At your request, this ietter will summarize our May 9, 7994 meeting regarding work
to be completed at the above referenced property. Also, Mr. Iverson had been
granfed a Conditionat Certificate of Occupancy on January 12, 1990. The City has
yet to issue a Final C.O. for this property.
The following issues must be dealt with to the City's satisfaction before the City
will issue the Final C.O. if the status of one or more of the items is in question, the
property owner must provide evidence that the issue was resolved.
1. The 1-112" force main from the south side of Century Point must be insulated.
2. The fire hydrant on the north side of the building must be raised by one foot.
3. The parktng lot wear course and striping must be completed.
4. The site landscaping must be completed per the plan provided to the City.
5. The concrete walkway from the front door to Centary Point was built without
City approval and does not ccrnnect to a City sidewalk, must be removed.

Dear Mr. Ridley,
Thank you for the opportunity to meet and speak on the phone with you
recently regarding completion items on the referenced property.
We have received and reviewed your letter of May 13, 1994, regarding
the seven (7) items which need completion. We are in the process of
completing the majority of these items, as their completion is
beneficia.l to the property and important to the new purchaser.
However, we question Items 1 and 2 on your letter and the
appropriateness of these items being included in a list of
requirements for an individual lot owner. It appears to us that both
of these items are developer rather than lot owner items. Comments on
each item to foilow.
Item 1
Regarding the 1 1/2" force main. We have visited with the developers
of this property, namely Donald Klober and Tom Klecatsky. We have
also reviewed the Development Contract dated June 5, 1989, governing
this project, executed by the developers and the City. We have also
personally inspected the North end of the referenced line to determine
what the particular objections might be.
In discussing the development with the developer, they stated that
this line was installed by them in accordance with plan specifications
and City inspections approximately ten (10) years ago when the
development was completed. In review of the development contract, it

is quite clear that the City has had ample opportunity to call default
on the developer in accordance with paragraph 5 of the agreement and
also has had opportunity to withhold escrow funds and/or demand
additional funds if work were not completed. It should also be noted
that paragraph 6E or the referenced contract covers inspection and
City acceptance. Upon completion of inspections, which were done many
years ago, the lines became the property of the City in accordance
with the contract, a portion of which reads as follows: "Upon
compliance with such ordinance standards and approved specifications,
the City improvement shall become the property of the City". Since
the line in question is City property, and easements have been
provided to the City for its maintenance and upkeep, we question the
City's attempt after ten (10) years to make any purported deficiencies
in the construction the responsibility of a subsequent land owner not
involved in the development itself. Also, our inspection indicates
that the line in question enters the manhole at the same level as does
the line from the building on our property, as well as the exit line
into the balance of the sewer system. Since all three lines entering
or exiting from that particular manhole are at the same level, we
frankly do not comprehend the concern about insulation of just one of
those three lines.
Item 2
In visiting with the developer, we were informed that the fire hydrant
in question was not a part of the development agreement entered into
between the City and the Klober development group. It actually
provided service to the development North of this project before
Century Addition was completed and was probably therefore a part of
that development. Again, since this is a City owned fire hydrant,
serving the property adjacent North of our property, we question why
its adjustment and change should be the responsibility of us, a
non-developer, on an adjacent development.
As mentioned above, we are proceeding with completion of items 3
through 7 in the referenced letter, For reasons noted above, we do
not feel that items 1 and 2 are relevant to use of Lot 3, Block 1, nor
are they our responsibility if any problems exist. We also believe
that if any problems really do exist, they are the responsibility of
the City, which owns the utility lines.
Therefore, we respectively request that these
from your completion checklist and that we be
deletion within the next 15 days, so that we

As a follow up to our discussions and letters over the past several months this letter may provide
some closure to the various issues surrounding The Dive 5hop located at 1571 Century Point in
Eagan.
I understand that except for insulating the 1-1/2" force main from the south of Century Point and
raising the fire hydrant, all of the issues listed in my May 13, 1994 correspondence have been
addressed. The force main issue was reviewed thoroughly by the City's Public Works Division
and it was determined that this main is a private line not to be maintained by the public;
therefore, whether or not this line is insulated is a decision left up to the property owner.
Your letter dated July 1, 1994, authorized the City to preform the work involved with raising the
fire hydrant and provided an agreement on your part to reimburse the City for these costs (subject
to a cap of $400.00). This work was completed on July 20, 1994. I have enclosed a copy of the
work order and associated documents for your review. Your prompt submittal of a check made
out to the City of Eagan for the amount of $373.10 will be appreciated.
I appreciate the Credit Union's assistance in resolving the issues involved with this property and
look forward to the business being a success. If I can be of further service please do not hesitate

APPLICATION: An application has been submitted by Jonathon R.
Iverson requesting a 15 foot variance to the rear parking setback
and a 12 foot variance to the rear yard setback for Lot 3, Block
1, Century Addition.
COMMENTS: 'i`he purpose of this variance is to allow the proposed
Sport Scuba Diving Center to be located 18 feet from the north
property line and the proposed parking lot be located 5 feet from
the north lot line. The nortli property line abuts Fox Ridge
Apartments, thus requiring a minimum setback of 30 feet from the
building and 20 feet from the parking lot.
The dimensions of this lot severely limit the building design and
placement. The setbacks created by the adjacent residential
parcel further enhance this unique hardship.
The proposed development meets or exceeds all other building
setbacks and requirements. Approximately two-thirds of the
building is set back 40.feet from the south property line
(Century Point Road) adding a large portion of landscaped area to
the front of the building which is highly visible from Coachman
and Yankee Doodle Roads.
City watermain exists 5' north of the north line of Lot 3 and 5'
east of the west line ot Lot 3. Appropriate easement dedication
has been made to protect these lines. The proposed building
location does not encroach within the dedicated easements.
With the constraints innate to this parcel, strict adherence to
the City code setback requirements make development of Lot 3,
Block 1, Century Point Addition impractical at best.

On 9/27/90 at 3:30 p.m. I sat in on a meeting with Stan Lexvold,
John Wingard, and Jonathan R. Iverson.
Mr. Iverson stated his purchase agreement for the adjoining
property would be completed by this weekend. He pointed out that
he is not responsible for extension of water and sanitary sewer
service to the westerly adjacent parcel. He is going to explore
the insulation of the 1-1/2" force main north of Century Point and
the fire hydrant height.
This fall, he intends to provide a curb cut and a mix of bituminous
and concrete curb around all sides of the parking area except the
east. He will approach the City Council for a deviation from the
approved plans regarding the eastern curb and a stretch of
sidewalk. He does not want to lay blacktop because he wants to
have the parking area "heave" through one more frost and thaw.
I told him the City will proceed with leqal action until the
parking area is improved to current City standards.

Dear Mr. Iverson:
Per your inquiry yesterday, the following exit doors shall not he
provided with a latch or lock unless it is panic hardware: 101A,
200B, 208A, 209B, and 209D.
A key locking device may be used in place of panic hardware on main
exit door 200A, provided there is a readily visible, durable sign
adjacent to the doorway statinq THZS DOOR MUST REMAIN iTNLOCRED
DIIRINO BOSINE88 80IIRS. The sign shall be in letters not less than
one inch high on a contrasting background. When unlocked, both
leaves of the pair of doors must be free to swing without operation
of any latching device. When the pair of doors is installed, one
leaf shall have no locking devices whatsoever, and the second leaf
shall be arranged to latch or lock into the frame and into the
first leaf in such a manner that a sinqle unlocking action will
unlock both leaves simultaneously. Flush, edge, or surface bolts
or any other type of device that may be used to close or restrain
the door other than by operation of the locking device are
prohibited. The use of this exception may be revoked by the
building official for due cause.
