Craig stated that engineering staff has had previous contact with the current property owners, Kevin and Rebecca Kulas The property was final platted in 1987 by Keith and Diane HFarstad. Shamrock Development purchased the undeveloped lot several ,years ago. A building permit for Last. 21, Block 2, was issued on May 5, 1993. The original overall grading plan: showed a retaining wall in the backyard; however, one was never constructed with the initial site grading. Currently, there is no retaining wall on the lot and from the appearances of the vegetation, it does not loQk like one has ever been constructed. i Craig advised that the letter of credit has been released and feels this grading issue is between Shamrock Development and the KulasI A retaining wall could be constructed or the hillside could be planted with a maintenance-free ground cover for slope stabilization.: - r I contacted Rick Packer of Shamrock Development to hear their side of the. story. As stated earlier, this was an assumption based on a cursory review of overall development grading sometime during the development process. i Big Permit Aval Process A surveyor's certificate is required to be submitted with the building permit application. This Certificate of Survey is reviewed by the Engineering Division of the Public Works Department primarily to review elevations of the proposed structure in relationship to its ability to be serviced with City utilities and to ensure adequate drainage fiom the structure without adversely impacting' other property. The Building Inspections Division of the Community Development Department also reviews the Certificate of Survey to ensure compliance with setback requirements and other related structural building codes. A review of the Certificate of Survey by the Engineering Division within two clays of building permit issuance is not unusual bawl on periodic differmg workloads between the two divisions. City Administrator TL.H f jeh r i 4 MEMO -city of eagan TO THOMAS L HEDGES, CITY ADMINISTRATOR FROM: THOMAS A COLBERT, DIRECTOR OF PUBLIC WORKS DATE: AUGUST 9, 1994 SUBJECT: KULAS RETAINING WALL Remy, you forwarded a memo to Community Development Director Reichert regarding a voice mail message from Councilmember Masin concerning the retaining wall issue for the Kulas property in the Burr Oak Hills 1st Addition. Due to Peggy's vacation schedule and my familiarity with the historical background of this development, I have offered to prepare this response. I will first specifically address the two questions contained in your memo and then provide some general background discussion. Did the retaining wall Issue occur after the developer's bankru tcv? The original developers of the Burr Oak Hills subdivision were Keith and Diane Harstead. The final plat for the 1 st Addition was approved and recorded at Dakota County on May 27, 1987. The developers filed for bankruptcy in February, 1990. The issue regarding the noncompliance of the retaining wall was brought to the City's attention approximately June of 1994. Were there restri ions placed on the two lots that are not built (Lots 18 & 19) that weld require retaining walls or some other proper erosion control? A memo has been placed in the parcel file for these two lots indicating the need to ensure that a detailed site grading plan is submitted with the building permit application to determine the extent of retaining walls and, if necessary, ensure that it has been designed and included as a part of the building permit issuance. Background ;Itpformstion The detailed grading, drainage and erosion control plan that was submitted with the final plat application for the Burr Oak Hills 1 st Addition was more than what is required by City Code. This grading plan showed building pads and final grades for the majority of the subdivision and referencing the installation of approximately 300' of retaining wall for Lots 18, 19, 20, and 21, Block 2 of Burr Oak Hills 1 st Addition. If the subdivision were to be I f s ,1 • graded according to the proposed grading plan, it would require the installation of this , retaining wall. However, the developer provided stabilized slopes of approximately 2:1 in lieu of the retaining wall which does meet the City's minimum erosion control and grading standards. Many times, developers will leave the installation of retaining walls to the builders and future homeowners' architectural discretion to incorporate It into their final building design. A revised grading plan to eliminate this retaining well and replace It with the stabilized 2:1 slopes that presently exist would be approved I submitted even to this day. Shamrock Development Corporation purchased all remaining undeveloped lots from the bank who obtained title as a part of the bankruptcy proceedings. They realized they purchased the lots "as ls" and then sold there to builders only. In a recent meeting with Jun Stanton of Shamrock Development, he Indicated that he sold these particular lots at a reduced price from comparable lots in the development due to the steep topography in the r+earyard area. When the particular lot for the Kulas property was sold to Chase Builders, it was sold was is". Subsequently, Chase Builders included a clause in the puree agreement with the Kulas' that the installation of any retaining walls, if necessary, would be the responsibility of the Kulas'. This was agreed to by the Kulas' when they purchased the lot. There presently is no financial security available for the development contract. Shamrock Development Corporation is merely a landholder who purchased these lots through the bankruptcy sale and should really not be considered a developer. It appears that Mr. Mrs. Kulas have reached an Impassee with Shamrock Development in their discussions. Mr. and Mrs. Kulas presently have an obligation to construct a retaining wail to properly stabilize, the embankment before it affects adjacent properties through erosion in addition to the Identifiable safety concerns. The construction of a walk-out on this lot further exacerbated the need for a retaining wall. In reviewing the site plan submitted with the building permit application, the land surveyor for the applicant did not properly reference the elevations either as they existed at that time or were proposed with the development grading plan. Based on the Information received, the staff processed and issued a building permit which did not show anything out of the ordinary. In hindsight, there may have been an opportunity for the City staff to be more aware of this Issue to possibly prevent the concerns presently being experienced by Mr. and Mrs. Kulas. However, with the limited staff resources and the volume of development, building permits and developers meeting varied levels of compliance at differing timeframes, this was a situation that staff was not " to prevent. However, we have put a special notation In the parcel file for the two remaining vacant W to ensure #0 #me issues are addressed as a part of the building permit issuance to avoid a similar reoccurrence in the future. In summary, it does not appear that the City has any liability or obligation to assist in providing a retaining wall for the Kulas property, especially in tight of their written agreement to do so as a part of their purchase of the lot. If the City Council should chooser to provide assistance, they should be very specific as to the reasons for providing any financial assistance to avoid establishing a precedence for many other lots in this community where the building of custom homes often times require the installation of substantial landscaping and retaining wall improvements. Please provide proof and documentation that the property was sold "as is". At no such time did Shamrock indicate to us, nor to our developer, that the property was sold "as is" in person nor is it stipulated in any docents or contracts. The City states that Shamrock Developments sold our lot at a reduced price from comparable leas in the development. Attached please find a lot price list dated April 1993 from Building Sites, Inc. showing that our lot was sold at $1,000 less than the lot across the street from us (Block 4, Lot 9). Understand that the lot across from us does not need a retaining wall, which is estimated to cost approximately $15,000. According to the City's earlier statement, a retaining wall is not required if it meets a 2:1 slope, and according to the City, our property met the 2:1 slope, therefore, we do not need to construct a retaining wall. This request by the City, , however, is a mute issue because according to the Grading, Drainage, and Erosional Control Plan, a retaining wall was suppose to have been installed prior to our purchase of the property. It is our understanding that prior to the City issuing a building permit, the City Inspector is required to visit the property and inspect it for constructability. At that time the City notes any restrictions or modifications for the permit, or denies the site for construction. According to Craig Knutson, the City reviewed the building permit site plan on May 7, 1993. Please provide documentation of this review and documentation on the approval of the building permit. Also please provide documentation and clarification as to why the building permit dated May 5, 1993, varies from the City review date of May 7, 1993. Based on the date, the City issued a building permit prior to the review of the plan. I also noticed that each adjoining lot to the nest Bind west had a. similar slope. A slope of this wagnitude, more than likely, will require stabilization by some type of mechanical means rather than a vegetative one. According to our files, the District reviewed a grading plan dated 2/3/88 when this site was planned to be developed. The grading plaA depicts a` retaining wall on the back side of lots 18, 19, 20 and 21, Block 2. It is apparent that an integral part of these lot configurations was the creation of terraces through the use of a retaining wall. As of the date of my inspection, this wall has not been installed. It is also apparent that any structures above or below the embankment are not secure from damage until the slope is stabilized. A retaining wall mould seem to be the best way to stabilize the slope on this site Possibly a series of three shorter walls rather than, one tall one to create a. series of steps or terraces would more esthetically pleasing. Does the City have development regulations/requirements for the Bur Oak Hills subdivision with current developers? Does the City; give up development rights as a result of bankruptcy? Shamrock Development Corporation was not the original developer of the property. It is the City's opinion that they purchased the lots in a buildable condition. The City never entered into any separate development agreement with Shamrock. To the extent that the developer had any obligation to the City, those obligations' would have been modified or released by the bankruptcy court. 6. Who has a retaining wall in Bur Oaks Hills 2nd Addition and was that a condition of development? The City would have no way of knowing who, or where, retaining walls are built in a development. A grading/erosion plan identifies existing and proposed finished elevations with preventative erosion control measures (i.e., silt fence, sedimentation basins, etc.) to contain and control erosion during the subdivision's mass development stage. It is not intended to imply the finished grading erosion control required of the individual lot development associated with building construction. 5. Does the City have development regulations/requirements for the Sur Oak Hills subdivision with current developers? Does the City give up development rights as a result of bankruptcy? Shamrock Development Corporation was not the original developer of the property. It is the City's opinion that they purchased the lots in a buildable condition. The City never entered into any separate development agreement with Shamrock. To the extent that the developer had any obligation to the City, those obligations would have been modified or released by the bankruptcy court. 6. _ Who has a retaining wall in Bur Oaks Hills 2nd Addition and was that a condition of development? The City would have no way of knowing who, or where, retaining walls are built in a development.
