent October 12, 1988, to Jim Sheldon, Tom Colbert, and Jerry Bourdon. I would like to say that "Judy" at Tom's office has done more than anyone for us and been very cooperative and helpful, but she can only do so much. Now we want some action from the city or we will have to take some legal action. During this time of waiting we have done some research into what the experts recommend for moving trees and we have gotten some estimates on what the cost would be to replace them, which we have for you to see. We have found out through our research that the University of Minnesota recommends that for moving a tree, every inch of tree you need 10 inches of spade. Example: an 8 inch tree trunk would need an 80 inch tree spade. Bachman's recommends less than 10 inches of spade. That means being the tree trunks were 13 inches and 10 inches that maybe they were too big for his 90 inch spade that we think he used. The tree mover was the expert on this not us. We feel if they were dug deeper or used a bigger spade they would have survived. We also know that some people on Blackhawk Road that had trees moved, that died had them replaced by the city. Why can't we get our trees replaced? We are asking the city to please replace our trees or pay us the cost and we will have them replaced ourselves. We are asking that the city of Eagan does not continue to ignore us anymore. We are tired of asking for help and not getting it, after all it was the city that wanted the trailways on Blackhawk Road and because of it our beautiful big trees had to be moved and now they are dead. Thus,this opening will get a new lintel. The house is a rambler with a basement and a hand-framed roof.The wall in question is on the main level,approximately in the center of the house. The new lintels will support the attic and first floor ceiling. Based on my observations,I recommend using either a 3%z"X 9'/4"LVL or a 3%2' X 7'/4"LVL to span the 8 foot opening and(2)2X10's or(2)2X8's to span the new 5 foot o�ening.As discussed at the site,the lintels should set under the e�sting double top plate. The 5 foot lintel needs(1) 2X4 bearing stud while the 8 foot lintel needs(2)2X4 bearing studs.At the floor,provide a new 1-3/4"�9'/4"LVL floor joist below the bearing studs for the 8 foot lintel or provide double 2X6 blocking attached with Simpson hangers to the joists on either side of the bearing studs.A sketch is enciosed with this letter to further clarify these recommendations.
