COLBERT, DIRECTOR OF PUBLIC WORKS DATE: JUNE 17, 1993 SUBJECT: CITIZEN COMPLAINT JIM CLICKMAN - 2033 CARNELIAN LANE PARKING TICKET Council Member Wachter gave me the attached Citizen Complaint form and asked that I look into k. On June 15th, 1 contacted Mr. Clickman to learn more about his complaint. Mr. Clickman lives on the north side of Carnelian L.ane just west of Rahn Road. This portion of Carnelian Lane is presently being reconstructed. During the timeframe when the streets were being paved, the homeowners were requested to park on anpther street for one day. Mr. Clickman indicated that he then parked his car on Jade Lane east of Rahn Road where parking is prohibited from 2:00 a.m. to 6:00 a.m. Upon completion of the paving for the day, he neglected to return his vehicle to his home address and the following morning found that it had been ticketed for violation of the posted parking restriction. He recognized his violation and has since paid his violation fee. What raised Mr. Clickman's complaint was not so much being ticketed for the violation, but the fact that approximately one week later the apartment compiex on the south side of Jade Lane was paving their parking lot and had all tenants park on Jade Lane through the evening hours. He indicated that he observed that none of these vehicles were tagged for the apparent same violation. Subsequently, he feels that the parking restriction is not being fairly enforced and he would like to know how he can get his $20 fine refunded. Public Works was not aware of any request to have the no parking restrictions temporarily bagged or removed either for the street construction or the apartment parking lot resurfacing project. I explained to Mr. Clickman that the citation was probably a result of a routine patrol on one night that did not occur on the other night of violations. He then commented that he wished the officers would have recognized that the street of the violation vehicle was under construction and either not issued the citation or contacted them to move the vehicle. . Page Two June 17, 1993 The conversation with Mr. Clickman was more orientated towards the enforcement policies and procedures of the Police Department and what process was available to pursue a refund of his citation payment.
