NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties do agree as follows: 1. DEFERRED ASSESSMENT. The Parties agree that the street improvement costs under the Project in the amount of $6,900.00 shall be deferred without interest until the earlier of the following: A. The Property is sold; B. The Property is subdivided; C. The Property is platted; or D. June 1, 2008. At such time, the deferred assessment shall be payable in equal installments over a period of ten years with interest thereon at interest of seven percent (7%) per annum. 2. WAIVER. The Landowner hereby accepts the deferred assessment for street improvement costs in connection with the Project in the total amount of $6,900.00. The Landowner hereby waives the right to object or appeal the assessments pursuant to MINN. STAT. § 429.081 and further waives notice of hearing on this Agreement. 3. BINDING EFFECT. The Eagan City Code specifically addresses home occupation in Chapter 11, Section 11.03, Subdivision 28 as follows: "Home Occupation" - Any gainful occupation meeting all of the following requirements when engaged in only by persons residing in their dwelling, when that occupation is conducted within the principal structure, when evidence of the occupation is not visible from the street, when no signs are present, no stock-in-trade is stored on the premises, and over-the-counter retail sales are not involved..... Based on information contained in your letter regarding warehousing and employees (assuming your employees would not be residing at your house), you would not meet code requirements and, therefore, this home occupation as described would not be allowed. Regarding 1682 Woodgate Lane, I performed a drive-by inspection of this home and saw no evidence of a home occupation being conducted. I do not recall seeing a pole building or an additional garage at this site. In fact, the day I went by (approximately one month ago), the garage door was open and I did not see any stock-in-trade being stored in the garage. WINKLER/JACKSON ADDITION REZONING AND PRELIMINARY PLAT The application of Richard Winkler to rezone from Agricultural to Planned Development consisting of 91 acres and preliminary plat approval of Winkler/ Jackson Addition was next reviewed by the City Council. The Planning Commission had considered the application on April 28 and on May 26 reviewed the application in detail and recommended denial of the applications. Mr. Mike Gair, planner, appeared and reviewed in detail the proposal together with revisions from the original plan. A large number of neighboring property owners were present. There was discussion concerning topography and it was noted that the Residential Multiple at the northwest corner on Cliff Road was provided on the Comprehensive Plan but the developer requests Neighborhood Business in that location. There was review of the park land proposal to be dedicated both by the developer and MN/DOT as well as the R-1 adjoining Slater's Acres to , consist of six units. Mr. Gair stated the Neighborhood Business area to the north of the 7.7 acres is isolated by steep slopes and trees on the south. The 44.7 acre parcel of R-3 would consist of 5.3 units per acre net density with a 100-foot buffer on the west, heavily wooded. The first situation deals with the Lumber Millwork - Pig Pen (old theater building) located adjacent to Cedarvale's property. The area around the building is terrible and unfortunately it reflects directly back to Cedarvale because most people think it is part of the Center. Please notify the owner of the building that this should not be tolerated. We have had the same notice for a problem that, in my opinion, is less serious. The other matter deals with the weeds growing by the Mr.Donut Shop and Country Club on the old Highway 13 road. This again is a bad reflection on the whole Cedarvale area. I am assuming this is on city property since the road was turned back by the State. My suggestion is to have these cut or sprayed to control this problem. Company, a Minnesota corporation, party of the first part, hereinafter referred to as "Cedarvale", and Discotrec, Inc., a Minnesota corporation, party of the second part, hereinafter referred to as "Discotrec", WITNESSETH: WHEREAS, Cedarvale is the owner of the real estate in the County of Dakota, State of Minnesota, legally described on Exhibit A attached hereto and hereby made a part hereof; and WHEREAS, Discotrec is the owner of the real estate in the County of Dakota, State of Minnesota, legally described on Exhibit B attached hereto and hereby made a part hereof; and WHEREAS, a portion of the westerly boundary of the said premises of Cedarvale adjoins the easterly boundary of the said premises of Discotrec; and WHEREAS, Cedarvale desires to grant to Discotrec an easement and right-of-way upon its said premises on the terms and conditions hereinafter set forth; NOW, THEREFORE, in consideration of the premises and of the mutual covk~.nants and agreements of the parties hereinafter contained, it is hereby agreed as follows: 1. Cedarvale hereby grants and conveys to Discotrec, its tenants, employees, visitors and invitees, a non-exclusive easement and right-of-way for driveway and parking purposes over and upon the said real estate owned by Cedarvale described on Exhibit A attached hereto and hereby made a part hereof, after seven o'clock p.m. on Mondays through Saturdays and anytime on Sundays. 2. While said easement and right-of-way shall be in force and effect, Discotrec shall pay to Cedarvale the sum of Fifty Dollars ($50.00) per month on the first day of each and every month. 3. The easement and right-of-way granted herein is to be held by Discotrec, its successors and assigns as appurtenant to the said described real estate owned by Discotrec described on Exhibit B attached hereto and hereby made a part hereof; provided, however, that if Cedarvale shall sell the property described on Exhibit A attached hereto, the easement and right- of-way granted to Discotrec herein shall terminate as of the date that such sale shall be completed. Cedarvale agrees to give to Discotrec written notice of any such sale twenty.(20) days prior to the completion of any such sale.. Such notice shall be deemed to have been given when delivered personally or when deposited in the United States Mail, registered, postage prepaid, addressed as follows; Discotrec, Inc., 3994 Cedarvale Drive, Egan, Minn- esota, 55122.
