It has been brought to the City's attention that there have been some
concerns over the drainage pattern along your coinr.ion property line
located between the above referenced addresses. During the platt,ing
o€.the Wilderness Park lst Addition, customary 10 foot drainage and
utility easements centered oder the common nroperty line was not
provided for. Consequently, it is the City's position that each
individual property owner should not alter or change the natural
course of drainage and should con+ain as much drainage on their
respective properties as is feasible• One pf the reasons
for requiring setbacks from side property lines is to allow the
individual homeowners adequate side yard areas to handle aw respeetive
drainage problems that they may have.
In a situation such as this it is strongly recommended that two property
owners work together to arrive at a common solution to both drainage
problems.

Re: Your Letter Dated March 25, 1980, Concerning Residential
Drainage Problems
On April 16, 1979, we purchased our home in Eagan. It was agreed
upon with Mike Giles, the building contractor, to build a retaining
wall on the side of our property facing the Smith's, in order to
contain runoff from our lot. On three occasions the Smiths harassed
the builder's crew to the point that they stopped work on the re-
tainer wall. Upon completion, the wall was not to the Smith's sat-
isfaction. Mr. Smith asked me to lower the wall two more ties,
which I did. He then excavated soil on his side of the property
line for fill into the lake at the back of his lot. As a result,
the lots were no longer the same elevation. Mr. Smith then asked
me to put additional fortification down the property line so we
would not drain on his lot. I dug a trench approximately six (6)
inches deep, set and staked two by twelve inch timbers, and aqain,
at his request, covered the soil on our side of the lot line with
gravel to prevent any soil moving with drainage that might occur.
Mr. Smith continued to excavate on his side of the lot line until
my timbers fell over. He than asked me to remove the timbers, which
I did.
These were our attempts during the summer of 1979, to contain as
much drainage on our property as is feasible. The Smiths had not
been satisfied with our efforts and last summer requested Mr. Dale
Peterson and Mr. Doug Reid to inspect the property lines. Enclosed
is a copy of the letter they sent both parties.
The incident which prompted this last complaint resulted from our
continuing attempts to contain drainage. We contracted with Mr.
Fred Bergacker to install gutters on the front of our house to catch
roof drainage. Mrs. Smith proceeded to complain to the contractor
about the gutters to the point that the contractor called me at work
that day to inform me my "neighbor lady had cussed him out". Upon
arriving home that night I was clearing my driveway of water, so it
would not drain on my neighbors lot, when Mrs. Smith came out to
complain to me. At that time I explained to Mrs. Smith our intentions
concerning the drainage, which I will now reiterate.
