The parcel has been zoned residential since back in the 60's. The townhome zoning shows up in 1971 prior to the construction of the townhomes to the south and it was guided D-III in 1974-75 when the City was incorporated and the first land use plan was created. Yes, they love the house, and said it may be the oldest house left in Eagan. But it has no basement, just a small cellar, and little storage space. They love the lot and the location too and want to stay ther e for some time to come so they want to fix it up and I'm telling them they can't. And not only can they not fix up their house, I'm telling them we expect their house to be moved out or demo'd and townhomes built in its place. On the other hand, they're not certain they'd want to pursue rezoning because they realize that when they sel I or for their estate, the multi-family zoning probably means a higher value. The Comp Plan is MD. The owners bought it in 1977 and they said it was Ag when they bought it and th ey don't recall it getting rezoned to R-3. 10/9/2008 Page 2 of 2 There is a s-f home on the property and they want to build and addition to the home, and I've told them they can't because it's a non-conforming use. I've also told them they cannot request a variance for the addition, as the ordinance doesn't allow variances for non-conforming uses. Their only option would be to request a rezoning and comp plan amendment that would make the s-f use conforming. If the rezoning didn't occur with the last comp plan when we had to make the land use and zoning consistent, then I'll have to do some more historical research. Thank you. The preliminary feasibility report prepared allocated two-lot equivalents to your property in the amount of $11,248. The Mot equivalents previously allocated to your property have been reduced to a single-lot equivalent. Also, further revisions to the estimated preliminary lot equivalent cost shows a reduction from $5,624/lot equivalent to $3,987/lot equivalent. JBDB will be performing the construction of the shell, mechanical rough ins, insulation, and drywall hanging. We will not be performing any of the landscaping or interior finishing. That is all being performed by the owner or others and is not part of our contract. It is up to the city to either issue one building permit for the entire job or if desired two separate permits one'being for us as the contractor and the other for those performing tasks after we as the builder leave the site. If one permit is issued JBDB responsibility will end as we leave the site and no responsibility shall fall on us as a builder as we have no control of what happens when the scope of our contract ends.
