The application of Wesley Medin for waiver of plat in order to split a
2.3 acre parcel into two single family lots at 1325 Carriage Hills Drive was
next discussed by the Council. Mr. & Mrs. Medin were present and the APC
recommended approval subject to certain conditions. Egan moved, Thomas sec-
onded the motion to approve the application, with the understanding that the
application will comply with zoning, water and sanitary sewer requirements of
the City as follows:
1. No variances shall be granted for the newly created lot.
2. Drainage and utility easements shall be required along all lot
lines.
3• Any assessments on either of the newly created lots shall be handled
separately. Presently there are no assessments on either lot.

COACHMAN OAKS APARTMENT - AMUSEMENT DEVICE APPLICATION
An application from the owners of the Coachman Oaks Apartments for a
permit for 3 game machines in the Coachman Oaks Apartment complex was then
discussed by Council members. There were concerns about compliance with the
ordinance provisions concerning hours of.use. Egan moved, Smith seconded the
motion to continue the application for further study and report to the -ra
Council. All voted yea.
PROJECT #353 - TRUNK HIGHWAY 55 UTILITY REVISIONS & SIGNALS
Mr. Colbert reviewed with the Council the Feasibility Report for Improve-
ment Project #353 covering utility revisions and signals on Trunk Highway 455
due to the construction of I-494. Several revisions to the existing utilities
within State right of way are required which will be at City's cost. The
costs will be funded from trunk utility and major street funds and therefore
there will be no assessments associated with the project. Sanitary sewer,
water main, storm sewer and traffic signals will be involved and it was noted
that certain other changes result from the potential need to replace some
water mains and relocation of certain utility lines. Smith moved, Wachter
seconded the motion to receive and approve the Feasibility Report and to
authorize the preparation of a Cost Participation Agreement with the Minnesota
Department of Transportation. All voted in favor.

For its Notice of Appeal, Richard N. & June R. Nelson (hereinafter "Landowner'), states
and alleges as follows:
1) This appeal is brought pursuant to Minnesota Statute Section 429.081 to appeal the
assessments affecting Landowner's property adopted by the Defendant, the City of
Eagan (hereinafter "City's on April 21, 2009.
2) Landowner owns property located a 1319 Carriage Hills Drive, Eagan, Dakota
County, State of Minnesota, 55123 which is the subject matter of this appeal. The
identification of Landowner's property is PIN No. 10-03400-032-53. The amount of
assessments set forth in the notice of assessments sent to the Landowner by the
City against said property is $4940.58, which is attached hereto as Exhibit A and is
incorporated herein by reference.
3) The City's assessments that are the subject of this proceeding are for the proposed
improvement of Project 905R.
4) Within the time limited by law, Landowner filed a written notice of objection to the
proposed assessments in accordance with the requirements of Minnesota Statute
Section 429-031(1), which is attached hereto as Exhibit B and is incorporated herein
by reference.
5) The action of the City in adopting the assessments is contrary to law for the
following reasons:
A) With regards to the construction of Project 905R, landowner believes that it
received no special benefit equal to or greater than the amount of the
assessment;
B) The City failed to comply with the provisions of Minnesota Statute Section 429,
as amended;
C) The criteria and method used to determine the assessments upon said property
are not proper for the imposition of assessments, are not in accord with
constitutional, statutory or municipal assessment policy requirements and are,
therefore, arbitrary and capricious and thus, deprive the property owner of
property without due process of law, contrary to the requirements of the United
States and Minnesota Constitutions;
D) The improvements in Project 905R are excessive in scope and are designated to
favor other landowners who are not being similarly assessed;
E) The assessments as adopted by the Eagan City Council are contrary to and in
violation of Landowner's substantive and procedural rights and the following
constitutional, statutory and ordinance provisions:
i) United States Constitution, Amendment V;
ii) United States Constitution, Amendment XIV;
iii) Minnesota Constitution, Article 1, Section 7;
iv) Minnesota Statute Section 429.01, et seq.; and
v) City of Eagan Ordinance, Resolutions, and Policies regarding Assessments.
WHEREFORE, Plaintiff/Landowner, Richard N. & June R. Nelson, prays for judgment of
the Court and against Defendant City of Eagan as follows:
1) That the assessments for Improvements be set aside.
2) That the Landowner be awarded its costs and disbursements, including reasonable
attorney fees pursuant to Minnesota Statute Section 549.211 and Minnesota Statute
Sections 15.471-.4753
3) Awarding such other and further relief as the Court deems just and equitable,

A special assessment of $4,940.58 has been proposed to be levied on our property.
This assessement relates to the Lebanon Hills Regional Park / Long Acres Storm Sewer
Improvements - Project 905R.
We oppose this assessment of $4,940.58 on the basis that we are not involved in this
project in any way. Our property would NEVER have any run off water leave our yard,
as the contour of our property allows all water to either soak in the ground or pond in
the low spots. We would not benefit by this assessment in any way. "Assessments
may not exceed benefits". Quoting from Minnesota Statues 2008, Chapter 103D,
Section 901, Subd.4:
An assessment may not be levied against property or corporations benefited
under this chapter in excess of the amount of benefits received as set by the
order of the managers authorizing the or implementation of the project or
subsequently determined on appeal.
This property does not benefit from this project in any way so therefore it does not
qualify for any assessment.

considering the possibility of reaching a settlement to the current litigation.
As you recall, we discussed the possibility of deferring 50% of the assessment for up to
20 years with 6% simple interest added at the end of each year (i.e. the interest would
