The flood zone designation for the Premises is Zone C, panel number 270103-0002-B, dated August ll, 1978. The Premises is currently vacant. The intended use of the Premises as an apartment or townhome complex having a density of approximately eight units per acre and including related facilities is not consistent with or allowed under the current land use and zoning designations of the Premises. Before a residential development as presented in your concept plan could proceed, the City's Comprehensive Guide Plan would need to be amended from GB to DIII (Residential Multiple, 6-12 units/acre), and rezoned from LB to either R-3 (Residential Townhome) or PD (Planned Development). Enclosed is a brochure outlining the City's development review process and expected timelines for various types of applications. Requests forboth Comprehensive Guide Plan Amendments and Rezonings go through a public heazing process before the Advisory Planning Commission, with the final decision made by the City Council. For multiple family residential developments, the City's Zoning Code requires that at least one enclosed parking stall which is attached to the principal building, and one other pazking stall be provided. Required building setbacks and height depend on the zoning classification, which may be either R-3 or PD. In general, a maximum building height of three stories, a 30 foot build'tng setback around the perimeter of the site and between buildings, and 50 foot building setback from a major thoroughfare are required. A representative oP Naegele was present and explained the proposal, indicating that 10$ of the time the bi116oard would be used for public purposes. It was noted by Mr. Colbert that there are zrosion problems on the site owned by Barton Contracting Co. and that the developer has not, at the present Lime, corrected the erosion problems. Mr. Colhert was direeted to continue to attempt to acquire compliance by the owner of the property to improve the erosion issue. Smith moved, Thomas seconded the motion to approve the advertising sign as applied Por, subjeet to compliance with the applicable ordinance. Those in favor were Smith, Thomas and Egan.
