topography through grading, filling and/or excavating approximately 6 acres of the above-
referenced parcel located within 350' of your property.
This activity is not associated with any proposed development at the present time, but, rather,
only deals with the removal and/or deposit of clean fill material. If there is any subsequent
development proposaUapplication, you will be informed through a formal mailed notice.

The above referenced property, (hereinafter "Premises") is currently zoned LB, Limited Business, and
has a land use designation in the City's Comprehensive Guide Plan of GB, General Business. The flood
zone designation for the Premises is Zone C, panel number 270103-0002-B, dated August ll, 1978.
The Premises is currently vacant. The intended use of the Premises as an apartment or townhome
complex having a density of approximately eight units per acre and including related facilities is not
consistent with or allowed under the current land use and zoning designations of the Premises. Before a
residential development as presented in your concept plan could proceed, the City's Comprehensive
Guide Plan would need to be amended from GB to DIII (Residential Multiple, 6-12 units/acre), and
rezoned from LB to either R-3 (Residential Townhome) or PD (Planned Development).
Enclosed is a brochure outlining the City's development review process and expected timelines for
various types of applications. Requests forboth Comprehensive Guide Plan Amendments and Rezonings
go through a public heazing process before the Advisory Planning Commission, with the final decision
made by the City Council. You may also wish to replat the property or combine the existing lots.
For multiple family residential developments, the City's Zoning Code requires that at least one enclosed
parking stall which is attached to the principal building, and one other pazking stall be provided.
Required building setbacks and height depend on the zoning classification, which may be either R-3 or
PD. In general, a maximum building height of three stories, a 30 foot build'tng setback around the
perimeter of the site and between buildings, and 50 foot building setback from a major thoroughfare are
required. However, deviations from these requirements may-be. approved as paR of a Planned

M application was submitted by Coca Cola Bottling Midcrest for varianee
under Ordinance No. 16 to allow Coca Cola logo and name'to be painted on the
east wall of the Coca Cola building located in Eagandale Center Industrial
Park S1. The Planner's report was reviewed noting that normally the Ordinance
requires raised lettering but that painting of tha logo appeared to be appro-
priate noting the extremely long building side. Maintenance of the sign was
discussed and two representatives from the Arenitectural :irm of Setter, Leach
& Lindstrom, Inc. were present and explained the proposal. Wachter moved,
Egan seconded the motion to approve the application for variance sub,ject to
the following:
1. That an annual maintenance program be agreed Lo by Coca Cola, set
forth by the City Council.
2. That iP the identification becomes unattraetine according to the
determination oP the City, Coca Cola will agree to remove the sign or conPorm
with Ordinance No. 16 regarding raised lettering.
All voted yes. Further, that there be an annual renewal for the permit
for the sign.

An application of Naegele Outdoor Advertising Co. for special permit for
advertising sign to be located in Cedar Ridge Second Addition was then dis-
cussed hy the Council. A representative oP Naegele was present and explained
the proposal, indicating that 10$ of the time the bi116oard would be used for
public purposes. It was noted by Mr. Colbert that there are zrosion problems
on the site owned by Barton Contracting Co. and that the developer has not, at
the present Lime, corrected the erosion problems. Mr. Colhert was direeted to
continue to attempt to acquire compliance by the owner of the property to
improve the erosion issue. Smith moved, Thomas seconded the motion to approve
the advertising sign as applied Por, subjeet to compliance with the applicable
ordinance. Those in favor were Smith, Thomas and Egan. Those against were
Wachter and Blomquist.
