Plat covenants governing residentz.al home construction in Oslund's Timberline
Addition establish certain setback reguirements. The protective covenaats
also provide that, before co-mmencing construction, the homeowner must have his
plans and specifications approved in writing by Timberline Incorporated. Such
approval coveiS, among other things:
l. Setback requirements
2. Placement of house on lot
3. Harmony with existing structures
Note: See copy of plat restrictions.
The owner whose home adjoins my property on the north failed to obtain the
required approvals. As a result, two violations of the protective covenants
occurred:
1. 14 foot setback violation at the rear property line.(protective
covenants require 40 foot setback but actual setback is only 26 ft.)
2. Placement of house on lot at wrong angle and not in harmony with
existing structures.

When I notified Timberline Incorporated of the violation, I was told that the
plans and specifications has not been approved. However, Timberline Incorpor-
ated did not require correction of the violations, probably because actual
constructionihad already commenced. '
In the opinion of everyone with whom I have discussed this matter, there is
general agreeaent that this is a severe setback violation (14 feet) and not
just the usual type of 6 inch of 1 foot violation that seems to occur with
some regularity. Everyone also agrges that the setback violation coupled with
the inharmonious placement ;of the house on the lot adversely affects my proper-
ty. The adjoining property on the other side of the property with the violation
is benefitted by additional space and by having a front view.
In informal discussions with the County Assessor, I was advised that, in order
to obtain a reduction in value af my property for tax purposes, I would have to
take legal action against the owner of the adjoining property and/or Timberline
Incorporated, and have a court of law make a precise determination of damages
in order to establish the exact amount of the decline in value of my property.
I have discussed this matter with legal counsel and have been advised that the cost
to litigate this matter (legal fees, court costs, real estate appraisal fees, etc)
probably would be prohibitive for this size claim. Legal counsel advised me that
a person usually would have to be seeking damages of at least 25% in value of the
property in order to justify the cost of litigation.

It doesn't seem to me that, just because it may be too costly for me to pursue
this matter in a court of law and obtain monetary damages, I should be prohibited
from obtaining a reduction in my assessed valuation for property tax purposes.
A court award of damages and a reduction in assessed value are not alternative
remedies. Both are availabie to me should I choose to pursue them. Accordingly,
I,shouldn't he precluded from obtaining benefit of one remedy just because the
other remedy may be too costly to pursue.
Wizen the deputy assessors came through my house this la.st year for purpose of
reassessment, they listed individually each unusual item and each exeraordinary
feature which, in their opinion, added additional value to my house over and
above a general value based on size of the house, type of construction, etc.
Tha tangible items which they listed included a drin!?:ing fountain, a circular
stairway, and similar items. If extraordinary items and features which tend to
increase property value are taken into account, equity requires that extraordinary
items which result in a loss in value also should be taken in account.
I certainly agree that the measurement of loss of value in the present circumstance

Use of estimates is inherent in the appraisal and assessment process. Simelar
situations are faced daily by assessors and appraisers, and are resolved by using
the best information available without having to resort to a court of law, forced
sale.of the property, etc. in order to establish an exact amount of loss in value.
I am a concerned citizen and taxpayer of Eagan Township and Dakota County. I'm
interested in paying my fair share of property taxes, based on a proper valuation
and an equitable assessment. Accordingly, I respectfully request that the valuation
of my property for tax purposes be_reduced by a deprecation factor of 10%, which is
considered to be the minimum loss in value to my property and the amount by whict.
I would have to discount my property for a salei at this time.
