For your information, this particular water main within this sub- division was installed by the developer of this subdivision in 1961 and was turned over to the City for maintenance in 1966. Mr. and Mrs. Brunker built their existing house during the summer of 1965. Sanitary sewer and related services to service this sub- division were installed by the City during 1968. In March of 1970, the property in question connected to the sanitary sewer service. As we discussed during our phone conversation of February 14th, there is publicly-dedicated right-of-way approximately 13' in back of the existing curb. It is my understanding that construction activity to correct this broken water main was confined to the public right-of-way. There is no other drainage and/or utility easement dedicated to the City beyond the public right-o£-way. When available, I will forward to your attention a copy of the 35m slide that I took of the property in question on February 9, 1983. I apologize for the long delay in this response to your letter. Due to the re- location of City Hall offices combined with the changeover of per- sonnel within the insurance company, it was difficult to respond any sooner. In your letter, you had.expressed four concerns which you wanted the City to respond to as follows: 1) The field claim representative with the Home Insurance Co., Mr. Jim Koch, indicated that the damage to your sidewalk had apparently occurred prior to the watermain break and was not a direct result of the watermain. This was outlined in a let- ter to you dated May 3, 1983. The City has to rely on the field investigation and final determination of the insurance company in responding to claim for damages. If this is pur- sued further, the City will request the insurance company to continue to defend any potential City liabilities. 2) During the first week of November, I personally inspected the yard where the construction repair had taken place. I was unable to identify the area that you feel was repaired unsatisfactorily. I will be happy to meet with you this spring after the snow melt to identify those areas that are unsatisfactory so that the City can perform whatever addi- tional repair may be required. 3) I did witness some minor settlement in the street where the patch was performed. After this winter's freeze/thaw cycle, I will again review the situation in the spring and our Main- tenance Division will perform whatever additional corrective work is necessary. 4) The responsibility for the underground utilities in that area and subsequent repair is broken down as follows: THE LONE OAK TREE... Director of Public works TAC/jach OCT 12W October 7, 1983 Mr. Tom Hedges City of Eagan Eagan, Minnesota 55121 Dear Mr. Hedges: On Tuesday, February 8, 1983, the City of Eagan Water Department began digging in the front yard to fi.c a massive leak in the city water system. As it turns ouc she leak was under the road some fifteen (15) feet from the edge of the yard. To find this, you dug up approximately 10 feet of my yard. This leak was caused by a cracked pipe, apparently from settling, from a system that has been under a paved road for approximately 15 years. Prior to this leak being fixed my concrete driveway and sidewalk were forced up and the sidewalk cracked. I believe this was due to the ground being saturated with water from the leak and then freezing. After the leak was fixed, the concrete did not raise any more and in fact started to and did return to its normal position. I have several concerns which I would like the city's position on. 1. The insurance company did not honor my claim to repair the cracked concrete. 2. Although the hole dug in the yard has been filled in, it was a rather sloppy job. 3. This area has experienced settling this summer. 4. Who is responsible if the pipes in this area (water, sewer, gas) should break like the main water pipe under the road did? Please advise your position on these issues so I may determine what course of action to pursue.
