valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant and convey unto the City, its successors and assigns, a temporary construction easement for
site grading and excavation purposes over and across the following described premises, situated
within County,Minnesota,to-wit:
Together with a temporary easement for construction purposes, over, under and across that
part of said Lot 24,described as follows:
Beginning at the northeast corner of said Lot 24; thence on an assumed
bearing of South 00 degrees 12 minutes 55 seconds East along the east line
of said Lot 24, a distance of 32.97 feet; thence North 70 degrees 19
minutes 47 seconds West, a distance of 42.42 feet; thence South 19
degrees 40 minutes 13 seconds West, a distance of 20.00 feet; thence
South 70 degrees 19 minutes 47 seconds East to said east line; thence
northerly along said east line to the point of beginning.
Said temporary easement shall expire August 1,2019.
The grant of the foregoing temporary construction easement for site grading and excavation
purposes includes the right of the City, its contractors, agents and servants to enter upon the
premises at all reasonable times to construct, reconstruct and inspect site grading and the further
right to remove brush, undergrowth and other obstructions. After completion of such construction,
maintenance,repair or removal,the City shall restore the premises to the condition in which it was
found prior to the commencement of such actions, save only for the necessary removal of brush,
undergrowth and other obstructions, subject only to permanent easement alterations.
The Landowner, their heirs and assigns, does covenant with the City, its successors and
assigns, that it is the owner of the premises aforesaid and has good right to grant and convey the
easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed as
of the day and year first above written.
