Ft h9s been.brought to the City's attention that there have been some
concerns over the drainage pattern along your common property line
located between the above re£erenced addresses. During the platting
of the i^]ilderness Park lst Addition, customarq IO foot drainage and
utility easements centered over the common propertsy line was not
provided £or. Consequently, it is the City's position that each
individual property owner should not alter or change the natural
course of drainage and should eontain as much drainage on their
respeetive properties as is Feasible. On.e o£ the reasons
for requiring setbacks from side property lines is bo allow the
individual homeowners adequate side yard areas to handle any respective
drainage problems that they may have.
In a situation such as this it is strongly recommended that two property
owners work together to arrive at a coimnon solution to both drainage
problems.

Re: YQur Letter Dated March 25, 1980, Concerning Residential
DTainage Problems
On April 16, 1979, we purchased our home in Eagan. It was agreed
upon with Mike Gsles, the building contractor, to build a retaining
wall an the side of our property facing the Smith's, in order to
contain runoff from our lot. On three occasions the Smiths harassed
the bu:ilder's crew to the point that thep stopped work on the re-
taine.r wall. Upon completion, the wall was not to the Smith's sat-
isfaction. Mr. Smith asked me to lower the wall tko more ties,
which I did. He then excavated soil on his side of the propertV
line for fill in'to the lake at the back of his lot. As a result,
the lots were no longer the same elevation. Mr. Smith then asked
me to put additional fortification down the property line so we
would not drain on his lot. I dug a trench approximately six (6)
inches deep, set and staked two by twelve inch timbers, and again,
at his request, covered the soil on our side of the lot line with
gravel to prevent any soil moving with drainage that might occur.
Mr.•Smith continued to excavate on his side of the lot line until
my timbers fell over. He than asked me to remove the timbers, which
I did.,
These were our attempts during the summer of 1979, to contain as
much d'xainage on our property as is feasible. The Smiths had not
been satisfied with our efforts and last summer requested Mr. Daie
Petersun and Mr. Doug Reid to inspect the property lines. Enclosed
is a,cupy of the letter they sent both parties. The incident which prompted this last complaint resulted from our
contincxing attempts to contain drainage. We contracted with Mr.
Fred!Bergacker to install gutters on the front of our house to catch
roof,dsainaqe. Mrs. Smith proceeded to complain to the contractor
aboult €he gutters to the point that the contractor called me at work
that? day to inform me my "neiqhbor lady had cussed him out". Upon
arriving home that night I was clearinq my driveway of water, so it
wouldinot drain on my neighbors lot, when Mrs. Smith came out to
comp,'lain to me. At that time I explained to Mrs. Smith our intentions
concernimg the drainaqe, which I will now reiterate.

`---Wp--have con'tracted the resurfacing of our drive so that no drainage
cani get off on their side. The newly instaZled gutters will drain
ontn the drive as soon as it is resurfaced.- When Mr. Smith has com-
ple_ted excavating along his side of the lot line, I plan to shore
up,on our side so as not to lose the fill from our reLaining wail.
We feel we have made every reasonable attempt to contain as much
dr:ainage ora our progerty as is feasible. Since purchasing our home
the only fi_11 we have dumped along onr lot was the gravel inside
ttn€ timbers to prevent erosion. At present the mutual lot line is
the low po3nt on both lots. Current erosion marks indicate the
primary wai:er source cominq from drainage on the Smith's lot, not
ow:es. Mrs.. Smith expressed concern over seedling trees on the back
of their lcct. The primary danger to the trees in question is
a.mtaosed by soil erosion and,the possibility of smothering. This
caald best be prevented by any method of securing the soil surface,
sumh as planting grass, landscaping, gravel, etc.
It.is our contention that we have made, and will continue to make,
evwry reascsnable attempt to contain any runoff from our property,
and have already done more than many property owners would to mee?
dentands made by their neighbors.
In conferri;ng with the City Police Departnent, we feel two options
are'open to us. The first is to notify the police of trespass or
hasassment, and follaw up by filing an official complaint. The second
opkion is tn protect our privacy and property by legal (a court
injmnction against harassment) or physical force.
It :is our preference to have no further contact with the Smiths,
allowing bogh families some degree of peace and privacy.
