SIIBJECT: TWIN CITIES TREE TRIIST BIIILDING PERMIT
Twin Cities Tree Trust has submitted plans to the City requesting
a building permit for a pole barn structure on Metropolitan Waste
Control land west of Highway 3. Specifically, the parcel is
Property ID #10-90040-014-00, Tract E, Lot 014, Block 00,
Registered Land Survey #4.
T'win Cities Tree Trust is a private, nonprofit organization that
has had youth crews working in Eagan since 1984, landscaping parks
and the Municipal Center. The City always provided the materials
but the labor was at no expense to the City. The pole barn
requested will allow on-site equipment and tool storage, making
their operation more efficient as well as providing greater
security. Tree Trust is asking the City to waive the park
dedication and road unit fee. Both Gene VanOverbeke and Ken Vraa
have reviewed this request and support it, noting that the use is
temporary in nature. MWCC has the ability to remove Tree Trust
from the property without cause 180 days after notice is given,
should they desire.
I have requested that the inspections department hold the building
permit until this issue can be addressed. Given the approval of
Gene and Ken, I will release the hold on Friday, September 1,
unless I hear from you otherwise. Let me know if additional
information is desired.

Please place Tree Trust's request for deferr<i1 of the park dedication
fee and the road unit fee for Property ID. # 10-90040-014-00,
Tract E, Lot 014, Block 00, Registered Land 5urvey #4 on the next
City Council's meeting agenda.
The Twin Cities Tree Trust is a nationally recognized, private
non-profit corporation that directs public service employment and
training programs. Since 1976, it has provided employment and
training for over 15,000 economically disadvantaged and
handicapped youth and 3,000 economically disadvantaged adults.
Over 900 youth and 1,000 adults are employed annually.
Tree Trust has three goals in directing these programs. The
first is to provide basic job skills training for the employees.
The second is to provide the employees with challenging work that
has obvious value and results in a product they can be proud of
when completed. The final goal is to provide quality products
for the communities we serve.
Tree Trust has been directing youth crews in Eagan since 1984,
and the entire Dakota County Summer Youth Employment and Training
Program since 1988. Hundreds of Dakota County youth have been
employed in this program. They have completed numerous park
construction and landscape projects including the landscaping and
timber work at Eagan City Hall; and timber wall at Cedar Pond
Park. In these and other Tree Trust projects, the City either
provided the materials or was charged for the materials used.
There were no other costs to the City.
Tree Trust needs a equipment and tool storage faci1ity to improve
its on site nursery operation, increase security, and to allow it
to more efficiently serve the Dakota County Summer Youth Employment
and Training Program.

Tree Trust has permission from the Metropolitan Waste Control
Commission to use the afore mentioned property to grow trees for
public and low income plantings and to construc:t a 40'X 64'
storage building on the property.
Under the Waste Control's license, Tree Trtast r,an be removed from
the property without cause 180 days after notir.e is given. The
license also stipulates that upon termination, Tree Trust must
remove, at its own cost all facilities, c:onstrurted on the property.
Tree 7rust is in need of a equipment and storaye facility on the
property; but as a private non-profit; aiithout title to the
property; and being required to remove t:he facility upon
termination of the license; the park antl ruad fees would make the
storage facility prohibitively expensive.

Request to•Expand Facilities
Dear Mr. Brown:
This is in response to your letter of April 12, 1988 requesting
permission to expand your facilities operated pursuant to the
above-referenced license and located adjacent to the Commission's
Seneca Wastewater Treatment Plant. A copy of your letter is attached
hereto for reference.
Our Facilities Operations Department has reviewed your preliminary
sketch for fencing additional nursery acreaqe and constructing a pole
building on the site. Based on that review, the Commission has no
objeetion to Twin Cities Tree Trust ("TCTT") proceeding as proposed in
your letter and authorizes the same subject to the following express
conditions:
1. Additional facilities to be constructed shall be explicitly ,
subject to all the terms and conditions of License Agreement No. ?
2282 including, but not limited to, term, indemnification,
insurance, and termination. .
2. At the expiration of the license, or any renewal thereof, or upon
earlier termination thereof, TCTT shall at its own cost remove all
facilities constructed on the Commission's property upon request
of the Commission.
3. TCTT shall be responsible for obtaining any and all state or local
permits or licenses needed in orc]er to carry out the proposed
construction and shall be responsible for all construction costs
including permit or other fees.
4. TCTT shall be responsible for payment of all utility costs
incurred for its faciZities and any taxes or other costs imposed
on the Commission or its property as a result of the facilities to
be constructed.

5. TCTT shall, not less than 24 hours before commencement, notify
the Commission of the time construction of the proposed facilities
is to commence.
If this arrangement is satisfactory to you, please have the original
of this letter signed by an officer or officers of TCTT with authority
to bind the organization to its terms and return it to me. This
authorization is not effective until we receive a signed original of
this letter.

Cities Tree Trust is a nationally recognized, private
non-profit corporation that directs public service employment and
traininp programs. Since 1976, it has provided employment and
traininq for over 15,000 economically disadvantaged and
handicapped youth and 3,000 economically disadvantaqed adults.
Over 900 youth and 1,000 adults are employed annually.
Tree Trust has been directinp youth crews in Eagan since 1984,
and the entire Dakota County Summer Youth Employment and Traininq
Propram since 1988. Hundreds of Dakota County youth have been
employed in this program. They have completed numerous park
construction and landscape projects includinp the landscapinq and
timber work at Eaqan City Hall and timber wall at Cedar Pond
Park. With all Tree Trust projects, the City either provided the
materials or was charqed for the materials used. There were no
additional costs to the City.
Tree Trust has permission from the Metropolitan Waste Control
Commission to use the afore mentioned property to grow trees for
public and low income plantinqs. Tree Trust has just recently
completed construction of a 40'X 64' storage building on the
property.
Under the Waste Control's license, Tree Trust can be removed from
the property without cause 180 days after notice is given. The
license also stipulates that upon termination, Tree Trust must
remove, at its own cost all facilities constructed on the property.

To fully utilize the building, we require electric power.
We are planninp to install single phase 120/240 volt, 100
ampere service. The power will be usetl for lights, blower motor
for heater, and light shop equipment.
Mr. Dan Schultz, Customer Service Representative with NSP, has
stated under present quidelines, we are required to have
underground service. Ne has piven us three estimates for
service, overhead (frost/no frost) $396, underground (frost)
$3694+, underground (no frost) $2001+. As a non-profit, the
installation of underground lines with frost is prohibitively
expensive and would delay electrical service until sprinq.
In addition to the tremendous cost savinqs of overhead lines, we
feel that underaround lines are not safe/appropriate for the
site. The Metropolitan Waste Control Commission purchased the
land to screen the Seneca Treatment Plant and Maintenance
facility. MWCC has no plans to sell or develop the site. The
building and facilities are "temporary " and must be removed by
the Tree Trust if notice is aiven. The area is agricultural,
devoted to training unskilled labor and production of nursery
stock. It is subject to cultivation and digginp. It also has
existing over head lines.

Twin Cities Tree Trust has submitted plans to the City requesting
a building permit for a pole barn structure on Metropolitan Waste
Control land west of Highway 3. Specifically, the parcel is
Property ID #10-90040-014-00, Tract E, Lot 014, Block 00,
Registered Land Survey #4.
Twin Cities Tree Trust is a private, nonprofit organization that
has had youth crews working in Eagan since 1984, landscaping parks
and the Municipal Center. The City always provided the materials
but the labor was at no expense to the City. The pole barn
requested will allow on-site equipment and tool storage, making
their operation more efficient as well as providing greater
security. Tree Trust is asking the City to waive the park
dedication and road unit fee. Both Gene VanOverbeke and Ken Vraa
have reviewed this request and support it, noting that the use is
temporary in nature. MWCC has the ability to remove Tree Trust
from the property without cause 180 days after notice is given,
should they desire.
I have requested that the inspections department hold the building
permit until this issue can be addressed. Given the approval of
Gene and Ken, I will release the hold on Friday, September 1,
unless I hear from you otherwise. Let me know if additional
information is desired.

Request to•Expand Facilities
Dear Mr. Brown:
This is in response to your letter of April 12, 1988 requesting
permission to expand your facilities operated pursuant to the
above-referenced license and located adjacent to the Commission's
Seneca Wastewater Treatment Plant. A copy of your letter is attached
hereto for reference.
Our Facilities Operations Department has reviewed your preliminary
sketch for fencing additional nursery acreage and constructing a pole
building on the site. Based on that review, the Commission has no
objeetion to Twin Cities Tree Trust ("TCTT") proceeding as proposed in
your letter and authorizes the same subject to the following express
conditions:
1. Additional facilities to be constructed shall be explicitly
subject to all the terms and conditions of License Agreement No. ?2282 including, but not limited to, term, indemnification,
insurance, and termination.
2. At the expiration of the license, or any renewal thereof, or upon
earlier termination thereof, TCTT shall at its own cost r`emove all
facilities constructed on the Commission's property upon request
of the Commissian.
3. TCTT shall be responsible for obtaining any and all state or local
permits or licenses needed in order to carry out the proposed
construction and shall be responsible fo.r all construction costs
including permit or other fees.
4. TCTT shall be responsible for payrnent of all utility costs
incurred for its facilities and any t.axes or other costs imposed
on the Commission or its property as a result of the facilities to
be constructed.

5. TCTT shall, not less than 24 hours before commencement, notify
the Commission of the time construction of the proposed facilities

APPLICATION SIIMMARY: The applicant is President of Twin Cities
Tree Trust, a private non-profit corporation that directs public

applicant is seeking a Variance from the City Code requirement of

COMMENTS: The applicant states the use and building are temporary

There is overhead power existing approximately 550' from the Tree
Trust building. The applicant wishes to tie into this pole and run
the line to the building via three new poles. This is an older
portion of the City that had electric service provided long before
the current regulation pertaining to underground service went into
effect.
If approved, this Variance shall be subject to the following:
1. Overhead power lines shall be allowed for only the period of
time Twin City Tree Trust is a tenant in said structure.
