issued, or, (9) animals kept in a laboratory for scientific
or experimental purposes, or, (5) animals kept in an animal
hospital or clinic for treatment by a licensed veterinarian.
Subd. 3. Animals in Transit. It is unlawful for
any person to txansport animals unless they are (1) confined
within a vehicle, cage or other means of conveyance, or, (2)
Earm animals being transpoeted in a portion of the City
zoned Agricultural, o=, (3) restrained by means of bridles,
halters, ropes or other means of individual restraint.
Subd, 4. Treatment. It is unlawful for any
person to treat any animal as herein defined, or any other
animal, in a cruel or inhumane manner.
Subd. 5. Housing. It is unlawful for any person
to keep any animal as herein defined, or any other animal,
in any structure infested by rodents, vermin, flies or
insects, or inadequate foc pcotection against the elements.
Subd. 6. Trespasses. It is unlawful for any
person to herd, drive or ride any animal over and upon any
grass, turf, boulevard, City park, cemetery, ga[den or lot
without specific pecmission therefor Erom the owner.

SEC.10.13. TRAPPING PROHIBITED - E%CEPTIONS.
Subd. 1. Definitions. The following terms, as
used in this Section, shall have the meanings stated:
A. "Trap" - Any device, snare, artificial
light, net, bird line, ferret, hawk, vehicle or contrivance
whatever used to catch, snare, kill, or otherwise cestrain-
the fxee movement of animals or birds.
B. "Trapping" - The act of setting, laying
or possession with intent to set or lay a trap.
Subd. 2, Unlawful Act. It is unlawful foc any
pecson to do any trapping.
Subd. 3. Exceptions. This Section shall not
apply to:
A. Owners of platted lots of five acres or
more, and then only if it is done by the owner, a member of
the owner's family, or hy written consent of the owner;
provided, that such trapping is not done upon or within 100
feet of the boundary of the any City, County or State park,
or9anized recreational area, or other pu6lic property.

B. Quick-kill tcapping if the tcaps ace
designed to kill only cats, mice, gophers or moles.
C. Employees or duly authorized
repcesentatives of the City, County, State or Federal
government acting within the course and scope of their
employment.
D. Teachers trapping fo= educational
pcograms or scientists for the purpose of studying animals,
wild life or birds, which will be returned to theic natural
environment uninjured.

however, it is expected that a request from that agency will
be made to allow an open season for deer hunting within the
City of Eagan sometime this fall. Please watch the agenda for

l. We bill Mr. Marshall for the current quarter consisting
of the months of July, August and September, 1984, based
on a June 22, 1984, reading of 832100 and a September 24,
1984, reading of 918200. This is a consumption of approximately
86,000 gallons and generates a water bill of $60.34. This,
combined with the current sewer bill of $17.10, gives a
total quarterly bill of $77.44.
2. We bill Mr. Marshall for the previous four guar?ers ending
June, 1984, March, 1984, December, 1983, and September,
1983, on the basis of the average monthly useage for the
period from the meter turn in the quarter ending June 30,
1982, through the good reading at June 22, 1984, of 832,100.
That computation is as follows:

3. The current quarterly amount be paid presently and the balance
($189.44) be paid in whatever installments is agreeable
to Mr. Marshall in a time period not to exceed one year.
In summary, the City would then have reduced the total bill
by $181.11 from $447.99 to $266.88. The total reduction is
based only on a change to water billed. The City is also absorbing
all costs related to the underbilling of sewer costs. At a

winter quarter water useage of 40,000 (compared to a current
quarter useage of 86,000 and an eight-quarter average of 103,750)
this sewage undercharge amounts to $208.00 at $26.00 per quarter
for the eight quarters.
Mr. Marshall should be advised that his utility bill will rise
substantially as actual consumption is used to determine the
bill. This will be compounded dramatically as soon as the minimum
is no longer used to calculate the sewer charge.
I make this recommendation based on the fact that the City should
have concluded earlier that there was a problem with the meter
readings as well as on the fact that regulated utilities are
generally limited to a one-year recovery period. I would say
that each of these cases will have to be reviewed as they arise
and that this action should not be viewed as a policy.
