Dear Dr. Fuller:
On October 16, 1979 the Council reviewed Staff's reoaRnendation in response
to your request for the installation of a stop sign at the intersection of
the Cedarvale Shopping Center parking lot with the intersection of the
entrance road from Rahn Road. After analyzing the two suggested locations
that you sketched on your request, it was felt to be in the best interest to
install a single stop sign controlling the southbound traffic in the parking
lot. 'It is felt that to place a stop sign controlling the westbound traffic
on the entrance=ad would be confusing to those vehicles travelling within
the parking lot area. Consequently, we will be installing a temporary stop
sign in a reflectorized barrel in the parking lot area to control the South-
bound traffic. After several weeks of this installation, we will monitor
its effect to determine if a permanent installation should be handled and
also evaluating the feasibility.of installing a second stop sign.
The City appreciates the concern that you have and the letter you subsequently
submitted on September 27 regarding the need for the stop sign. Any insight
you may have as to the effectiveness of this experimental location will be
greatly appreciated. If you have any ca ments or questions regarding this
information, please feel free to contact me at your convenience.

Pavlak of the Dakota County District Court requiring the Eagan City Council to
adopt a Resolution to complete the rezoning of the Amcon property from A
(Agricultural) to RB (Roadside Business).
You will remember that the Supreme Court decision required the District Court
to order the Council to change the underlying zoning and I have prepared a
Resolution to be presented to the City Council for the change in the zoning.

EAGAN CITY COUNCIL
JUNE 1984
WHEREAS, an application was submitted by Amcon Corporation and 0. J.
Sporting Goods in September of 1981 to rezone approximately 19 acres at the
southwesterly corner of Pilot Knob Road and I-494 from A (Agricultural) to PD
(Planned Development); and
WHEREAS, in approximately April of 1982, the applicant, Amcon Corpora-
tion, and 0. J. Sporting Goods, submitted a similar application for approval
of the rezoning from A (Agricultural) to PD (Planned Development); and
WHEREAS, on March 1, 1983, the Council adopted a Resolution authorizing
the rezoning from A (Agricultural) to PD (Planned Development), subject to
certain conditions, including those conditions recommended by the City staff
in its report to the Eagan Advisory Planning Commission and City Council
concerning application for rezoning to PD (Planned Development) and that the
applicants would proceed diligently to submit applications and support
information for approval of all requirements necessary to the development of
the property and that the City would act upon all such applications
diligently in accordance with the City Code and Regulations, and other
conditions; and
WHEREAS, the applicants, Amcon Corporation and 0. J. Sporting Goods,
appealed to the Minnesota Supreme Court from the Dakota County District
Court's Order and Judgment of Dismissal dated and filed May 17, 1983 wherein
the District Court denied the applicant's motion requesting a Court Order
requiring the City Council to grant the applicant underlying RB (Roadside
Business) zoning; and
WHEREAS, the Minnesota Supreme Court determined in its decision filed
April 20, 1984 that the Dakota County District Court should issue an Order
directing the City Council to grant the applicants underlying zoning from A
(Agricultural) to RB (Roadside Business); and
WHEREAS, the Dakota County District Court by Order dated May 9, 1984
directed the City Council to adopt a Resolution necessary to rezone the
applicant's property from A (Agricultural) to underlying RB (Roadside
Business) in addition to the PD (Planned Development) zoning previously
granted;
NOW THEREFORE, upon motion duly made by and seconded by
, it was RESOLVED as follows:
1. That the Eagan City Council be and it hereby is on record
authorizing the underlying rezoning from A (Agricultural) to RB (Roadside
Business) and further ratifying the Planned Development zoning pursuant to the
conditions that were specified in the motion of the Eagan City Council at its
regular meeting on March 1, 1983, with such conditions incorporated herein by
reference, relative to the property described in Exhibit A and B attached
