THIS ASSESSMENT DEFERRAL AGREEMENT ("Agreement") is made this ~~ay
of Awns 2005, by and between Larson Training Services, Inc., a Minnesota
corporation (hereinafter "Landowner") and the City of Eagan, a Minnesota municipal
corporation (hereinafter the "City"). (Landowner and City are collectively referred to as the
"Parties.")
WHEREAS, Landowner is the fee owner of certain property in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:
Lot Four (4), Block One (1), Barton McGray Addition.
(hereinafter the "Property"); and
WHEREAS, as part of Public Improvement Project No. 80OR (hereinafter the "Project")
the City is proposing to assess the Property for street improvement costs in the amount of
$6,790.14; and
WHEREAS, the City is willing to defer the assessment for a limited time in anticipation
of redevelopment of the Property; and
WHEREAS, Landowner is willing to accept the deferment and pay the assessment all
upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration. the receipt and sufficiency of which are hereby acknowledged,
the Parties do agree as follows:
1. DEFERRED ASSESSMENT. The Parties agree that the street improvement
costs under the Project in the amount of $6,790.14 shall be deferred
without interest until the earlier of the following:

2. WAIVER. The Landowner hereby accepts the deferred assessment for
street improvement costs in connection with the Project in the total
amount of $6,790.14. The Landowner hereby waives the right to object or
appeal the assessments pursuant to MINN. STAT. § 429.081 and further
waives notice of hearing on this Agreement.
3. BINDING EFFECT. This Agreement shall be binding upon and inure to the
benefit of the Parties' heirs, successors and assigns and shall run with the
land.

APPLICATION: An application has been submitted requesting a
Conditional Use Permit to allow a pylon sign for Motec Transmission
Clinics on Lot 4, Block 1, of the Barton McGray Addition.
COMMENTS: All seven lots in this addition have frontage along
Cedarview Drive, a service road for Cedarvale Blvd. Lot 2 (Sherwin
Williams Paint) and the Mediterranean Cruise Restaurant, Lot
5, have pylon signs along this service road. They are approximately
400' apart. (See exhibit.) City Code requires 300 lineal ft.
between pylon signs on the same side of the street and a maximum
height of 27-.
The proposed sign is 20' tall, two-directional, interior-lighted
and has a signage area of 60 sq. ft. The applicant will locate
this sign along the northwest property line that abutts MnDOT
(Hwy. 13) right-of-way. The widest portion of the sign must
be kept 10' within the property line. No other pylon sign is
being proposed along Cedarview Drive.
If approved, this Conditional Use Permit shall be subject to:
1) Sign placement as approved by the City Council.
2) The one-time sign fee of $2.50/sq.ft.

In official action that was taken by the Eagan City Council-at a regular
meeting held on Tuesday, August 19, 1980, your request for an extension
of the Conditional Use Permit granted to Eagan Automotive for the
construction of an automotive transmission repair facility and training
center was granted for one (1) additional year.
Your brother, Dave, was present and explained the need to revise the over-
night parking restriction which was an original condition of the Conditional
Use Permit approval. The City Council did agree to amend that action
by rewriting condition number four to read as follows: "That only vehicles
with current licenses. and a work order should be allowed to park in the
rear parking lot. That there be no overnight parking except for occasional
and emergency parking."
We are hopeful that this action will eliminate the concerns you stated in
your letter dated August 4, 1980, regarding the overnight parking
restriction. Good luck on your construction plans.

An application has been submitted for a conditional use permit for a pylon sign
located on Lot 4, Block 1, McGray Addition.
Coimients
1. According to Ordinance 16.05, Subdivision 2, states "No pylon sign may be
located within 300 feet of any other pylon signs measured on the same side of
the street."
2. In reviewing all pylon signs within the Barton McGray Addition, the proposed
automotive center is the first applicant to locate a pylon sign on the new align-
ment of Highway 13 which will be relocated on the north side of the Barton McGray
Addition. The proposed pylon sign is 300 feet from any other existing pylon signs.
3. The proposed pylon sign shall not be more than 27 feet in height or have sign
coverage of more than 125 square feet.
4. The proposed sign should meet all other applicable ordinances.
*Note: You may recall on April 24, 1979 the Advisory Planning Camiission recorended
approval for a conditional use permit for an automotive center at this present
location.

A petition has been submitted for a conditional use permit for an automobile
training center and repair shop.
Comments
Lot 4, Block 1, Barton McRay Addition is a platted, undeveloped lot..which
consists of approximately .84 acres. The proposed repair facility would
consist of approximately 2,640 square feet for the initial building and
planned expansion for approximately 1,056 square feet. This would bring
the total building lot coverage to approximately 9%.
According to Ordinance 52.07, Subdivision 10, allows motor vehicle repair
or service facilities within a general business district as a conditional
use. In reviewing the site plan, the site appears to be well designed.
All building setback's are met and this would even include the future expansion
area. According to the zoning ordiance a minimum of 16 parking spaces would
be required for the proposed facility. The site plan indicates 8 parking
spaces in the front of the building and roan for at least 13 additional spaces
in the rear. So there appears to be no panting problem for the proposed site.
The zoning ordinance indicates that a 20 feet green area be provided between
a public street and any parking area. The proposed plan only indicates 16 feet
so this should be increased an additional 4 feet.
If approved the conditional use should be subject to the following conditions:
1. The parking area on the site plan should have an asphalt service and
concrete curbing around the entire perimeter of the parking area.
2. A 20 foot green area should be required between the access road and the
proposed parking area.

3. The applicant should be required to provide between a 2 and 3 foot
solid fence or sow type of screening around the perimeter of the rear
parking lot. In the future when T:H. 13 is relocated it will be abutting
the rear of this property so screening and landscaping should be required
in the rear of this property.
4. Only vehicles with current license should be allowed to park in the
rear parking lot.
5. The proposed sign is going to be a pylon sign, another conditional use
permit should be required.
6. A $1,000 landscape bond should be required and not released until one
year after the landscaping has been conpleted.
7. Grading and drainage plans shall be approved by the Public Works Director
prior to issuance of a building permit.

repair service facility. Ile said the plan shows 8 parking spaces in front and 13
in the rear and the Planner's report of April 18, 1979, was reviewed. Mr. Borneman
