VAN OVERBEKE Proposed Lot Split (Timothy Pond Property) Gry Clerk Deaz Gary: On Apri120, you forwazded a letter to the City of Eagan informing us of a contact made by Mr. and Mrs. Pond with the Plat Commission to discuss the possibility of obtaining a driveway pemut from Diffley Road (County Road 30) to the above-referenced pazcel. Our information also reflects that a restricted access has been dedicated to Dakota County across the frontage of this parcel and that no driveway pernut would be granted for access to County Road 30. Your letter went on to state that it was the Plat Commission's feeling that this lot should not have been allowed to be split without access to Augusta Court. On April 5, 1988, the City approved a Waiver of Plat creating this particulaz parcel with a condition that states "no additional building pernuts will be allowed on the newly created pazcel for residential homes and single tax pazcels will be created for each of the three affected lots". This Waiver of Plat was a result of adjacent property owners requesting to acquire additional land to maintain the azea as woods and provide a buffer for their existing homes. City minutes reflect their intent was not to build or develop this newly created pazcel. With the restricted access dedicated to Dakota County along Diffley Road and the condition that this parcel would not be developed, the City did not have any objections to the lot split and Waiver of Plat pmcess. In addition, due to the intent expressed by the property owners, there did not appeaz to be any need to provide access to Augttsta Court. I just thought that this background information would be helpful in your understanding of how the lot split came to be and to assure you that the City similazly does not support the development of this parcel with any access to County Road 30.
