The City of Eagan regrets that you are not pleased with your builder's
performance on your new home. You were well advised in having a company
representative from your homeowners warranty insurance company mediate your
dispute. I am now in receipt of letters from Richard Grimm, HOW Claims
Representative, and Joe Miller Construction Company stating that the agreed to
corrections are completed.
The City building inspectors can only inspect for building codes as mandated
by the State of Minnesota and are limited to life safety and minimum
requirements for structural stability and health. In reviewing your list of
corrections, the code related items were the final grade which now is
completed to City standards and the blocked sliding patio door. The blocked
dooT was ordered by the building inspector as a safety requirement until a
safety railing or approved deck is provided.

The City of Eagan has received a number of complaints from residents
who have purchased a home constructed by Joe Miller Construction
Company. Those complaints range from lack of telephone and gas
connections to lack of residential home completion. Complaints
have been received from several home buyers located throughout the
community. Complaints have been directed to members of the City
Council as well as the City staff.
The City has building inspectors to make sure all structural and
other code related requirements are fulfilled with residential
home construction. The City is confident that minimum building
code requirements have been satisfied. The City has also adopted
a contractors license policy which is intended to assure residents
that a builder who is licensed through the City is responsible and
provides a high level of residential construction for future home
buyers. The City Council is questioning your contractor license
and is planning to investigate several of the complaints.
After an investigation of these complaints, your contractor license
will be evaluated.

The letter she presented to you was received in our office
Jan. 23, 1985. Since that time my subcontractors and carpenters
have tried everyway possible to satisfy their complaints. Still
not satisfied, we notified HOW Warranty Corporation to help us.
On August 7, 1985 we had a meeting in their home. Enclosed
you will find a Dispute Settlement Record of our meeting.
This outlines the decisions which HOW felt would resolve the
problems. The owners signed this agreement August 27, 1985.
We talked to Richard Grimm,ClaimsRepresentative of HOW Nlarranty
