Public Works Utility Maintenance personnel were called out at 7:35 a.m. on that date in response to the report and discovered a blocked sanitary sewer line on Yankee Doodle Road just west of Aspen Drive. City crews worked until approximately 9:00 a.m. at which time the blockage was removed and sanitary sewer service was restored. The apparent cause of the sewer blockage was a build up of grease and soap in the sewer line. We cannot accept, in light of the three occurrences at Ms. House's residence, any suggestion that the City is maintaining a properly designed or inspected sewer system. Certainly, no homeowner should accept as normal or reasonable the number of occurrences which Ms. House has experienced. The contention that the City did not know of the construc- tion activities which gave rise to the first two occurrences is of little consolation to Ms. House. Moreover, we assume that the City was aware of the construction which presumably could not have occurred without the issuance by the City of a permit. Your letter also fails to suggest what action, if any, the City would have taken had it possessed the knowledge which you contend it lacked. Contrary to your statement, Ms. House denies that the City has ever contacted her to discuss the sewer system design or any alternatives which could prevent future occurrences. Her contacts with the City, other than my letters, have been limited to reporting the damage and obtaining the names of responsible persons and insurance carriers. Moreover, you have missed the crucial fact that the continued maintenance of the present system constitutes a nuisance and negligence on the part of the City which reduces the value and marketability of her home. Certainly, given the pending reconstruction and widening of Yankee Doodle Road, the likelihood of future occurrences seems inevitable. The burden should not be upon a resident, particularly one who has experienced what Ms. House has, to tell the City what is wrong with its sewer system. The City under the circumstances should, at a minimum, be willing to explain to her precisely why these three incidents have occurred and what can be done to prevent future situations like them. Nothing in your letter even remotely suggests that the City acknowledges that the problem exists. Unless and until the City is prepared to address the issue Ms. House would have little recourse other than the commencement of a lawsuit seeking damages and injunctive relief. The fir'si.t concerns the pending street and utility assessments as they affect the Surrey Height area of Eagan. As you know, the City has proposed an asesessment plan which is inequitable and in violation of the established legal articles governing this townh,ome association. It was established : at. a meeting in i?-1pr`L.L, attended by Tom Colbert and yourself, that the property against which these assessments are to be levied is owned equally by 164 homeowners, and that none benefits more from nor- bear-_ greater liability for the improvements to or u.=..ue derived from the property. Consequently, all assessments are to he shared equally • - by the homeowner-s. Subseq_ent to the above-mentioned meeting, the As;soci;at.ion"s attorney and its management firm have supplied Mr. Colbert with the r-egr.ac:s,ted documentation ver-:ify:ing that the above is true and requesting that the pending assessments be corrected to conform with the re uired equal distribution. Yet nothing has been clone. As a result, homeowners on fl`_=.pen ]hive continue to have recorded a. Fiei`d nr assessment of $2298 ,:I while: others an Surrey Heights ,hov+ pending assessments as low as 356. One consequence of this is that Aspen Drive homeowners who sell their property are faced with an assessment escrow of nearly $5000 (twice the pending amoynt:.), figure no townhome owner can afford. The total refusal of the City and the County to correct this unfair treatment of the citizens and voters in this area is inexcusable. We have been patient well beyond reason, and we, believe that action must be taken now to protect our rights The second problem that persists for the residents of Aspen Drive concerns a long-standing sewer problem that has three times since 1979 caused us to he flooded out of our home due to back-up of the City's sewers. This, too, is a matter of record with youi, office and with the Public Works Department. My own attorney has contacted you by mail after the 1984 and 1986 incidents. Unfortunately, these matters are always referred to Mr. Colbert who dances around them in his usual smiling, evasive and totally ineffectual sway. it is the City's contention that., because two of the :incidents were caused by construction accidents in the neighborhood„ the City bears no liability for the fact that there are no backflon preventerss in the se=wer line=s. (The third incident, in 1986, was not caused by construction but was the result_ of blockage in the sewer line which had not been adequately cleaned and maintained.) Mr. Colbert also seems to believe thr_ 'it because insur.atnc companies cover the losses, there is no nar-m done. In my own case, 1 have sustained $12,000 in covered losses from the three incidents, yet 1 have not ever been compensated for months of lost, time, lost income, and loss of the use of my home, not to mention the serious depreciation in property value that is a. consequence of this situation. To avoid a lawsuit that my attorney threatened to file in 1986, the Public Works department finally sent personnel to :Surrey Heights to locate the sewer lines. it is itself a commentary on the effectiveness of that department that (a) it did not even know where its own lines are located„ and (b) it took: nearly a year for them to finally get around to completing the task of locating the lines.. However, knowing where the sewage comas from does, nothing to prevent it from happening again. And l cannot acc,apt the City's argument that it will not install backflow preventers because they are difficult to maintain. The City of Eagan has a responsibility to assure that sewers are adequately constructed to begin with and tha.t residents are not .=subject to continued peril because a known hazard 1<.> allowed to exist untreated, Three :inr_idents, many claims, and legal notices ;core than adequately establish the nature of the problem. It is time now fnr- this 'C'ity to admit its responsibilities to its taxpayers. Both of these problems affect twenty homeowners on Aspen Drive. We are taxpayers and ri'oter's who have been unfairly treated in the past, We await some evidence from your office that you are, as you profess in your campaign literature, concerned for the rights and welfare of the citizens of Eagan.
