As can be seen from the enclosed correspondences, the City of Eagan has sent several notices to Opus requesting reimbursement. Recent telephone conversations with Marc Anderson of Opus Corporation indicated his understanding was that the City was to perform this analysis for their property as a commitment from the public hearing process when the plan was formally adopted by Council action. Enclosed is a copy of the minutes from the April 3, 1990, Council meeting with those portions pertaining to Opus' concerns highlighted. I do recall their request to have this analysis done to determine what the financial impact would be on a development scenario; however, I do not concur that the City agreed to do it at our expense. I recall reviewing the issue with you as the consultant was performing the work and you had concurred that Opus should bear that expense. I am unable to receive a commitment from Opus to reimburse the City for our costs incurred. Subsequently, since I am unable to assist the Finance Department in collecting this outstanding balance, I would appreciate your direction as to how the City should proceed regarding this matter and, if it is determined that it is not to be pursued, which account this expense should,be charged to. Water quality requirements for this location are dictated by LeMay Lake and will be met without the requirement of any casb contribution it the development provides a three cell pending facility. r e A three cell ponding facility can be built in an area of approximately s Ac. There are other alternatives such as the creation of several (four or five) small detention ponds to serve Smaller areas but any alternative can only be defined during final design. The combined area for several ponding facilities more than likely will exceed 9 Ac due to the extra open space normally provided around ponds but could be used for aesthetics. Northeast Quadrant of Lexington Ave. and Yankee Doodle Rd. Two cell Pond Wet volume 21.4 AP Nutrient Removal 75% Phosphorus concentration 196.8 ppb. This development is well defined trod the proposed parameters for pond DP-11 will provide the required storage. The two cell treatment facility on be obtained by constructing a berm which will divide DP-11 to create two separated treatment basins contained in the pond. ALTERNATIVES Pond DP-11 is a DNR protected wetland (W-134 In order to divide this pond into a two cell pond as required for water quality treatment, the developer will need a special permit from the DNR. The following paragraph illustrates some of the possible alternatives to provide an equivalent nutrient removal if the DNR permit is not granted. Upstream ponding (in the proposed development ) L A two cell pond with an arcs of approximately 1.3 Ac and 42 AP of wet storage intercepting runoff from 78 Ac of the proposed development or, b. Two ponds, each with an area of .75 Ac, servicing a total area of 70 Ac, and with a total wet volume of 6.0 AP, or, Downstream ponding (downstream of pond DP-II) a One pond with an area of approximately SA Ac and a wet storage volume of 5.5 AP, or, d. A two cell pond will not be efficient since it will require 1.4 Ae of area for a wet volume of 4.8 AF. COMMPIVTS The two proposed developments are located in district D which is LsMay Fake's watershed. LeMay Fake is a classified Type I watcrbody severely affected primarily by runoff from its direct drainage. The Eagandale Development is located in the direct drainage area to Lemay Lake and therefore the water quality requirements to be met by this waterbody are higher than at other locations in the same district.
