Box 21199 Eagan, Minnesota 55121 Dear Mr. Colbert: ' SUBJECT: PROJECT 317, CLAIM FOR DAMAGES - DRIVEWAY SLOPES I feel the Public Works Committee was very unfair to have met and not allowed me an opportunity to respond in person to Mr. Rosene's statements. I received your letter the evening of March 13th and you requested my comments returned to you by March 13. As time is very short, I will submit the thoughts I have. I feel if I could have sat down with the committee and Mr. Rosene, I could have explained my side of the various issues. I believe this would have lead to a more reasonable offer of settlement. I expected the City to make an offer of settlement somewhat less than I asked for but the $3,000 is almost an insult. I don't understand where Mr. Rosene gets some of his figures. He refers to the existing grade of 13.5/0. 1 have profiled it two times, once before the blacktop and again after. I find a 50' portion that begins about ten feet behind the curb to have a grade from 14.2% to 18.6%. Mr. Rosene says the grade was raised five feet from the preliminary plans and the alignment was shifted ten feet. This may well be true but it is still much steeper than my original. He mentions the wide boulevard he left me when in fact it is so steep my riding mower won't work on it and I burned the engine out of my four-cycle walking mower because the slant was too great for the engine to oil properly. He says the original design proposed a service road and retaining wall which we and the Flogsteads requested be deleted. First of all, we did not objerct to the retaining wall, only the service road and that for several good reasons. 1. At that time we had not been told the road would shift to the west and the service road would have been very close to our house, in fact so close I believe we would have lost two large spruce trees. Mr. Thomas A. Colbert Page two March 15, 1985 2. It would have terminated at the north end of my property making it very long and a real snowplowing problem. 3. It would have been very steep also. So instead of having a short straight steep driveway I would have a long steep driveway with two corners. 4. As I understood it then, the service road would have been on private property and our responsibility to plow the snow. The Owner agrees for himself, his heirs, executors, administrators, successors, and assigns, that if the actual use of said property is changed in the future to a use or zoning category which is assessable at a higher rate than the rate for the present use, the City may reassess or levy a supplemental assessment at such time equal to the difference between the I assessment for the new land use and the assessment for the present land use at the assessment rates, according to City policy, in effect at such future time. i 6. Therefore, it would be beneficial to discuss all four property owners' situations collectively to avoid any repetition. Project 317 provided for the installation of sanitary sewer, water, storm sewer and street improvements on Blackhawk Road from Diffley Road to the northside of I-35E/Blackhawk Road overpass. In order for the State to construct the 48-foot-wide bridge over I-35E, the City had to commit to a concurrent construction of Blackhawk Road from I-35E to Cliff Road and also to Diffley Road. Due to the fact that Blackhawk Road is classified as a municipal State-aid street, certain design standards had to be complied with. Prior to permanently improving a street to its ultimate design section, all underground utilities have to be installed. Subsequently, Project 317 was initiated and constructed during 1983. These four property owners along Blackhawk Road are existing residents who did not petition for improvements and expressed their objections at the time of the public hearing and have followed through with written objections at the final assessment hearing ll which was held on September 18, 1984. Enclosed on pages L_through _ are copies of the written objections submitted" by these four property owners. Enclosed on pageis a topographic map referencing these four property owners and the parcels under their ownership. Enclosed on page is a breakdown of the assessments associated with each property showing the frontage and areas used to determine the final assessments based on the individual rates. The City Attorney and Public Works Director have had several meetings with these property owners from the inception of the project at the original public hearing to most recently on September 24 to review the concerns with the property owners listed as follows: 1. The project was not at the request of the property owners but rather initiated by the City over their objections. 2. The amount of the assessment exceeds the benefit to each of the parcels affected. 3. The amount of the assessments is excessive as to what each property owner can afford on a monthly/yearly basis. During the meetings with property owners, the staff has reviewed how the costs of the assessments were determined, the method used to calculate the f e F. The property owners are requesting further review by the Special Assessment Committee to see if any special consideration to their unique situation through the deferment, postponement or reduction of the assessments relating to this improvement. The staff has hired Mr. Dan Dwyer as an appraiser to evaluate the increase in valuation to the property as a result of this project in relationship to the amount of the assesments. At the time of this packet preparation, this appraisal report has not been completed. Therefore, it is anticipated that this information will be made available to the Special Assessment Committee at their meeting on October'9, 1984. STAFF RECOMMENDATION While the staff understands the situation and the concerns of the adjacent property owners pertaining to the assessments resulting from this project, the assessment revenue generated from this project had to be guaranteed against the sale of the bonds used to finance the construction of this project. If the appraisal report substantiates an increase in value to the property equal to or greater than the amount of the assessments, it is staff's recommenda- tion that the assessments be reaffirmed, adopted and certified to the County as presented at the final assessment hearing on September 18, 1984. TRAIL ON BLACKHAWK ROAD (DIFFLEY ROAD TO HIGHLINE TRAIL) DIRECTION TO BE CONSIDERED: Provide a recommendation to the City Council for the bid award for Contract 14-13 regarding the Blackhawk Road trail segment in response to the concerns expressed by the resident at 4300 Blackhawk Road. BACKGROUND: • On May 20, 2014, the City Council considered the plans and specifications for Contract 14- 13 (2014 Trail & Parking Lot Improvements) for the purpose of advertising for a bid opening to be held on Thursday, June 26, 2014 (the bid date has since been postponed to July 10). Contract 14-13 provides for the construction and maintenance overlay of bituminous trails and parking lots in a number of locations. • The construction of a new bituminous trail on the east side of Blackhawk Road, south of Diffley Road from Eagan Pointe Senior Living (currently under construction) to the Highline Trail, was included as part of the contract. • At the May 20 Council meeting, a concern about the construction of the trail segment was expressed by the resident at 4300 Blackhawk Road. The concern stated was regarding the impact of a trail on the slopes of the existing residential driveways. The resident stated the grading required for a new trail would make the driveways steeper than desired. • In response to the resident's concern, the Council authorized the advertising of the contract for bids with the Blackhawk Road trail segment separated as an alternate bid and directed staff to schedule a discussion of the Blackhawk Road trail for a future Public Works Committee meeting. • As a follow up to the Council direction, a staff review of all of the driveways along the proposed trail segment was performed. The review indicated that revisions to the slope of the driveway at 4300 Blackhawk Road would be only slight, well within an acceptable range, and limited to within the public right-of-way. However, two other residential driveways, which are already steeper than desirable, would become slightly more steep or require the acquisition of significant temporary construction easements to maintain the current grades. • The single family residential properties adjacent to the proposed trail are guided for high- density residential in the City's Comprehensive Guide Plan. • The proposed design of the trail does not provide widths for a standard boulevard due to the topography. As proposed, snow removal and storage could be challenging and may conflict with winter street maintenance efforts. • The Eagan Pointe Senior Living development includes the construction of a new trail with standard boulevard widths along its frontage with Blackhawk Road. Similar trail construction could be included with future redevelopment of the current single family residential properties as high-density residential. OPTIONS: • Include the Alternate Bid for the Blackhawk Road trail segment as part of the Contract 14- 13 bid award consideration on July 15, 2014.
