drainage and utility easements lying over and across the following

recorded plat thereof, Dakota County, Minnesota, described as
follows:
Commencing at the southeast corner of said Lot 9; thence North 35
degrees 54 minutes 57 seconds West a distance of 100 feet to the
point of beginning of the land to be described; thence South 54
degrees 05 minutes 03 seconds West, a distance of 3 feet; thence
North 35 degrees 54 minutes 57 seconds West parallel to the
easterly property line of said Lot 9, a distance of 20 feet;

CITY OF EAGAN
WHEREAS, a regular meeting of the City Council of the City of
Eagan, Dakota County, Minnesota, was held on the 17th day of
November, 1992, at 7:00 o'clock p.m. at the City Hall located at 3830
Pilot Knob Road, Eaqan, Plinnesaca; all members being p'resent; and
WHEREAS, pursuant to M.S.A. Section 412.851, the Mayor convened
the public hearing to consider the proposed vacation of certain
drainage and utility easements lying over and across the following
described property:
That part of Lot 9, Block 1, Chatterton Ponds, according to the
recorded plat thereof, Dakota County, Minnesota, described as
follows:
Commencing at the southeast corner of said Lot 9; thence North 35
degrees 54 minutes 57 seconds West a distance of 100 feet to the
point of beginning of the land to be described; thence South 54
degrees 05 minutes 03 seconds West, a distance of 3 feet; thence
North 35 degrees 54 minutes 57 seconds West parallel to the
easterly property line of said Lot 9, a distance of 20 feet;

WHEREAS, the Council at a regular meeting on the 20th day of
October, 1992, accepted a petition to vacate said drainage and
utility easements pursuant to a petition of the landowner and
scheduled a public hearing on the vacation for the 17th day of
November, 1992, at 7:00 o'clock p.m. at the City Hall; and
WHEREAS, an Affidavit of Publication of notice of hearing in the
Dakota County Tribune, dated October 29 and November 5, 1992,
relative to the proposed vacation was submitted; and
WHEREAS, said Notice of Hearing was posted at the City Hall on
the 23rd day of October, 1992; and
WHEREAS, there appearing no objections to said vacation and the
Council desiring to vacate said drainage and utility easemerts; and
WHEREAS, it having been determined that other than petitioner,
there are no other parties, including public utility companies,
having an interest in said drainage and utility easements, and it
appearing that it is in the public interest to vacate such easements,
and there beinq no objections;
NOW THEREFORE, upon motion by Councilmember Pawlenty, seconded by
Councilmember Wachter, all members voting yes, it was RESOLVED that
the certain drainage and utility easements lying over and across the
following described property is hereby vacated:
That part of Lot 9, Block 1, Chatterton Ponds, according to the
recorded plut thereof, Dakota County, Minnesota, described as
follows:
Commencing at the southeast corner of said Lot 9; thence North 35

Dear Property Owner:
Recently, you may have read an article in the local Eagan Chronicle
expressing the City's concern over the dike/dam that is constructed
around the pond outlet located between Lots 11 and 12 on the
eastern end of the pond. Further research into this matter has
ihdicated that the construction of this outlet restriction was
per£ormed at the time of the City approved dredging of the pond by
the developer and adjacent homeowners during the spring of 1989.
Therefore, before the City would proceed with any adjustment to the
present situation, we will reevaluate the hydrologic and hydraulic
design of the storm sewer system to determine if this restricting
outlet structure would have to be removed. If, as a result of this
additional evaluation, it is determined that its removal or
modification is required, a written notice will be sent to the
attached mailing list so informing them of the proposed action and
the reasons for it.
If, however, the results of this additional evaluation determines
that no adjustment is necessary, there will be no action taken by
the City.
Therefore, please be assured that the City will fully reevaluate
the situation and in£orm all affected property owners if there are
any changes proposed.
