The easement conveyed hereby is subject to the following conditions and restrictions which shall remain in full force and effect for the term of the easement: 1. The sign shall be. a monument sign for the City and shall not contain any advertising, other than the name of the City and its logo. 2. Attached you will find our revised documents (dated 2/28/03), and the plumbing (3/26/03) and HVAC (2/12/03) documents. We would like to respond to each item in your letter as follows: 1. We have removed the references to the UBC on sheet A102. 2. Please see the attached letter from Bruce Hasselquist, radiological physicist for Argosy University. His shielding calculations indicate that a single layer of 1/16" lead will provide sufficient shielding in the partitions surrounding the X-Ray areas. The standard concrete floor slabs in the building will provide sufficient shielding in the vertical direction. We are currently reviewing the alternatives of sheet lead vs. lead-lined gypsum board. After a decision is reached, we will revise the drawings to incorporate the required partition shielding around X-Ray 1068, Simulation 2049 and X-Ray 2050. 3. We have revised the drawings to indicate a one-hour enclosure for Closet 3046. 4. The revised drawings include casework details for the project. Reception counters for use by the public have a complying accessible surface. 5. We have revised the plans to indicate one hour rated partitions around the storage rooms larger than 100 s.f. 6. The Plumbing and HVAC systems are being done on a design/build basis. We have attached their plans here as noted above. 7. The MILT Room is the classroom for Medical Lab Technicians. Door 1039 has been removed from the plans. Argosy's intention is to provide an accessible sink in each classroom with the exception of Simulation 2049, X-Ray 2050, Positioning X-Ray 2054 and 2055. These classrooms are used to train X- Ray Technicians, who must lift patients on and off chairs as part of their duties. This task cannot be performed by the disabled, and thus accessible work surfaces are not appropriate for this classroom function. While the State Building Code sections you reference do require the accessible sinks, the building code does allow modifications to the code in situations where carrying out the letter of the code creates practical difficulties. Both UBC 104.2.7 and IBC 104.10 allow the Building Official to grant modifications for individual cases, provided the intent of the code is maintained. We request that accessible sinks should not be required in rooms 2049, 2050, 2054, and 2055 due to their inappropriateness for the instructional needs of the classrooms. 9. We have attached structural drawings for the canopy indicated in drawing 8/A403. 10. 1 have attached a copy of Argosy University's letter indicating that they will ensure that vehicles are not permitted to enter Trash / Storage Room 1045 under any circumstances. Based on our telephone conversation last month, it is my understanding that this guarantee is sufficient to avoid enclosing the room with 2 hour construction required for a parking garage. We also understand that if Argosy is found in violation of this agreement, your office will require pipe bollards cast into footings in the driveway to ensure that no vehicles are allowed to enter. The calculations arettraradiographic/ fluoroscopic therapy simulator room, a veterinary radiographic x-ray room, and a radiographic x-ray room with a wall bucky. Since the actual location of the units in each room was not available at this time, I have made reasonably conservative estimates of the beam center in each room and the location of the wall bucky in the x-ray room. For all walls and viewing windows in these rooms I would recommend using 1/16 inch thick lead (nominally 4 pounds per square foot) to a height of 7 feet. Joints in the lead should be overlapped by 1 /2 inch and all penetrations should be backed with lead. The operator's viewing windows must be at least 24 inches high by 18 inches wide and centered at a height of 5'- 2" from the floor. Please note that there are additional requirements in the State ionizing radiation rules, Chapter 4730.1610. Two layers of sheet rock are sufficient to shield any dental x-ray units. Floors and ceilings will be adequately shielded by the structural concrete. These shielding calculations have made use of the information provided tome by the Argosy staff. Rave used additional safety factors to ensure that the shielding will be adequate if the workloads should be higher than anticipated or if the final location of the units is different than I have assumed. This includes assuming a technique of 100 kVp throughout and generally doubling all workloads. I also have placed the wall bucky in the x-ray room on the wall adjacent to the office, which has the most stringent shielding requirements. If you have any questions or concerns regarding these calculations, please let me know as soon as possible. Please note that it is important for a qualified individual to inspect the lead installation. This is most easily accomplished by havin.9 me inspect the lead prior to being covered by sheet rock if sheet lead is used, or prior to finishing the back sides of the walls If lead laminated sheet rock is used. Argosy University PAI Project No. 27420-01023 Dear Mr. Schoeppner: The above project consists of a three-story medical training facility of approximately 90,000 s.f., to be located at 1515 Central Parkway. The building will be fully fire sprinklered and will be of steel frame construction with an exterior skin of architectural precast concrete and aluminum windows. We anticipate that construction will begin in December, 2002 and be completed in September, 2003. In our informal review of the project on July 18, 2001 with Craig Novaczyk of your department, we requested that the above project be reviewed for building permit purposes under the IBC 2000 building code. Mr. Novaczyk indicated that the City would consider this request under the provisions of Section 104.2.8 Alternate materials alternate design and methods of construction in the 1997 UBC, upon which the current State Building Code is based. This section allows building officials to approve alternate materials, designs and methods of construction, provided they are equivalent to the requirements of the current code. The State of Minnesota will apparently adopt the IBC 2000 code in January 2003. There are functional and economic advantages to the project that would be available under the IBC, including using the equivalent of Type II-N construction, non-rated corridors, and reductions in required exit width. In addition, by adopting the IBC, the State will have endorsed the suitability of this code to provide an adequate level of life safety, and all building projects will be reviewed under this code as of January 2003- We understand that if this project is allowed to be reviewed under the requirements of the IBC 2000 code, the project will be required to conform to all the amendments to the IBC adopted by the State of Minnesota. The observations and testing were performed to meet the general requirement of the 1997 edition of the Uniform Building Code (UBC) Section 1701, Special Inspections and the projects specifications by an International Conference of Building Officials (ICBO) certified special inspector and engineer in training (EIT) special inspector. The work was done under the direction of a professional engineer registered in the State of Minnesota. Available Information GME Consultants, Inc., performed soil borings for the proposed Argosy University. The results were submitted in their "Geotechnical Evaluation Report" under project number 8560-B. We were provided with a set of plans titled, "Eagan Preserve" and associated specification manual, which were prepared by Pope Associates, and were dated November 11, 2002. Previously Submitted Summary Report The results of the compaction testing and subgrade observations and testing were summarized in our report dated March 3, 2003. We direct your attention to this report for a discussion of the testing results, our observations and our conclusions. Compaction Testing The engineered fill placed for wall and column pad backfill primarily consisted of poorly graded sand. The engineered fill was typically placed in about 12-inch thick loose lifts with a backhoe, then compacted with a hand-operated compactor. During this period, 19 compaction tests (119 to 137) were performed. The compaction tests met or exceeded the minimum density requirement of 95 percent of standard Proctor maximum dry density ' (ASTM D 698). The compaction test results are attached to this report for your records. Providing engineering and environmental solutions since 1957 j Duke Construction Project BODY-02-313C June 11, 2003 Page 2 Concrete Reinforcement Observations 3 The concrete reinforcement observations were conducted on an as-needed basis by an engineer in training (EIT) special inspector or level II technician special inspector. To conduct the observations, the special inspector reviewed the project structural drawings and the available shop drawings. The information included bar size, bar length, bar spacing and bar locations. Other items such as clearance, splice length and dowel placements were also included. The information was then used in the field to document the "as-built" conditions. As areas of work were reviewed, various items were compared to the structural drawings. If the area of observed reinforcement did not conform to the structural drawings, the contractor was notified of the required additions and/or concerns. See the attached Daily Observation Reports for a more detailed outline of each concrete reinforcement observation. Based on the results of our observations and available plans, it is our opinion that the reinforcement ' observed has been placed in general accordance with project plans and specifications. a Concrete Testing and Observations ll The concrete testing and observations were performed by an American Concrete Institute (ACI) certified level I or II technician. The observations and testing were performed between December 10, 2002 and April 21, 2003, and consisted of determining slump, temperature and air content as the concrete was discharged from the truck. We also observed the contractor's concrete placement procedures for compliance with industry standards. A total of 26 sets of concrete test cylinders were cast for evaluation of compressive strength of the concrete. There are no outstanding discrepancies of the concrete placement. Review of the 28-day test results indicate the concrete represented by these cylinders has met or exceeded the specified minimum 28-day compressive strength. The concrete tested should be considered acceptable based on the requirements of the plans and specifications. The results of the compressive strength tests were previously forwarded and are attached to this report. Structural Steel Observations 1 The observation and testing of welded connections and bolted connections were provided on on-call basis by ICBO Certified Special Inspectors. These inspectors are also qualified as level II technicians qualified in accordance with American Society for Nondestructive Testing (ASNT), publication SNT- TC-IA, 1988 Edition and American Welding Society Certified Welding Inspector criteria. The structural steel related observations and testing for this report were provided from January 9 through March 31, 2003. See the attached Special Inspector Daily Reports for a more detailed outline of each structural steel observation. To the best of our knowledge the structural steel observed was done in general accordance with project plans and specifications. J Conclusions Based on the results of the compaction testing, it is our opinion the engineered fill tested is suitable for building slab support. The construction will include adding a three compartment sink, hand washing sink, two 2-door refrigerators and shelving in the room adjacent to the coffee sales counter. No cooking or food service operations will be conducted other than making coffee and cappuccino and selling bulk bakery. Please contact this Department for approval prior to adding any additional food service operations. At this time, a HACCP plan has not been submitted for review. In addition, I have found nothing within the plans or application to indicate a HACCP plan review is necessary. The three compartment utensil washing sink and storage room will have a quarry tile floor and base and painted sheetrock walls with alassboard covering the walls behind the sinks. The above room finishes appear to be acceptable. The ceiling material and finishes were not provided for the serving area and the utensil washing and storage room. The plans submitted indicate a three compartment utensil washing sink and a hand washing sink with a splash shield on the left hand side will be located in the utensil washing and storage room. The splash shield will be between the hand washing sink and the three compartment utensil washing sink. A hand washing sink will be located in the back counter in the coffee and bakery service area. Concerns: 1) The plans submitted did not show a mop sink. A mop sink must be conveniently located for disposal of mop water. On 1/20/09 Mr. Robert Swords indicated a mop sink is conveniently located about ten feet from the food sales area. 2) The ceiling material and finishes were not provided for the serving area and for the utensil washing/storage room. The ceiling in these areas must be smooth, easily cleanable, durable and non-absorbent. The washable ceiling must extend over the entire service and service counter area and the entire utensil washing and storage room. Examples of acceptable ceiling materials include vinyl covered gypsum ceiling tiles and smooth finished and painted sheetrock ceilings. 3) Manufacturer and model numbers were not provided for the air pots and coffee makers. They must meet the applicable NSF standard. 4) The size of the air pots was not provided. The three compartment utensil washing sink compartments must be large enough to properly wash, rinse and sanitize the air pots. The specifications indicate the compartments are 10 x 14 inches and 10 inches deep. Equipment Food equipment shall meet the applicable National Sanitation Foundation (NSF) International food service standards. The equipment shall be determined by NSF International or an American National Standards Institute (ANSI) Z34.1 accredited independent entity, including Underwriters Laboratory or the Edison Testing Laboratory, to be equivalent to the NSF International Standard. The use of equipment, that does not meet the NSF standards, prohibited. Bakery equipment must comply with the Bakery Industry Sanitation Standards Committee (BISSC). Install a NSF three compartment, utensil-washing sink (4626.0680) (4-301.12) with integral drain boards, racks or tables, (4626.0685) (4-301.13) for the proper cleaning and sanitizing of all multi-use equipment and utensils. The size of the sink compartment must be large enough to accommodate the largest utensil/equipment, which is to be cleaned and sanitized. Provide and use an appropriate chemical test kit to determine the strength of the sanitizing agent in the final rinse water of the three-compartment sink. ( 4626.0715) (4-302.14) Install a separate food preparation sink if raw food will be cut or combined with other ingredients, or otherwise processed. (4626.0780) Install at least one service sink or curbed unit with a floor drain for disposal of mop water and similar liquid waste. (4626.1080)(5-203.13) Provide hooks or hang-up brackets at the utility sink for storage of mops and brooms. Utensil washing and hand washing sinks are designed and approved only for their intended use. Storage Provide adequate shelving covering the food operation to ensure that food products, utensils or single-service articles are stored at least six inches off the floor. (4626.0730 A.) Food storage shelving used in walk-in refrigerators must be in Page 5 conformance with NSF standard 92. Chrome or zinc-plated shelving without an approved factory applied hard-baked protective coating is not approved for this purpose. (4626.1600) Room Finishes The floors, floor coverings, walls, wall coverings, and ceiling surfaces shall be designed, constructed, and installed so they are: a) smooth, durable and easily cleanable where food operations are conducted; b) nonabsorbent, for food preparation areas, walk-in refrigerators, ware washing areas, toilet rooms, janitorial areas, laundry areas, interior garbage, refuse storage rooms, and areas subject to flushing or spray-cleaning methods, or other areas subject to moisture. (4616.1325) Polymer flooring systems: If polymerflooring such as an epoxy or urethane systems are installed they must be 118 inch minimum in thickness in snack bars and sandwich preparation areas and 3116 inch minimum in thickness in areas where ovens, fryers and other heavy kitchen operations take place and contains aground aggregate to refusal. The finish coat must render the floor surface smooth to the extent that it can be cleaned with available cleaning equipment. A test area should be provided so that our inspector can verify the flooring thickness. Concrete, sealed or unsealed, is prohibited: a) where food product packages, containers, or cases in those areas are opened. b) Under equipment in food preparation and service areas including under service cases. c) in walk-in refrigerators or freezers, ware washing areas, toilet rooms, mobile food establishment servicing areas, hand wash areas, janitorial, laundry areas, interior garbage and refuse storage rooms, areas subject to flushing or spray-cleaning methods and areas subject to moisture. (4616.1335 D.) Unsealed concrete is permitted: For use where outside garbage and refuse containers are placed, including compactors stored on a smooth and nonabsorbent surface. (46261230) Vinyl flooring is prohibited: Ina walk-in cooler or freezer. (4616.1335 C.) Vinyl flooring is not allowed in kitchens, deli areas, behind fast food or service counter areas unless the manufacturer recommends it for this use. It is allowed in storage rooms and retail areas including under food and beverage counters. Proof of recommended use will be required in the form of sales material or a lever from the manufacturer specifically showing the recommended use before approval of this flooring will be granted. Floor and wall junctures: Shall be coved and closed to no larger than one millimeter (1/32 inch) when cleaning methods other than water flushing are used for cleaning floors. At the floor wall juncture where the fiberglass panel meets the floor an acceptable base coving such as stainless, quarry or other pre-approved materials must be installed. (4616.1345A.) Where water flushing is used coving shall be sealed. (4626.1345B.) Glued rubber coving may not be acceptable on fiberglass panels, as it may not bond to the fiberglass material. Floor surfaces: Shall in the food preparation, food storage, and utensil washing areas be constructed of smooth, durable, nonabsorbent, easily cleanable materials, which resist the wear, and abuse to which they are subjected. The walls and ceiling in the food preparation, utensil washing and toilet room areas shall be smooth, non-absorbent, and easily cleanable. The canopy and hood construction must meet the applicable standards of the NSF.
