The following is a review of what appear to be applicable ordinance provisions. 1. Section 10.12 under the public protection section of the Eagan Code dealing with animals and fowl, Keeping, Transporting, Treatment and Housing. Honeybees are included within the definition and its subdivisions do provide that it is unlawful to keep any animal, which includes honeybees, except in agriculturally zoned areas and containing no less than five acres with certain exceptions. However, the exceptions do not apply to the facts that have been presented to me. 2. Under the land use zoning regulation 11.40, the enforcing officer of the City may enter on land to determine whether the land is being used under the zoning restriction. It is my understanding that the person who is keeping the bees is living in an R-l ate which does not appear to allow under permitted uses the keeping of honeybees. 3. Under Section 11.40, Subdivision 3, Variances, the Council may grant variances from the strict application of the Code and impose conditions and safeguards where practical difficulties or particular hardships result from carrying out the strict letter of the regulations. This would mean that an application should be submitted to the City and the Advisory Planning Commission and Council would then review whether practical difficulties or hardsh result and should then follow the criteria laid out in paragraph 4 of u divi ion 3B. The Eagan City Code, Chapter 10, deals with the storage and disposal of refuse and the parking of recreational vehicles. The existing code does not address the long-term storage of any recreational vehicles in single family districts other than that they must be at least 15' from any improved roadway (which Beam Lane would be considered). While the situation is visually unappealing, the City has no ability to require any change to the existing condition. The City Code has a definition for "Other Refuse". Included in that definition are: trees, tree branches, and wood except where stored as firewood. In single family zoning districts, it is unlawful for any person to store refuse for more than one week. As a result, the City has sent a letter informing the property owner of the City Code requirements. Planning staff will continue to monitor this situation and enforcement of the Code.
