The resident was told their property was curretly zoned R-3 (townhouse), although a single-family home now exists. Any expansion to the existing home would not be allowed due to the ordinance pertaining to non-conforming structures. The resident was very concerned because the home was on the market for sale and he claimed the zoning would effect the re-sale value of his home. The resident was told Staff would reseach the zoning history of this property for any possible errors. In 1971, the area to the south and west of Blackhawk Acres was rezoned from R-1 to R-4 (townhouse, now R-3 by current definition), however, the area of single family homes along the West side of Blackhawk Road was not included in this rezoning. It appears that a line error in the subsequent zoning map update caused this area of single-family homes to be rezoned R-4 (townhouse, now R-3 by current definition). The City desires to call to your attention the existence of a transaction that has a financial impact upon the owner of the property. Kenneth Hassler, now deceased, petitioned for and was granted a senior citizen deferral of the payment of special assessments on his property at 3745 Blackhawk Road. The re- sults of this laboratory analysis indicates that the only excessive contaminant in this water is the high level of iron which, accord- ing to their report, is more than sufficient to cause taste, color and odor problems. In the order of your response the issues are: 1. Malfunction of a 20 year old well and pump. The well was finished in rock so there is no screen. A new Fairbanks Morse submersible pump was installed in 1975. At that time I spoke to R. Rosene about the availability of city water on Robin Lane. It was not a problem of water availability or quality at that time - it was a mechanical problem and deciding the economics of pump replacement vs. perpetual sewer and water charges. Some four years ago the water was tested by the State because of a hepatitis scare in this area. The general purety and quality of the water was excellent with minimum traces of nitrates. The P/M bacterial count was safely low. 2. The elevations of the BLTS tunnel parallel to my property are separated by less than fifty feet. On a surface par- allel plane some eighty yards. Geologically it's appar- ent that they are in a common aquifer - if not my well is being supported by the same springs and ground water penetrated by the tunnel. At least that is the opinion of the Minnesota State Department of Health (Water) Dep- artment. 3. Reimbursement for damages. As I have already demonstrated - I prefer a well. Since I have already incurred substan- tial expense and inconvenience we may as well consider another well with its facilities. From a local well dril- ler I've been told that the next lower sufficient aquifer III City of Eagan September 7, 1982 Page 2 is at from 235 to 280 feet. A new well with pump, pos- l sibly screen, underground discharge plumbing and elect- •rical, some $3,600. Installation and hook-up of city water would cost about $1Y-0-00. My personal expense since the well failure has been for purchasing bottled water, yard and garden neglect, well and electrical ser- vice calls and legal expense. 4. The existing well was drilled by G. Boudette, who is no longer in the State. When the replacement pump was in- stalled six years ago I neglected to have it plumbed. (I had no reason to.) From the best source of infor- mation it is 135 feet and has a four inch casing. It was drilled in 1958 and finished in rock. It has a one horsepower Fairbanks Morse submersible pump. Particulars Since the installation of Project #297 I observed and provided sec- urity for the contractors' machinery, equipment and supplies. The operation was performed some 80 Yards (across Robin Lane) from my home. I watched and notified them when their pumps failed. Ground water, springs and possibly some artesian aquifer constantly flooded the caisson at the junction to the leg running to the river. The caisson, as well as the earth moved cavity, bled a constant stream of water until it was plugged with Bentonite, of which abundant quantities were used. It is obvious even to the layman that when the aquifer is disturbed to that extent, along with the feeder springs, etc., that there has been a rearrangement of the water supply. Since I am the closest and only well in close proximity, it is logical that my water supply would be effected. My well began pumping air shortly after the caisson was sunk. Ser- vicemen drained and balanced the air/water ratios of the tank, took power readings on the pump and numerous other exercises. The conclusion alwas was insufficient water. In the twenty years since. we built this home we have never experienced water supply problems. It should also be noted that when your Eagan sewer flush crew vis- ited here this summer I asked them to remove the cover of the caisson to look into the tunnel and we discovered it contained free flowing water. The lake (Blackhawk) is laterally about 500 yards East. My property line is about 80 yards Northeast, but there was no water entering the tunnel inlet at the lake. My water has been tested subsequent to my water problem. It con- tains nitrates marginally safe, and other impurities indicative to dilution with swamp water. It also has petroleum traces and sul- fur odor. The petroleum traces are probably from the Williams Bros. u d City of Eagan September 7, 1982 Page 3 pipeline that was installed during the "Gold Rush" reign of Stalland and Kline. Leakage would follow the course of the pipe and seek the closest peneti~;~tion. My well functions at about 50% efficiency intermittently. My water is of poor quality and I attribute these problems to Project #297. I know of no other logical reason. It gives me a warm feeling to know that you are sympathetic to the expenditure of public funds and am gratified to know that there are no other wells nearby to be damaged. To minimize my legal expenses I have prepared this report per my attorney's suggestion. We have performed extensive research into this claim, and from information that Mr. Hassler has provided our consulting engineering firm, we have concluded that our construction activity has not disturbed the water table from which Mr. Hassler draws water for his private water supply. On the contrary, we tend to suspect that a 'privte water well in place for twenty-three years is possibly having other malfunctioning problems unre- lated to our construction activity. Our construction has not disturbed nor 'r affected the water table at the elevation being used by Mr. Hassler. With public water supply being readily available to Mr. Hassler's residence, we have strongly recommended in the past and will continue to do so in , the future that he connect to City water to insure an adequate and safe potable water supply for his residence. However, the financial responsi- bility associated with this connection must be that of the benefited property owner. If there is a specific financial claim being made, and if the City has been determined to be negligent and responsible for the costs incurred under said claim, the City is responsible for only reimbursement of the amount associated with that claim. It would then still be Mr. Hassler's responsi- bility to connect to the City's water supply if he so desired at that time. As we informed Mr. Hassler in the past, if a formal claim is to be submitted to the City for damages incurred, please indicate the dollar amount of those damages and specific detailed information that justifies your claim of City negligence associated with the construction of this project. In order for us to process this claim through the City's insurance company or onto the general contractor performing this work, it is necessary to review what speci- fic damages were incurred as verified by any and all individuals performing repair work in the process of incurring those damages. Mr. Hassler states he has lived in his home for about 23 years, and has had a well for his water needs all those years without any adequate supply problem. However, since the city in the spring and summer of 1981 developed the above referred to tun- nel, which ran within 50 yards of Mr. Hassler's property at the depth of approximately eighty feet; he has been experiencing inadequate supply of water ever since and attributes this to the projects disruption of the aquifer serving his well. He states that he has brought this problem to the attention and notice of Tom Colbert, City Engineer, on two occasions and a Mr. Bob Rosene also on two occasions, as the independent consulting civil engineer to the city. Mr. Hassler said he talked to Colbert vis-a-vis and Rosene by telephone. They are fully informed as to his complaint. They sent a representative out to interview Mr. Hassler in the fall of 1981 and no remedy of the situation was proposed by the city, or anyone acting in their behalf, after said inter- view. Mr. Hassler wants an amicable resolution of his water inadequacy because he feels the city is responsible for his current problem; he wants a solution and to be made whole. When this matter was first brought to our attention in the later part of July, 1981, our project inspector was informed of the situation and instructed to determine if any known conditions were encountered that could effect the well in question. Since groundwater was not encountered by the tunnel construction at the time. of first claim notice, it was not believed that any project activity could have effected this well. Since it appeared very unlikely that any City or contractor liability for this claim existed as a result of this project con- struction, no formal response was prepared concerning this issue. The claim however has been reiterated and it is therefore appropriate to document spe- cific details herein. Based upon the timing of this claim submittal it is likely that any well prob- lems are unrelated to the construction activities of this project. However, because the resident may have observed the contractor pumping rain water from the jacking pit adiacent to his property, this may have been construed by him to correlate with any well problems experienced at that time. The water pump- ing referred to was necessary only because heavy rains flooded the jacking pit. No groundwater prior to or immediately subsequent to this instance was encountered by the project work. An adverse groundwater condition was encountered on October 7 at approximate plan station 20+00 which resulted in the contractor's installation of a de- watering well to relieve goundwater flow in the immediate area to allow the Page 1. 7545a City of Eagan Eagan, Mn. 55122 December 3, 1981 Re: File No. 49175 tunnel construction to continue. --The well casing was set to approximate ele- vation 791.0. Pumping in this vicinity continued for five days at an estima- ted discharge rate of 4 to 8 gpm. We have been informed that Mr. Hassler's well is adjacent to the house and is approximately 150 feet deep. The house is approximately 400 feet from the dewatering site at an estimated ground lev- el elevation of 860.0. For comparison purposes the approximate surface eleva- tion of Blackhawk Lake is 791.0. This is the only incidence of groundwater encountered by this project work. It should be noted that the groundwater was encountered subsequent to receiving the initial claim notice. The volume of water withdrawn was small and believed to be a "perched" water table. Sur- rounding surface water elevations are approximately equal to the elevation pumped. We do not think that the discharge rate of the dewatering well at the relative ..distance and elevation from the house would have an effect upon the Hassler well. If it did, it should have been minor and groundwater recharge has prob- ably occurred since that time. If any further information or action concerning this matter is necessary, • please call us. Mr. Don Christenson appeared concerning the proposed street improve.-- `i ment assessments on Crestridge Lane on the North side of Fish Lake. i-ir. Christenson objected to the proposed assessment of his land abutting on the i' South side of Crestridge Lane consisting of about 360 feet plus an addition^1 60 feet for a proposed road. After considerable discussion, upon motion by Knight and seconded by Polzin, aye Klein, it was recommended that the Christenson assessment for Crestridge Lane be deferred until Mr. Christenson or his succes- sor develops any portion of his property with-the exception of the proposed Lot i 4 at the Southwest corner of the Christenson property. It is understood that development could consist of a building permit request, platting on the property 4 y or any other development on the land. In the event that the street assessment for Crestridge Lane is levied against the Christenson property in the future, she assessment will be based on the average per foot assessment levied at the time of the original assessment together with interest at eight per cent. I am requesting that my property, Lot 6 - Blackhawk Acres, be considered for a reduced (or-paid) assessment status in lieu of the aforementioned circumstances. (See attached drawing of subject lot) I purchased this lot from Mr. Stalland in 1957 under restricted covenents. One family dwellings, minimum 20M cost, no typo- graphical changes, etc.. A condition that he would install water, sewer and finish Robin Lane. Typical of a Stalland agree- ment, nothing was done except he secretly rezoned the property to multiple dwellings. He ran a bulldozer down the path that you now call Robin Lane. Mr. Kline must of had a child by that name at that time. The road has four inch trees growing in the right of way. It is not traversable by a conventional vehicle. (see photo) In 1971, sewer, water and a blacktop mat was laid down on Blackhawk road and a leg of sewer and water trunks were run down Robin Lane. Two service stubs were set in the segment going West and I guess others further down to service those lots when they are platted. When I received my assessment, I learned that I had been assessed for the total perimeter of my lot except the North leg. I was charged some $350.00 for two service stubs I don't need since when the village sent out a questionnaire asking where you prefer service to come into your house, I indicated my front of house off Blackhawk Road. Just last week, the people on the Ruger property tapped into one of those stubs despite the fact that Rugers were never assessed although they are on the South side of Robin Lane. Sometime in 1971, after some violent complaints to City Hall, Mr. Kline sent out two of his lieutenents to study the problem. They considered it resolved by permitting me to split off the back half of this property so I may sell the back lot. I am a retired Marine Officer on total disability for which I graciously receive a county tax consideration, but this does not include special assessments. HEDGES, CITY ADMINISTRATOR FROM: THOMAS A . COLBERT, DIRECTOR OF PUBLIC WORKS DATE: FEBRUARY 25, 1988 SUBJECT: LOT 6, BLACKHAWK ACRES (KEN HASSLER) PROJECT 368, ROBIN LANE STREET ASSESSMENTS Recently, you forwarded to my attention for review, research and comment a letter you received from Mr. Hassler on January 5th regarding concerns associated with the improvement of Robin Lane under the above referenced Project and the related special assessments of $4,008.74. At the time of the original public hearing (2-1-83), Mr. Hassler expressed objection to the Project and related assessments. Subsequently, the Council directed the Staff to negotiate with the Developer (Hillcrest Development, Inc.) to participate in financing a portion of the original proposed assessments against Mr. Hassler ($5,577.00). Based on successful negotiation with the Developer, Mr. Hassler's adjacent frontage of approximately 290' was reduced to 80.66 assessable feet at a reduced assessable rate of $30.49/ff as compared to $40.05/ff for all remaining frontage. With this reduction in assessable footage and assessment rate, Mr. Hassler's proposed assessment was reduced by $1,568.26. On October 16, 1984, the City Council formally adopted the revised reduced Final Assessment against Mr. Hassler taking into consideration his previously stated objections which most recently have been reiterated. Subsequent to the adoption of that Final Assessment, Mr. Hassler submitted, and was granted, a senior citizen deferment in accordance with City Ordinance. This deferment postpones any annual installment of the 10 year Special Assessment spread. Mr. Hassler is correct in that, at the 10.5% interest for the Special Assessment, the senior citizen deferment continues to accrue $420.84/year to the deferred original principle balance until such time as the assessment can be levied. All research indicates that Mr. Hassler's current objection is similar to his previous objections and that they were properly taken into consideration in both the reduction of the final assessment amount and deferment in accordance with his request. I do not know of any other considerations that are available to offer Mr. Hassler at the present time. Attached to this memo are copies of appropriate background minutes and correspondence pertaining to this issue. Please let me know if any additional information is necessary to clarify this issue for you. Respectfully submitted, Director of Public Works Attachments TAC/jf i Council Minutes 001G24 February 1, 1983 ROBIN LANE - PR ,JECT-4368 68 - STREET IMPROVEMENTS The next public hearing convened by Mayor Blomquist concerned the pro- posed street improvements under Project #368 consisting of Robin Colbert and Mr. Rosene explained the two alternate alignments project in detail. It was anticipated that llcosts would be assessed hand an estimated assessment roll had been prepared and was submitted to the Council and all persons interested. K=gJh Hassler was present and objected' -to-the assessments in that he stated he ii6-bene fit, e "there no further use intended to his lot from Robin Lane, noting that main his main access is to Blackhawk Road. John Uban and Vasco Bernardi of Metram Proper- ties were present and stated that they intend to buy land from Hilicrest Development Company to gain access to Robin Lane. Hillcrest Development and the Goodman family are the two other large property owners affected by the project. Access to Highway #13 from Robin Lane would necessarily be vacated for roadway purposes but retained for utility purposes. Mr. Uban stated that alternate No. 1 is preferred, but the property owners would not object to alternate No. 2 noting that access to Highway #13 would be extremely close from Blackhawk, if alternate No. 1 is implemented. Mr. Bergstrom and Mr. Pomeroy were not present nor represented. Smith moved, Wachter seconded the motion to close the hearing, to order in the project and to authorize the preparation of plans and specifications with the recommendations that Mr. Hasler request a deferment until his lot, Lot 6, Blackhawk Acres, is split or divided, and further recommended that the suggestion of Mr. Uban, that the other property owners help to defray the assessments on the Hassler property be implemented; further, that alternate No. 2 be utilized in the preparation of the plans. All voted in favor. IMPROVEMENT PROJECT #369 - SHEFFIELD ADDITION - STREETS & UTILITIES The next public hearing convened by Mayor Blomquist consisted of Project #369 concerning street and utility improvements to Sheffield Addition. There was no appearance on behalf of the developer, Gabbert Development Co. and no objections to the improvements. There were several property owners from Lakewood Hills Addition who were concerned about a boundary line dispute along the south line of Sheffield Addition. Egan moved, Thomas seconded the motion to close the hearing, to order in the project and to authorize preparation of the plans and specifications, noting the final plat had not been approved as yet. Since this project hasn't been completed yet, the final assessments associated with its improvement haven't been computed yet. Therefore, I am not able to tell you what the final assessment amount will be. However, it is my recollection that the City did in fact agree to negotiate with the developer, Hillcrest Development, Inc. to pick up a portion of your assessments. However, this was through a method by which you would be assessed. only what a normal residential equivalent for a comparable street would be and that any costs over and above this would be born by the developer, Hiilcrest Development Inc. In addition, you will be assessed only for the single lot where your homestead presently exists and that your "backyard area" would not receive any assessment liability. After reviewing this information with the developer, I feel confi- dent that we will be able to comply with the situation as we review- ed it with you during. the negotiations for the acquisition of the required easements. Well #7 - Project #412 - Pumping Facility. The feasibility report for Well #7 under Project #412 has now been completed and it was recommended the Council receive the report and authorize the preparation of detailed plans and specifications. 6. Clearview_ 3rd Addition - Final Plat. The application of Joe Peterson for final plat approval for Clearview 3rd Addition was submitted to the Council and the staff recommended that the application be approved and authorize the appropriate officers to sign the related documents. Wachter moved, Egan seconded the motion to approve the foregoing consent agenda items. All voted yes. RAHN ROAD - FINAL ASSESSMENT HEARING - PROJECT #367 Mayor Bea Blomquist convened the public hearing regarding the final assessments for Rahn Road sidewalk providing for installation of sidewalk along the west side of Rahn Road to Cliff Road and Rahn Park. Mr. Colbert explained the project and Charles Bartholdi of Federal Land Company appeared and submitted objections to the assessments. He stated that Federal Land Company is now under contract to purchase the Burow property and that Federal Land is simply reserving its rights and will investigate the assessments further with the City staff. Smith moved, Wachter seconded the motion to continue the hearing until the next regular meeting on September 18, 1984 at 7:00 p.m. All voted in favor. ROBIN LANE - PROJECT #368 - FINAL ASSESSMENT HEARING The Mayor next convened the final assessment hearing regarding streets and utility improvements under Project #368 for Robin Lane. Tom Colbert, the Public Works Director, reviewed the project with the Council including explaining the benefits that were derived by the adjoining property. Upon motion by Smith, seconded Thomas, it was resolved that the public hearing concerning 14 parcels relating to miscellaneous assessment projects be closed and final assessments be approved and authorized to be certified to the County Auditor according to the schedule attached to the Council packet. All members voted yes. Wachter then moved, Egan seconded the motion to continue the hearings as to the ten parcels according to the schedule attached to the Council packet from October 18, 1984 to January 8, 1985 at 7:00 p.m. at the City Municipal Center to consider the adoption of the assessments covering those parcels. All members voted yea. ROBIN LANE - STREETS - 2110J.ECT, #368 The Mayor then reconvened the public hearing concerning Project 4368 consisting of the final assessment roll for the Robin Lane Street Improvements. The hearing had been continued from -September 4, 1984. A revision to the final assessments for the project was submitted by the Special Assessment Clerk and recommended for approval by the Special Assessment Committee at its meeting on October 9, 1984, with a recommendation that the assessable footage of Lot 10, Blackhawk Acres, for Herbert Bergstrom, Jr., be reduced reflecting an overall increase of $0.56 per front foot for the balance of the project. There were. no further objections and upon motion by Wachter, seconded Smith, it was resolved that the assessment roll be approved and it be authorized to be submitted to the County Auditor for certification. All voted yes. SHORELAND ZONING ORDINANCE The staff recommended that the Council continue the consideration on the proposed Shoreland Zoning Ordinance until the October 30, 1984, meeting. MAGNUM TOTTING CONDITIONAL USE PERMIT The application of Magnum Towing and Kevin Mellon for conditional use permit for outside storage of vehicles in conjunction with a towing service at 3468 Dodd Road was next considered by the Council members. Dale Runkle reviewed the application and indicated that the Planning Commission recommended approval subject to conditions. Mr. Mellon was present and indicated that he will be towing for the City of Eagan and the Minnesota State Patrol and that he will be purchasing the Mendota Skelly Towing Service business and moving into the proposed location. He also indicated the cost of complying with the conditions imposed by the staff and Planning Commission were very high and indicated that further expansion is proposed in the future.
