However, the remaining assessments shall not be levied upon issuance of any building permit for: (i) construction or reconstruction of any primary single family home on the premises, so long as only one single family home is used on the premises; or, (ii) construction or reconstruction of any attached or detached garage; or, (iii) construction of any other ancillary structure permitted under the City zoning ordinance for agricultural or single family residential zones. B. The property is split or platted. C. The property is rezoned. D. The property is developed. 3. Upon the happening of any of the conditions specified in paragraph 2, the remaining assessments as described in Exhibit A shall be levied at the standard City assessment rates in effect at that time to be paid over a 15- year term at an interest rate of 10.5%. 4. TSCHERNE, SATURDAY, SEPTEMBER 15, 1984 The reason for my field trip was that I did not know which parcel Mr. Holden had his residence on. The aerial maps showed buildings on both parcels 070-05 and 060-05, the Planning Department housing inventory map indicated Mr. Holden's residence was on parcel 060-05 and the inventory map did not indicate a home on the Tscherne property. If I recall correctly, I left City Hall about 12:00 noon and I stopped at the Tscherne residence shortly thereafter. I went to the door of the Tscherne residence and Mrs. Tscherne came to the door and I said that I was from the City and I just wanted to make sure that when figuring the assessment roll I can give the homeowners p--oiler credit for storm sewer large lot credit. I had a section map and she indicated which property was theirs and she also pointed to the parcel which Mr. Holden had his home on and I could see it from the Tscherne residence also. One of the first comments she made was that they were going to appeal the assessments and she said they were in contact with an attorney and an appraiser. I indicated to her that I understood her situation and the only capacity I had in dealing with assess- ments is making sure that they are made out correctly in accordance with City policy. She indicated that the appraiser they talked to indicated that the City does a good job to substantiate the assessment rolls. Mrs. Tscherne said that approximately 3 years ago they bought this home with acreage and liked the woods and the quiet atmosphere and open space and now with the freeway and upgrading of Blackhawk Road that this atmosphere is disappearing and they don't like it. I indicated that the freeway was planned for 20+ years and when a highway of that nature is constructed it will certainly bring on development. Because of said freeway construction it would appear to me it would make easy access from Eagan to the airport and downtown Minneapolis and St. Paul. Mrs. Tscherne asked what the final numbers would be and cost of the assessments. - She complained that everytime she called City Hall she could not get any answers from Ann Goers and Donna. I told her that the reason why Ann and Donna could not give her information is because of all the development and other assessment rolls we were preparing and I indicated that I had been working overtime and I was unable to keep up with everything that was going on. I told her that based on construction costs and the work I had done already on this assessment roll that the assess- ments would be a little higher than what the feasibility report a4 Meeting with Mr. & Mrs. Tscherne October 23, 1984 Page 2 originally indicated. She indicated to me at this point that they could afford the assessments while they were both working but it would be an extreme financial burden. She indicated there would be no way they could afford them on one salary. At this time her husband Jay came home from the Holden residence. I again went over the assessment cost situation indicating that the final assessments were a bit higher than what the feasibility report indicated. About this time they were questioning me about some type of relief from the costs of the assessments and I indicated I didn't know of any City policy and indicated that could be discussed at the Public Hearing. I more or less took the position that the assessable cost would be final. I felt they were not too happy at this point. About this time they asked me about development of this area bounded by new 35E and south of Diffley Road and east of Blackhawk. I indicated to them that the City did not have any timetable for development but did have a Land Use Guideplan and zoning maps indicating how it may develop, that might help them. I informed them that they owned the land and it was at their discretion as to when their property would develop. They asked several questions concerning what might happen to parcel 020-05 which they considered land locked. I indicated that I felt that whatever happen as far as development would take the cooperation of the owners of 020-05 the Holdens' and themselves because I indicated it would be poor planning to have a street access too near the intersection of County Road, 30 and Blackhawk Road. I indicated that the State or County controlled access to County Road 30 for Parcel 020-05 and the State just may not allow access. I indicated that eventually some study will have to be made as to where a street access would be allowed for Parcel 020-05 the Holden property and their property. I indicated that I am sure the City has no plans on determining this until either the Holdens' or the owners of Parcel 020-05 presents plans to the City to develop their property. They asked me when that might take place. I said that no one in the City could tell them and they should contact the Holdens' and the owners of Parcel 020-05 and ask them what their plans are. I told Mr. and Mrs. Tscherne that it was up to the property owners involved as to when the area would develop,,. I also told them that if you sold your property to a developer that was the only way that their property would develop in the near future unless they did something themselves. I again told them they owned the property and they were the only people that had control of development at this time. They again started to ask questions about what could be built on their property. I stated that currently their land was zoned agricultural and they would have to get the zoning changed through the Political Process of the Planning Commission and City Council f Meeting with Mr. & Mrs. Tscherne October 23, 1984 Page 3 and they said they understood that. I told them the City had a land use guide plan and they asked me what was that. I indicated that I was going back to City Hall and I would give them one copy and they could study that and see the Planning Department to further help them. They still indicated that someone in the City should know how the property would develop. At that time I did not know what their property was guided for but I knew that parcel 020-05 was zoned for some type of business and since an oil company owned it I told them that said oil company may be speculating that it may be a good location for a gas station but here again I told them that what ever is con- structed there they would have to be notified and a public hearing and Planning Commission and City Council approval would be required. At this time we talked about what was taking place in other areas in Eagan. We did talk about the commercial development at Cliff and Nicols Road and the new SuperAmerica Station and Inn at Yankee Doodle Road at Pilot Knob. I told them to compare their land use guide plan with the property they own and that may give them some idea what could be done with their property but at that time I didn't know how their property was guided. About that time I was getting a little irritable about their questions and they were going to the airport so I started back to City Hall. They followed me and I gave them a Land Use Guide Plan and said they could get an idea of what may happen eventually to their property based upon what their property was guided for and what other properties in Eagan that have developed with the same guiding and I again told them to talk to the Planning Department. In the process of all this questioning I felt I should try to answer their questions as best I could because I would get blamed for not giving them information. They at times came on quite strong because I could not answer their questions with what they wanted to hear and I have a feeling that they feel someone in the City should do their planning for them since they are being hit with this large assessment. They asked me a question about what might happen to their taxes and I indicated that certain agricultural property (like farmland) may not be affected because of the improvements but I indicated that the Dakota County Assessor would be the people to ask. When they left City Hall they thanked me for my time and seemed to be quite satisfied with my answers. This pretty well summarizes what was discussed in the short time I talked to them. Darold Holden (10-02900-030-05) (10-02900-060-05) (10-02900-070-05) BACKGROUND INFORMATION While each of the above property owners have submitted individuals appeals/ objections, they are all neighbors affected by the same street and utility project. Therefore, it would be beneficial to discuss all four property owners' situations collectively to avoid any repetition. Project 317 provided for the installation of sanitary sewer, water, storm sewer and street improvements on Blackhawk Road from Diffley Road to the northside of I-35E/Blackhawk Road overpass. In order for the State to construct the 48-foot-wide bridge over I-35E, the City had to commit to a concurrent construction of Blackhawk Road from I-35E to Cliff Road and also to Diffley Road. Due to the fact that Blackhawk Road is 'classified as a municipal State-aid street, certain design standards had to be complied with. Prior to permanently improving a street to its ultimate design section, all underground utilities have to be installed. Subsequently, Project 317 was initiated and constructed during 1983. These four property owners along Blackhawk Road are existing residents who did not petition for improvements and expressed their objections at the time of the public hearing and have followed through with written objections at the final assessment hearing which was held on September 18, 1984. Enclosed on pages 6:1_through %1)_ are copies of the written objections submitted' by these four property owners. Enclosed on page is a topographic map referencing these four property owners and the parcels under their ownership. Enclosed on page is a breakdown of the assessments associated with each property showing the frontage and areas used to determine the final assessments based on the individual rates. The City Attorney and Public Works Director have had several meetings with these property owners from the inception of the project at the original public hearing to most recently on September 24 to review the concerns with the property owners listed as follows: 1. The project was not at the request of the property owners but rather initiated by the City over their objections. 2. The amount of the assessment exceeds the benefit to each of the parcels affected. 3. The amount of the assessments is excessive as to what each property owner can afford on a monthly/yearly basis. During the meetings with property owners, the staff has reviewed how the costs of the assessments were determined, the method used to calculate the i t F. The property owners are requesting further review by the Special Assessment Committee to see if any special consideration to their unique situation through the deferment, postponement or reduction of the assessments relating to this improvement. The staff has hired Mr. Dan Dwyer as an appraiser to evaluate the increase in valuation to the property as a result of this project in relationship to the amount of the assesments. At the time of this packet preparation, this appraisal report has not been completed. Therefore, it is anticipated that this information will be made available to the Special Assessment Committee at their meeting on October'9, 1984. STAFF RECOMMENDATION While the staff understands the situation and the concerns of the adjacent property owners pertaining to the assessments resulting from this project, the assessment revenue generated from this project had to be guaranteed against the sale of the bonds used to finance the construction of this project. If the appraisal report substantiates an increase in value to the property equal to or greater than the amount of the assessments, it is staff's recommenda- tion that the assessments be reaffirmed, adopted and certified to the County as presented at the final assessment hearing on September 18, 1984. Council Minutes January 18, 1983 CONSENT AGENDA The following consent agenda items were recommended for approval: 1. MSA Street Construction Program. The Engineering Division prepared a projected 5-year expenditure of MSAS funds with annual allotments of $425,000.00 per year for the 5-year period. The City would not be held to an anticipated time table for construction and the Council will retain some flexibility in revising the list. It was recommended that the Council approve the proposed 5-year MSA street construction program. 2. Project 0317 - Blackhawk Road Feasibility Report. In November of 1982, MnDOT awarded a Contract for construction of the interchange of I-35E with Cliff Road and also construction of the Blackhawk Road bridge over I-35E. The Feasibility report for Project #317 consisting of streets and utilities, south of County Road #30 on Blackhawk Road, has now been completed. It was understood that the Engineering Department will attempt to move the right-of- way of Blackhawk Road as far west as possible under Project #317 to minimize the impact on the existing homes. It was recommended that the report be accepted and that a public hearing be scheduled for March 1, 1983 at 7:00 p.m. at the City Hall. 3. Project #354 - Trunk Storm- Sewer _ Blackhawk Road. It was recom- mended that the Feasibility Report that has now been prepared for Project #354 consisting of trunk storm sewer improvements on I-35E and Blackhawk Road be accepted and approved by the Council and that a public hearing be scheduled for March 1, 1983 at 7:00 p.m. at City Hall. 4. Project f355 - South Blackhawk Road, Surfacing. With the improve- ments to Blackhawk Road on Projects #317 and #354 and the anticipated designa- tion of Blackhawk Road as a detour for County Road #30 during construction of County Road #30 interchange with I-35E during 1984, a Feasibility Report has now been prepared and it was recommended that the Report be accepted covering Project #355 and that a hearing on the report be scheduled at the Eagan City Hall on March 1, 1983 to begin at 7:00 p.m. 5. Project #367 - South Rahn Road - Sidewalk. It was recommended that a sidewalk be constructed along the north side of Cliff Road between Blackhawk Road and Rahn Road as a part of the I-35E/Cliff Road interchange. A Feasi- bility Report has now been prepared by the Consulting Engineer and it was recommended that his report be accepted and approved and that the public hearing on the report be scheduled before the City Council at City Hall on February 15, 1983 commencing at 7:00 p.m. 6. Project #370 _ Streets and Utilities - Dakota County Plat #l. The Preliminary Report covering Project #370 regarding feasibility report for Dakota County.Plat #1, streets and utilities has now been completed and it was recommended that the report be accepted and approved and the public hearing be scheduled for February 15, 1983 at the Eagan City Hall to begin at 7:00 p.m. Upon motion by Wachter, seconded Egan, it was resolved that the foregoing Consent Agenda items be approved and ordered implemented by the City staff. All voted in favor. 2 i 0 4 3 Council Minutes March 1, 1983 PROJECT #342 - CEDAR GROVE STREETS Mike Forester appeared with a Petition signed by approximately 100 persons requesting the Council resurface the streets in Cedar Grove Addition under Project #342 and that the Council not take bids on the installation of concrete curb and gutter. He stated 17 persons declined to sign and 14 stated they preferred curb and gutter in his survey. No action was taken. PUBLIC HEARINGS PROJECTS #355, #317, and #354 The Mayor convened the public hearings regarding Projects #355, Blaekhawk Road Surfacing south of I-35E, Project #317, Blaekhawk Road Streets and Utilities north of proposed I-35E, and Project #354, Blackhawk Road Trunk Storm Sewer at I-35E. Mr. Colbert and Mr. Rosene explained the projects in detail. It was noted that the MnDOT Park and Ride facility along the west side of the south end of Blackhawk Road would not be assessed for the street improvements, in that MnDOT has decided that it will not accept assessments for the improvements. The improvements would then be required to be paid from the City's major street fund. A number of affected property owners were present, some of whom objected to portions of the project. Tom Klein asked if grading and gravel base had been assessed and asked questions about the assessments. He was told that the grading and gravel base had been assessed on the southerly portion of Blackhawk Road and the proposal now is to complete the improvements including curb, gutter and surfacing. The construction is being built to 9-ton capacity because of anticipated heavy traffic. There were also concerns about need for traffic signals at Cliff and Blackhawk Road and also at County Road #30 and Blackhawk Road, but no signals are being planned at-Cliff and Blackhawk Road at the present time. There is a sidewalk plan on the west of Blaekhawk to connect with the sidewalk across the I-35E Bridge. Dave Sellergren, attorney for Cliff Road Properties appeared and submitted a written statement and also detailed some objections that Cliff Road Properties had to the proposed assessments. He stated that on-site ponds .could possibly handle the run-off and that the purpose for the storm sewer construction is solely for I-35E. He stated Pitt Lake is proposed to be raised about 4 feet and it may infringe on some of the proposed development area. He further stated there is no assessment proposed for City park land within the highline easement and requested that that area also be assessed. It was noted, however, that this is an area assessment at standard assessment rates for storm sewer purposes. He also questioned the sizing of the pipe and suggested that additional comments from Cliff Road Properties be allowed during the development process. He stated that there is no immediate plan for development of the Cliff Road site and that much of the proposal is not needed for that property at the present time. He stated under Project #317 there was concern about the site of the proposed easement for sanitary sewer and asked 3 W044 Council Minutes March 1, 1983 that the layout be reviewed with the staff. He indicated that it is not expected that the revenue from the development would justify the amount of assessments and therefore suggested several methods of relieving the assess- ment burden on the developer. There were numerous questions from council- members and Councilman Wachter objected to MnDOT not paying for its share of the cost along the south portion of Blaekhawk Road, adjacent to the Park and Ride site. Egan then moved, Smith seconded the motion to close the hearing regarding Project #355, to approve the project, to order in the project and authorize the preparation of plans and specifications. All voted in favor except Wachter who abstained. Smith then moved, Thomas seconded the motion to close the hearing concerning Project #317, to order in the project and autho- rize the City Engineer to prepare the plans and specifications for the project. All voted yes. Egan then moved, Wachter seconded the motion to close the hearing concerning Project #354, to order in the project and autho- rize the preparation of plans and specifications for Project #354. All voted in favor. LEXIBTGTON AVENUE - PROJECT #330 STREETS & STORM SEVER IMPROVEMENTS The next public hearing convened by Mayor Blomquist covered Project #330 consisting of streets and storm sewer improvements on Lexington Avenue from Cliff Road to Diffley Road. It was noted that a Petition had been received from the developer of the Lexington South PUD for improvement of Lexington Avenue and the City had entered into agreements with the developer and Dakota County for the ultimate upgrading of the road. The developer has dedicated the right-of-way and performed all necessary rough-grading prior to any con- struction by the County. It is understood that the County now has funds set aside for financing the improvements during 1983. There were no appearances by the developer but a letter from Rod Hardy of Sienna Corporation,requesting special consideration concerning the length of the assessment spread and the amount of the assessments,. in light of the fact that the developers.dedicated all necessary right-of-way and performed substantial quantities of rough- grading, at no cost to the City or County, was reviewed. Mr. Rosene presented the report and it was noted the project will be a County Road project. The City's portion would cover the utility improvements and 45% of the cost of upgrading the street. There were concerns by the Council that the Contract not be awarded until the issue with the developer is resolved. There were no objections to the project. Smith moved, Wachter seconded the motion to close the hearing, and to order in the project and authorize the plans and specifi- cations with the understanding that the Contract will' not be awarded until an understanding has been reached concerning assessments against the adjoining property. All voted in favor.' 4 0(.r-103 Council Minutes April 19, 1983 BLACKHAWK ROAD EASEMENTS City Public Works Director Colbert explained to the Council the problems that are being encountered with the acousition of necessary easements for the, improvement of Blackhawk Road between I-35E and Diffley Road. He noted that the grade of proposed Blackhawk Road will affect the driveways and lots of several single family residential property owners and that in light of the amount of the assessments being proposed to be levied against several of the properties, he expects that it will be necessay to pommenpe condemnation of the acquisition of the necessary right-of-way. Councilmembers recommended that the staff and Public Works Committee members Wachter and Thomas meet with property owners on Blackhawk Road on Tuesday, April 26, 1983 at 6:30 p.m. at the police building to discuss various alternatives for the alignment of Blackhawk Road. Upon motion by Egan, seconded Smith, it was resolved that the City Council be on record recommending further negotiations with the property owners for the acquisition of the right-of-way and in the event that it becomes necessary to do so, that the staff be directed and authorized to commence necessary condemnation for the acquisition of the right-of-way for Blackhawk Road and further, that. the staff be authorized to acquire an appraiser for the road right-of-way acquisition. Smith moved, Wachter seconded the motion to approve the plaris*and specifications for Contract #83-6 to authorize advertisement of bids, to be opened at 10:30 a.m. on Thursday, June 16, 1983 at the City Hall; further, to authorize the city attorney's office to commence condemnation action to acquire the necessary right-of-way if negotiations for the acquisition of the easement are not successful. CONTRACT #83-8 - BLACKHAWK ROAD - STREETS & UTILITIES The plans and specifications for Blackhawk Road streets and utilities for Contract #83-8 consisting of Project #317, and trunk storm sewer for I-35E as it crosses Blackhawk Road under Project #354, together with street surfacing of Blackhawk Road, under Project #355 were submitted. There was discussion concerning the acquisition of easements and it was noted by Paul Hauge, that of seven easements to be acquired for the road right-of-way, three have now been acquired and four are still being negotiated. However, the quick-take condemnation proceedings have been commenced. Smith moved, Thomas seconded the motion to approve the detailed plans and specifications for Contract #83-8 and authorize the Clerk to advertise for bids to be opened at the City Hall on Friday, June 17, 1983 at 10:30 a.m. All voted yes. CONTRACTOR LICENSING ORDINANCE AMENDMENT The Council discussed the proposed amendments to Section 6.42 concerning contractor licensing regarding performance bond and insurance for homeowners who are constructing their own improvements. DREXEL HEIGHTS ADDITION - ASSESSNOTS Paul Hauge reported that a Summoris and Complaint has now been served on the City by the developers of Drexel Heights Addition requesting certain relief regarding assessments for street improvements in Drexel Heights Addi- tion. It was noted that-the City has not negotiated a settlement concerning assessments and there was discussion concerning the need to proceed with such a settlement. BLACKHARK ROAD - EASEMENTS Tom Colbert and Paul Hauge reviewed with the Council the progress to date concerning approximately 10 easements in the process of acquisition on Black- hawk Road, between Cliff Road and County Road #30. It was noted that'4 of the easements have been acquired and negotiations are being continued on the remaining parcels. Condemnation has been commenced and the staff was re- quested to continue negotiations, noting the circumstances involving the possible effect on the adjoining. parcel of property, including the potential for installing retaining walls, some blacktop driveways, etc. PARK LAND - OUTLOT B - PILOT KNOB HEIGHTS 4TH ADDITION A letter from the City Attorney dated June 6, 1983 was reviewed con- cerning a meeting held with the proposed developer of Outlot B, Pilot Knob Heights 4th Addition,- concerning the settlement of the property acquisition by the City for park purposes. A demand has been made by the property owner and appraisals have been acquired both by the City and the property owner. Be- cause of the big disparity in the appraisals, the Council determined that futher consideration will be given to the acquisition of-the property, noting that the Council has taken the position that the property is owned by the City. No specific action was taken and negotiations will continue. UNITOG RENTAL SERVICE - I.R. FINANCING An application has been submitted by Unitog Company, a business clothing manufacturer from Kansas City, Missouri, requesting financing for purposes of building a new facility in Eagandale Center Industrial Park. The project will consist of a 27,000 square foot one-story building and a request had been made for a hearing for industrial revenue financing in the sum of $1,815.000.00. Smith moved, Egan seconded the motion to receive the application and set a public hearing on the application for July 5, 1983 at 7:00 p.m. at the City Hall. All voted yes. All voted yes. PROJECT #317 - CONTINUED FINAL ASSESSMENT HEARINGS Mayor Blomquist convened the continued final assessment hearings relating to Blackhawk Road and Project #317. It was noted by Thomas Colbert that at the original assessment hearing on September 18, 1984, four property owners had submitted written objections, and that the Council had continued consideration of the assessments relating to the those properties until a later date. He stated that the City has had appraisals done relating to all four properties by appraiser, Daniel Dwyer, that the proposed assessments are for assessment at current City rates, subject to a maximum based upon the appraised benefit to the property resulting from the improvements. With regard to the James and Carol Ashworth property, Mr. Colbert stated that the amount of the original assessment proposed on September 18 was $18,848.62 and that Daniel Dwyer had determined the benefit to be $11,000.00. James D. Ashworth appeared and stated that the assessments would be a severe 6 Council Minutes February 5, 1985 hardship upon him to pay each month and that as to the remaining matters in issue, he would rely on the objection previously filed with the City. Member Egan asked Daniel Dwyer a number of questions concerning his method of appraisal. Mr. Dwyer indicated that he assumed that the highest and best use for the Ashworth property was its present use with a single family dwelling, and that while he attributes to the benefits of the improvements to the land only, that he did look at the building on the property and determined that there was no benefit to the building. Councilman Smith stated that $11,000.00 for all assessments was not out of line with the size of the lot and the improvements made and Councilman Wachter mentioned that his assessments were $13,000.00. Mr. Dwyer stated that assessments for these types of improvements run in the $10,000.00 to $15,000.00 range in other communities in the area. Councilman Egan stated that the Special Assessment Committee didn't recommend a specific assessment, but did recommend that it be set by the City Council according to the amount of benefit determined by the City's appraiser, or the property owner's appraiser, whichever the Council determined to be better. Egan moved, Wachter seconded the motion to approve the proposed assessment of $11,000.00 based upon the proposed findings prepared by City staff with the findings to state also that the assessments will be certified and spread over 15 years at 10 1/2$ interest. All members voted yes. Hobert D. Kruger appeared and stated that he had previously submitted a letter to the City with regard to his assessments and also mentioned that he feels he has a claim against the City for damages relating to changes to his driveway resulting from the improvements. He stated that he could believe the value of his property has gone up even $22,000.00 as the City's appraiser had stated. He stated that he has a well and septic systems on both halves of his property. Councilman Wachter stated that there is a problem with the driveway, which is now much steeper, but that this is a separate issue from the assessments. Councilman Egan stated that the Assessment Committee had recommended to the City Council that it look at any appraisals presented to it and determine the assessment on that basis. Daniel Dwyer stated that the property would be worth much more than he determined if it were to tie in with other property, but he assumed that its highest and best use was to have two single family dwellings on it, one on the north half and one on the south half. Smith moved, Egan seconded the motion to approve the proposed assessment in the amount of $22,000.00 in accordance with the proposed Findings prepared by City staff,* with assessments to be certified and spread over 15 years at 10 1/2% interest. All members voted in favor. Thomas Colbert reviewed the proposed assessments for the Tscherne property, and stated that the original proposed assessment was $27,124.08, and that pursuant to the appraisal of Daniel Dwyer, the assessment would be $17,500.00 Leslie Tscherne appeared and reviewed a letter to the City by the Tscherne's attorney, Daniel Beeson, which stated that the Tscherne property is unique in that it is-long and narrow, has a swamp, would be very difficult to develop, and has a home in the middle of it, that the City's appraiser, Daniel Dwyer, has admitted that the highest and best use is for single family dwelling, that Mr. Dwyer's appraisal lacked comparable sales to substantiate it, that the comparables all dealt with raw land for development, that there were no before and after values on any of the comparable lots, that a State Supreme Court case had stated that Mr. Dwyer's appraisal technique was not acceptable. Mrs. Tscherne also stated that they had hired an appraiser who stated that the benefit to the property was $3,000.00.to $8,000,00, and that. any appraisal must include the land and buildings. Jay Tscherne stated that 7 Council Minutes February 5, 1985 the City obtained an easement from the Tschernes based upon land values of $20,000.00 per acre and that the assessments would require them to pay $300.09 per month for 15 years. Assistant City Attorney Smith indicated that Mr. Beeson's interpretation of the Minnesota Supreme Court case was subject to disagreement, and that it did not necessarily apply to this situation or Mr. Dwyer's appraisal. Mr. Dwyer stated that he did look at the building in making his appraisal, and that standard appraisal techniques were used. Smith moved, Thomas seconded the motion to approve the assessment in the amount of $17,500.00 to be spread over 15 years at 10 1/2% interest with the understanding that if the owners and the City enter into an agreement within 30 days of February 5, 1985 providing for: 1. The assessment of $11,090.00 now. 2. The assessment of the remainder to be postponed until the earliest of the following: a. Development of the property. b. Rezoning of the property. c. Sale of the property. d. Change of use of the property from the current use with one single famiy residentc to any other use. e. Or, platting of the property or splitting of the lot, except that if the lot is sold to a party who does not change the use from the current use with one single family residence, upon review and determination by the City Council to that effect, the assessment shall continue to be postponed until one of the above conditions is met, then the assessments shall be approved according to such agreement with the agreement to run with the land. All members voted in favor. Thomas Colbert described the assessments with regard to the Darold and Mavis Holden property and stated that the City's appraiser, Daniel Dwyer had appraised the benefit as a result of the improvements to be above the initial proposed assessments of $27,043.37. Darold Holden appeared and stated that the State of Minnesota had paid him $20,000.00 per acre for his property in condemnation proceedings with sewer and water in the area, and that his pole barn on the north portion of his property would have to be removed for the property to develop as R--3, as it appears in the Comprehensive Guide Plan. He stated that he accepted less than what the.property was worth, and that there is no benefit from the sewer and water through much of his property. Councilmember Egan asked about possible ponding credit and Tom Colbert stated that this would be allowed only if the pond on the back of the Holden property is necessary for the City's storm sewer system, and if an easement is granted for ponding purposes. Mayor Blomquist moved, Egan seconded the motion to levy the full proposed assessments on the two back lots, Parcel 60-05 and 70-05, in the amount of $711.15 and $1,012.85, and to levy the full amount of the proposed assessments of $25,319.37 against the remaining Parcel 30-03, all to be spread over 15 years at 10 1/2$ percent interest, on the condition that if the City and Mr. Hoiden enter into an agreement within 30 days of February 5, 8 Council Minutes February 5, 1985 1985, $11,000.80 only will be levied on Parcel 30-03 at this time, and the remainder will be levied only upon the sale or development of the property, rezoning, lot split, platting, or the issuance of a building permit for a residence on that property, or if there is a change in the existing use of that property, except that if the lot is sold to a party who does not change the use from the current use, upon review and determination by the City Council to that effect, the assessment shall continue to be postponed until one of the above conditions is met, then the assessments shall be approved according to such agreement with the agreement to run with the land. MULTI-FAMILY HOUSING REVENUE BONDS ROYAL OAKS CIRCLE APARTMENT PROJECT Mayor Blomquist convened the public hearing relating to the application for multi-family housing revenue bonds in the amount of $13,365,000.00 for the Royal Oaks Circle Apartment project, Thomas Hedges reviewed the proposal in detail and there was considerable discussion concerning the number of remaining units that the City can allocate to low-income housing for the rest of the decade under its goals. It was noted that the City's goal is not binding and that many of the units approved-for low-income housing will probably not be built. Mayor Blomquist stated her concern that the City should not let the market dictate to the City Council the number of low-income units which are approved by the City and that a balance of property uses is necessary. She stated her preference that the City stay within its plan and not simply approve.multi-family housing revenue bonds on a first-come first- served basis. Councilman Egan stated that while balance is important, the City cannot dictate balance but only give an opportunity for balance and that if the property has the prop_er zoning, the City shouldn't discourage development by denying such revenue bonds proposals. An Eagan resident near the proposed apartments stated his desire to see the area stay. single family and also stated that the proposed apartments were not aesthetically pleasing. Smith moved, Thomas seconded the motion to close the public hearing and approve the multi-family housing revenue.bonds in.the amount of $13,365,000.00 for the Royal Oaks Circle Apartment project as presented by City staff. All members voted in favor except Wachter who voted in opposition to the motion. The Mayor stated that she voted in favor of the bonds because while she believes that it'is important to stay within the City's goal of low income units that this project is still in keeping with the goal.
