Dear Charles and Judith McBrayer:
our offices represent Richard Land Associates which was the
develaper of the St. Francis Woad 6th Addition subdivision. As a
lot owner in that subdivision, you are probably aware of the
"street islands" located in the culdesacs on Blue Heron Court, Bald
Eagle Court and Falcon Way. These islands enhance the
attractiveness of your naighborhood arzd each lot owner benefits
from these landscaped areas directly and indirectly.
Although the landscaped street islands require very Iittle
maintenance, the City of Eagan has requz.red that a plan be
formulated to provide fior the maintenance of the landscaping in the
street islands on an ongoing basis and expects the lot owners in
the subdivision to join in and support this effort. To this end,
we have drafted a Declaration of Covenants for Maintenance and
Repair of Landscaping which has been siqned by Richard Land
Associates with respect to the eleven lots in the subdiuision which
Richard Laand continues to own. The Decl.aration alsa contemplates
additional owners in the subdivision joining a.n the covenants by
signing a separata Consent. A copy of both the Declaration of
Covenants by Richard Land and the Gansent to the Cvvenants for the
othar lot awners is enciosed for your review.
It is anticipated that the cost of maintaininq all three
street islands will not be more than $300.00 to $500.00 in total
annually fnr the next several years. This would result in a cost
to each lot owner of approxiznately $10.00 to $15.00 per year with
all lats participating. If areas are nat properly maintained, the
city does have the right ta remove landscaping in islands. By
becaming involved, other lot ownexs can assure themselves that the
isiands will contir?ue to be an amenity to their neighborhood and
nat become a detriment.
