Dear Mr. & Mrs. Reimer and Mr. & Mrs. Delauder
I am writing in response to your objection to the proposed construetion of a new 2 1 " diameter
storm sewer from the low point in Beacon Hill Road to Pond BLP-5 at the rear of your homes.
Presently, the existing 21" storm sewer drains the low point of Beacon Hill Road and directs
storm water to the backyard areas and homes abutting Covington Court, where flooding has
occurred.
An alternative to not constructing the new storm sewer pipe to Pond BLP-5 is to construct a 9"
diameter orifice in the existing 21" storm sewer to Covington Court. The 9" orifice will satisfy
the freeboard requirement for a 1% Storm Event and prevent flooding of the homes abutting
Covington Court from an event equivalent to the July 2000 Storm.
It is likely flooding ?vill occur in the low point of Beacon Hill Road with the installation of a 9"
orifice during any 1% storm or greater events, however, except in extreme events, not to the
extent homes will flood or the EOF to Pond BLP-5 will be used. Note that the EOF to Pond
BLP-5 is higher than the low entry elevation of one of your homes abutting Beacon Hill Road
by 0.1' and is lower than the EOF to Covington Court by 0.6' from Beacon Hill Road.
The 9" orifice is more susceptible to plugging than the existing storm sewer system. Primarily
because of its size, but also due to its location, any plugaing or increased restriction of flow
through the orifice will increase the potential for flooding in a significant storm event. The first
homes to be impacted by any significant flooding in this portion of Beacon Hill Road are those
at the low point, your homes.
In order to provide additional protection for your homes, the emergency overflow (EOF) to
Pond BLP-5 may be re-graded and improved from Beacon Hill Road to insure your lower
entries don't flood. Disturbance of portions of your properties, primarily between your homes
and the street, would be anticipated for the construction of the EOF. The Restoration Policy we
have previously discussed will be followed for areas impacted by the construction activity.
Your support of these drainage improvements and cooperation regarding easement acquisition
and property restoration will be appreciated. I will anticipate your response to this letter.

Enclosed please find a copy of a Ponding Easement apparently recorded prior
to the plat of Beacon Hill Addition. We do not have an accurate plat ma.p
in our office, however, informa.tion provided fio us by a buyer of Lot 12,
Block 9, indicates that the plat provided for a Ponding Easement replacing
the Easement described in Exhibit A on the 1975 Easement. I have also
enclosed a copy of our letter of March 1979 from Keith Gordon indicating
that the 1975 Ponding Easement was no longer necessary and could be vacated.
Perhaps you could review the plat and make a determination if this can
actually be vacated and vacation can be initiated by the City.

to the pIat of Beacan HiI.l Addition. We do not have an accurate glat map
in our office, hawever, information provided to us by a buyer of L+at 12;'
B1ock 9, indicates that the plat grovided for a Ponding Easement replacing
the Easerient described in Exhibit A on the 1975 Easement. I have also
enclosed a capy af our Ietter of March 1979 from Keith Gordon indicating
that the 1975 Ponding Easement was no langer necessary and could be vacated.
Perhaps yau could review the plat and make a determination if this can
actually be vacated and vacation can be initiated by the Gity.

It apgears that said Easement was recarded prior to platting Beacon 8i11.
Subsequently, a Ponding Easement as shawn on the plat was intended to be
the only Easement in the area. Also, the Easement in Document No.454040
contains a tygographical error.
Therefore, the Easement in question will be released in the very ntar future.
