I want to apologize if we did not respond to your letter dated January 2, 2000; my staff was unable to locate a copy of your letter or our response. This is particularly disturbing because we pride ourselves on our service to citizens; thank you for your understanding. Pond JP-21 is now and will continue to be part of our storm sewer system, a complex network of interdependent pipes, reservoirs and emergency overland flow designed to respond adequately to the 100-year storm standard, or, more accurately, storms with a 1% likelihood of occurring in any given year. During rain events, you can expect JP-21 water levels to rise and subside as the rainwater works through the system. The presence of sustained high water levels in any pond is dependent on several variables, including amount of rainfall received in any rain event, soil composition, and pipe size. These limitations impact the system's ability to reduce water levels before vegetation loss occurs. This April has been the wettest on record, compounded by the effects of the July 2000 Super Storm, yielding damaging losses across the City. In particular, the exceptional rainfall from the July 2000 Super Storm event impacted countless areas of Eagan in ways that could not have been anticipated; while we regret the loss of vegetation, I am sure you would agree that this loss is preferable to additional damage to homes. I understand you are concerned that the pumps for the pond are not operated in a manner that maximizes the potential survival of your pond's natural vegetation. It is the City of Eagan's priority to use our pumps to prevent damage to public infrastructure and personal property/structures before all else. Decisions regarding pumping are constrained by the capacity of pipes leading from ponds like JP-21. For more information on how pump decisions are made, please contact our Public Works Department at 651-681-4646. I'm trying to make the area more attractive. The recent 11-inch rainfall led me to this idea: Determine how long plant life need to be under water to kill it. Then each time we get rainfall sufficient to raise the pond level significantly, turn off the pumps and kill the willow sprouts thistle, and fibrous weeds then, if you must, turn the pumps back on. Henneberger - city of eagan MEMO TO: KEN VRAA, DIRECTOR OF PARKS AND RECREATION FROM: JOHN WINGARD, DEVELOPMENT DESIGN ENGINEER DATE: JUNE 13, 1994 SUBJECT: RESEARCH TO RESPOND TO RICHARD HENNEBERGER LETTER POND JP-21 I have done some research on Pond JP-21 which is located in the Bridle Ridge 2nd Addition development in the northwest corner of Canter Glen Drive and Northview Park Road. The pond was constructed in the late 1980's with the development of the Bridle Ridge and Hills of Stonebridge developments. The pond receives runoff from a large area of Eagan and the areas that drain to the pond continue to be developed; therefore, the volume of runoff will continue to increase. The following shows.the characteristics of Pond JP-21. The direct area draining to the pond includes Stafford Place, Bridle Ridge, portions of The Hills of Stonebridge development, and Trotters Ridge. The indirect drainage areas that drain to the pond include Autumn Ridge, Coventry Pass, Country Hollow, Sunset Additions south of Diffley Road and the Hawthorne Woods development. The City's Comprehensive Storm Water Management Plan describes Pond JP-21 and the downstream receiving water body of JP-19. Attached is the text of District J on pages 69 - 72. On page 71 of the text, is a description of how the water levels in Ponds JP-19 and JP-21 will fluctuate during a major storm event. When the area contributing to Pond JP- 21 receives a one inch rainfall event, the water in Pond JP-21 can bounce as high as 10-15 feet. Then the water in the pond stays high for approximately 20 days as the lift station pumps the water out of the pond. With the large drainage area contributing to Pond JP-21 and JP-19, the water in the ponds will stay at a high level after a major rainfall event. With the water staying high in the ponds for as long as 20 days, then the vegetation around the edge of the pond will be flooded out and could die. As a point of clarification, I believe your request is different from what I (we) believed to be your request from the, City last year. Department staff involved with your request last year confirmed my perceptions. It was also their impression that you were concerned about vegetative growth around the pond; specifically, the intrusion of willows and other vegetative material. It was our impression that you wanted the hydraulic backhoe to clear the area of this vegetation. This is what we focused on then. Sorry for our part in the misunderstanding. As I understand your request now, you are suggesting that the City (along with your willingness to share in the cost) excavate the pond deeper, defining the pond's edge much more readily with the spoils of this work to be used for base material for the eventual traihway planned for this area I believe that we can separate the two issues of pond edge improvement and trail construction. Deepening of the pond and construction of the trailway need not be combined. There may be some advantage to the City in using the dredgings of this pond for trailway construction because it may have suitable soils; however, it appears that there is sufficient material on site to construct a trail regardless of when the timing of that occurs. Part of the issue, as I understand it from you, is that you are concerned about the appearance of the pond at the normal water level compared to the high water elevation. When the water recedes from storm water inundations, it leaves an unsightly appearance. You showed me a picture of the pond near Carriage Green Apartments to reflect how attractive that appeared compared to a view from your backyard looking towards the storm waterpond behind your home; infering that the Carriage Green pond was what we should strive for. I don't know that it was the City's expectation to develop the area around this and every "pond to match the appearance of the pond near Carriage Green. The Carriage Green area is a highly manicured area with a high degree of blue grass and very little pond bounce. Wandering Walk is open space with grasses that reflect this "concept and a significantly higher pond bounce. I will pursue with City staff the feasibility, desirability and cost for providing a more defined pond edge in which to contain storm water runoff with the intention to reduce the area of disturbance caused by storm water conditions. Upon receipt of the information from other departments, i will propose that we meet to review their findings. At that time, we can discuss whether we should continue to consider this a feasible project and, if so, what the next steps would be. If it is deemed that the project is significant in scope, it may be desirable to "process this through the Advisory Parks, Recreation and Natural Resource Commission and then the City CounciL If this proposed process meets with your approval, I will contact you about the meeting after I have received the information from other City departments. Mr. Henneberger's residence is located on a ridge north of Pond JP-21 over-looking the pond. He has approached the City on several occasions regarding his desire to excavate a portion of the north edge of Pond JP-21 to accommodate some visual concerns he has with the pond. After a discussion about the City policies regarding such activities, we reached the following tentative agreement: 1. The City should try to accommodate Mr. Henneberger's request the next time the City arranges for excavation of any portion of Pond JP-21 as part of normal maintenance activities, provided there are no extraordinary difficulties in doing so and the contractor is amenable. 2. It will be up to Mr. Henneberger to make arrangements with the contractor for work done at his request on Pond JP-21. Mr. Henneberger will pay for all work done by.the contractor at his request and will make arrangements for payment directly with the contractor. 3. The excavation performed at Mr. Henneberger's request as well as the associated disposal of excavated material must be approved by City staff from the Parks and Recreation Department and the Department of Public Works. I will be the staff contact for Mr. Henneberger. Please let me know if you see any significant problems with accommodating this request. If not, would you please let me know the next time you intend to conduct excavation work in this pond so I can coordinate with Mr. Henneberger and other City staff as necessary. Thanks, Wayne. Al.k. I talked to Wayne Schwartz, he said that he has no plans to go into Pond JP-21 this year to do any removal. When I asked him about it, he responded that he talked to Dick last year about this and that he was aware of his desires to deepen and widen the pond. The check for three hundred would hardly pay for the cost of mobilization of the equipment to do the work, let alone the task of pond enlargement. I do have a concern that what he envisions being accomplished is something that we believe is achievable. His comment about the bike trail is certainly misconstrued. His request was not stopped because of the bike trail. His request came in (1) after the contractor had completed the work (2) he wanted to enlarge the pond to proportions that were not achievable. I thought from our meeting in '94 that his request had been reduced in scope to something workable and something that could be managed. If he has since changed his objective, then I think l staff ( engineering, utilities, water quality and Parks ) will have some concerns. Perhaps he may have gotten confused over our comments that we could use the spoils in conjunction with the trail construction. Does this help? Last summer no one was able to see the water in the pond, just a thick coating of green scum. I talked with some utility workers who tend the pumping facility and they indicated that there was a high probability that heavy equipment would be required at the pond to get fill from erosion dug away from the intake pipe this year. There are too many involved city staff members to effectively deal with any one of them other than you. Engineering had a reasonable explanation why the pond level couldn't be raised substantially. Storm sewer employees are involved, the Water Resources staff member may also have a voice in the matter. All was going well the last time heavy equipment was at the site until the Parks director blew the whistle on my desired objective. He indicated the reason for stopping my request was that he wanted to put in a walking trail. These are the same staff members of nearly every city who spent Community Development Block Grant on "bike route" signs that tell the kids which way to ride their bicycles, and you know the Capital Improvement Budget makes no provision for this trail. The earth taken from the pond that I request to make it bigger and deeper in close proximity to my lot would, in fact, facilitate trail development by the fill taken from the pond, but I doubt that there will be city money plentiful enough to undertake such a project. You are the only one who can authorize my proposed objective, and I have enclosed a check for $300 for the work that I desire and have marked thereon that it is for extended work on JP-21. If this is in your judgment completely unreasonable you can return my check, but if not, when the intake for the pumping station necessitates equipment being on the site, all parties concerned will be advised that I am paying for the work that I desire.
