While the City has no desires to vacate this eyebrow cul-de-sac, we do not have any objections to doing so upon petition of the affected property owners. In order to perform this necessary vacation, it will require preparation of respective legal des- criptions of property to be vacated by the City. Consequently, this will require detail computations which will have to be performed by our consulting engineering firm. The present estimate for preparing these legal descriptions is approximately $200-$400, which is normally the responsibility of the petitioner. If you submit a letter to us indicating your intentions to cover the engineering/surveying costs associated with the preparation of these legal descriptions necessary to proceed with the vacation, the City will proceed with the necessary public hearing. The financial responsibility for proceeding with this vacation will be with the petitioner regardless of benefit to other properties as the City has no legal recourse to collect fees from other property owners then those listed on the petition. This fee will have to be paid prior to the execution of the documents by the City of Eagan. However, this letter may be used by you for purposes of conveying title to Lot 12, Block 3, Meadowland, with theunderstanding that the eyebrow will be vacated in the normal course and timetable of the Eagan City Council.
