W I T N E S S E T H:
That the Landowners, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, do hereby grant and
convey unto the City, its successors and assigns, a permanent 20.00
foot drainage and utility easement, over, across and under the
following described premises, situated within Dakota County,
Minnesota, to-wit:
That part of Lot 32, Block 2, Lakeside Estates,
according to the recorded plat thereof, with a
centerline commencing at the northwesterly corner
of Lot 32, thence N 44° 561 . 33" E, aiong the
southerly R/W line of Atlantic Hills Drive 2.64
feet; thence northeasterly along said R/W line
along a tangential curve concave to the southeast,
having a radius of 211.08 feet and a central angle
of 45° 03' 27" a distance of 165.99 feet; thence
East along said R/W line, 65.69 feet to the point
of beginning; thence S 220 30' 00" E a distance of
75.00 feet to the NOHW line, elevation 907.70 of
Hay Lake and there terminating. The sidelines of
said easement shall be prolonged or shortened to
begin at the said R/W line and shall terminate at
points perpendicular to the centerline.
See also Exhibit "A" attached hereto and incorporated herein.
The grant of the foregoing permanent easement for drainage and
utility purposes includes the right of the City, its contractors,
agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes,
conduits and mains; and the further right to remove trees, brush,
undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore
the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of
trees, brush, undergrowth and other obstructions.
And the Landowners, their heirs and assiqns, do covenant with the
City, its successors and assigns, that they are the Landowners of the
premises aforesaid and have good right to grant and convey the
easement herein to the City.

At approximately 3:15 p.m. on November 18, 1992, I met with Sandy and Richard Bertz
concerning the City's plan indicating the buildable area for another home site on Lot 32.
Their first choice is to build a home which is larger than the area which is now considered
buildable without a variance. I indicated to them that they should meet with the
appropriate staff in planning and engineering to see what staff would support and try to
get a feeling for the costs involved.
I aiso indicated that the variance would have to be approved by the City Councii.

This Amendment to Drainage and Utility Easement ("the Amendment")
is made to that certain Drainage and Utility Easement dated August
11, 1993, recorded in the office of the Dakota County Recorder on
August 25, 1993, as Document No. 1146460 and which was entered into
by and between Richard A. Bertz and Sandra Bertz, husband and wife
("Landowners") and the City of Eagan, a Minnesota municipal
corporation ("City"), and which Drainage and Utility Easement is
hereinafter referred to as the "Easement". A copy of the Easement is
marked Exhibit "A" and attached hereto.

STORM SEWER OUTFALL RELOCATION
As you are aware, the storm sewer that drains the low point on the east end of
Atlantic Hills Drive southerly to Hay Lake transverses the above-referenced lot.
Research cannot locate an easement incorporating this existing storm sewer
alignment. This property is owned by Mr. Rick Bertz, 550 Atlantic Hills Drive,
452-5062.
Earlier this year, Mr. Bertz contacted me regarding his desire to subdivide and
split this residential lot into two buildable parcels. Subsequently, the
existing storm sewer will have to be relocated to the future common lot line
where a proper utility easement will be dedicated with the lot split.
Due to the discrepancies in our asbuilt record plans, I recall you having your
engineering personnel do some field work to properly locate the existing storm
sewer facility.
On May 21, I met with Mr. Bertz in the field to review the existing alignment and
his proposed lot split. He's proposing to create a new lot line 30' east of and
parallel with the east side of his existing house. Alternatives for the
realignment of this storm sewer seem to indicate it may be best to move it to
this new property line. This would involve transplanting the existing small
apple tree and removal and reinstallation of the chain link security fence along
this new property line.
Due to the fact that the City has not acquired an easement for this public storm
sewer system, the relocation costs will be the responsibility of the City in
exchange for dedication of a utility easement over its new location.
After my May 21 meeting, I reviewed this information with you and requested your
department to prepare a preliminary plan and profile of this new construction
along with a cost estimate and schedule that can be presented to the property
owner.
On July 7, I was contacted by Mr. Bertz inquiring as to the status of this work.
Due to your vacation absence, I was unable to provide him with this information.
Therefore, I would appreciate it if you personally contact him to reestablish
communications as necessary to ensure that this work is done within a time frame
compatible with his proposed subdivision.
Please keep me informed as to your progress so that I can be assured that this
problem is being properly attended to.

WHEREAS, a regular meeting of the City Council of the City of
Eagan, Dakota County, Minnesota, was held on the 5th day of
October, 1993, at 7:00 o'clock p.m. at the City Hall located at
3830 Pilot Knob Road, Eagan, Minnesota; all members being present;

WHEREAS, pursuant to M.S.A. Section 412.851, the Mayor
convened the public hearing to cnnsider the proposed vacation of a

brought to my attention that on September 20, 1975, Tommy R. Waite, a
single person, conveyed by warranty deed the following described
property to Richard A. Bertz and Sandra L. Bertz:

according to the plat thereof-on`file and-of record-"in the
office of the Reqister of Deeds within and for said County and
State.
In conjunction with the conveyance described above, the
following wording was included on the warranty deed:

said easement described as follows: Commencing at the
northwest corner of said Lot Thirty-two (32); thence north 44

The Ciry has received the bids from the corrtractors and the bW amourrts were favorable. Therefore, on July
20, 1993, the City Council authorized the award of City Project No. 93-RA&7 to Imperial Developers. The
Cfty has sent the corrtracts to the corrtractor for signatures. We aMicipate that neid week the Ciry will
conduct a preconstruction meeting wRh the contrector and at this meeting, the contractor wAI give us a
schedule showing when he plans to construct thfs project.
Attached is a cost estimate covering the construction af a sanitary sewer and water seMce to the new lot
on the east half of Lot 32, Block 2, of lakeside Estates. The cost est(mate Indudes untt prices irom Imperial
Developers' bids. The quantfties are estimated so the flnal cost mfgM change to reflect a veriation in the

7he Cfty has receNed the bids from the contrectors and the bid amourrts were favorable. Therefore, on July
20, 1993, the City Council authorized the award of Ciry Project No. 93-RAS-7 to Imperial Developers. The
City has sent the contracts to the contractor for signetures. We anticipate that ne)R week the City will
conduct a preconstruction meetfng wRh the contractor and at this meetfng, the coMractw wfll give us a
schedule showing when he plans to construct this project.
Attached is a cost estimate covering the construction of a sanf[ary sewer and water service to the new lot
on the east half of Lot 32, Block 2, of Lakeside Estates. The cost estimate includes unh prices from Imper(al
Developers' bids. The quantities are estimated so the final cost might change to refiect a variation in the
quantfties.
7he City would like you to sign this letter and retum a cropy to us. Your signature wtll be your authorizatfon
to us that we will direct the contractor to construct the sewer and water service to the new lot. The City will
send you a blll reflecting the finai costs after the work Is compiete. The City is also sending a letter to Rick

I received a telephone call from Rick Bertz and he indicated that if the City Council
approves his lot split (Waiver of Plat) that he would be putting the newly created lot up
for sale immediately after City Council approval.
He also is concerned about the City's schedule for relocating the storm sewer if a buyer
is interested in building right away that the storm sewer would not be a problem.
I feel we should get back to him with some type of schedule for the storm sewer
relocation.

Rick and Sandy Bertz have asked that Z help them with the removal of
a storm sewer easement across their property in Lakeside Estates
Addition. I helieve that one o£ the lawyers in your office has dealt
with the issue through the City, and I in turn have contacted Dave
Snoeyenbos at Dakota County Abstract Company to determine what he
feels would be most appropriate in order to effectively remove the
easement.
By way of background, I am enclosing a copy of the Warranty Deed
dated September 20, 1975 running from Tommy Waite to the Bertz which
re_serves the 20 foot easement. Although I have dealt with Tommy
waite in recent years, we are not able to locate him now and Dave
Snoeyenbos recommended the following:
1. That an affidavit be signed by a member of the Eagan staff
similar to the affidavit that I am enclosing for your review; and
2. That the City proceed with the vacation of the easement.
It is my understanding that the City is now proceeding to reroate the
storm sewer line from its present location. This will allow the
Bertz's to complete the split of their lot to allow them to sell a
portion of the lot for the construction of a sinqle family residence.

Thomas Colbert being first duly sworn on oath states and
alleges that he is the Public Works Director for the City of Eagan,
Dakota County, Minnesota, with office at 3838 Pilot Knob Road, Eagan,
Minnesota 55122.
In my position as Public Works Director for tha City of Eagan,
it is my duty to oversee the installation and maintenance of utility
lines, including storm sewer lines, throughout the City. It has been
brouqht to my attention that on September 20, 1975, Tommy R. Waite, a
single person, conveyed by warranty deed the following described
property to Richard A. Bertz and Sandra L. Bertz:
Lot Thirty-two (32), Block Two (2), Lakeside Estates,
according to the plat thereof on file and of record in the
office of the Register of Deeds within and for said County and
State.
In conjunction with the conveyance described above, the
following wording was included on the warranty deed:
Above property is subject to a twenty (20) foot drainage
easement across said Lot Thirty-two (32), the center line of
said easement described as follows: Commencing at the
northwest corner of said Lot Thirty-two (32); thence north 44
degrees 56 minutes 33 seconds east (assumed bearing) 12.64
feet along the northerly line of said Lot Thirty-two (32);
thence northeasterly deflecting to the right along a
tangential curve, radius 211.08 feet, central angle 39
degrees, 19 minutes, O1 seconds, 144.85 feet to the beginning
of said centez line; thence south 33 degrees, east to the
south line of said Lot Thirty-two (32), and said center line
there terminating.
I am familiar with the location and purpose of the 20 foot
drainage easement across said Lot Thirty-two (32) and state that the
storm sewer was installed and constructed for storm sewer drainage
purposes to serve as an adjunct of the City storm sewer system over
and across said Lot Thirty-two (32). The above described storm sewer
line has been used exclusively for City drainage purposes since the

STORM SEWER OUTFALL RELOCATION
As you are aware, the storm sewer that drains the low point on the east end of
Atlantic Hills Drive southerly to Hay Lake transverses the above-referenced lot.
Research cannot locate an easement incorporating this existing storm sewer
alignment. This property is owned by Mr. Rick Bertz, 550 Atlantic Hills Drive,
452-5062.
Earlier this year, Mr. Bertz contacted me regarding his desire to subdivide and
split this residential lot into two buildable parcels. Subsequently, the
existing storm sewer will have to be relocated to the future common lot line
where a proper utility easement will be dedicated with the lot split.
Due to the discrepancies in our asbuilt record plans, I recall you having your
engineering personnel do some field work to properly locate the existing storm
sewer facility.
On May 21, I met with Mr. Bertz in the field to review the existing alignment and
his proposed lot split. He's proposing to create a new lot line 30' east of and
parallel with the east side of his existing house. Alternatives for the
realignment of this storm sewer seem to indicate it may be best to move it to
this new property line. This would involve transplanting the existing small
apple tree and removal and reinstallation of the chain link security fence along
this new property line.
Due to the fact that the City has not acquired an easement for this public storm
sewer system, the relocation costs will be the responsibility of the City in
exchange for dedication of a utility easement over its new location.
After my May 21 meeting, I reviewed this information with you and requested your
department to prepare a preliminary plan and profile of this new construction
along with a cost estimate and schedule that can be presented to the property
owner.
On .Tuly 7, I was contacted by Mr. Bertz inquiring as to the status of this work.
Due to your vacation absence, I was unable to provide him with this information.
Therefore, I would appreciate it if you personally contact him to reestahlish
communications as necessary to ensure that this work is done within a time frame
compatible with his proposed subdivision.
Please keep me informed as to your progress so that I can be assured that this
problem is being properly attended to.

Dear Rick:
As you are aware, the City Council approved the revised financial oUligation on
the above referenced waiver at the regular meeting held June 1, 1993.
Per your request in our telephone conversation of June 7, 1993, enclosed is a
waiver of hearing form which upon your notarized signatures will allow the Cicy
to assess the total costs of $5,675 against the newly created lot. It is my
understanding that you desire the total outstanding existing assessments of
approximately $3,227 to remain on the lot on which your house is located and the
City will accommodate that.
In order to properly record these obligations the new parcel must be created at
the County through utilization of the waiver of plat resolution. This resolution
will be provided to you upon satisfaction of all conditions upon which the
approval was granted. I believe you have had previous communication with Marilyn
Wucherpfennig regarding that process.
In addition to the financial obligation which is contemplated to be assessed
through the waiver process, it is my undersCanding that you have agreed to pay
the water quality fee, park dedication fee and trails dedication fee in the
amounts of $249, $700, and $100 respectively, totaling $1,049. As I unders.tand,
these amounts have previously been reviewed with you.
I helieve this addresses all the concerns previously identified. If you have any
questions, please feel free to call me or any other staff inember for assistance.

Parcels and a Variance of 10' w the Required 30' Frontyard Setback for Property Located
Along the South Side of Atlantic Hills Drive in the Soatheast Quarter of Section 25--At iu
meeting of Apri127, 1993, the Advisory Planning Commission considered an application for
waiver of plat for the above-referenced lot in Iakeside Fstates located at 550 Atlantic Hills
Drive. A sepazate application for a variance was processed simultaneous with the waiver
of plat but was not considered by the Planning Commission as such applications go direc[ly
to the Ciry Council.

Rick Bertz, the applicant, stated he was available to answer any
questions.
Joyce Meyers, a resident of Atlantic Hills Drive, stated that the
proposed house would block her view of Hay Lake. When she moved into
the area, she believed that another home would not be built on that
site. Ms. Meyers did not feel that there was enough room to build
another house.
Mer..ber Isberg asked the applicant if the proposed home could be
moved =c Ms. N,eyers WOL'ZCI not lose her view of the lake. Mr. Bertz
stated that because of setbacks the house could not be relocated.
N.er..ber Hey1 cormented that if the applicant is proposing a
variance, maybe it is not appropriate to split this parcel.
N.r. Bertz me-.:ioned that most of the homes north of Atlantic
Hills Drive have had similar variances.

N.ember N.::ler felt that as the City matures more of these types
of applicatiens would be forthcoming. He stated that the City has a •
respor.=ibility to the current homeowners. They believed that nothing
would be buiit and then the "rules of the game" are changed. He felt
this was unfair to existing homeowners.
Member Isberg stated that he agreed with Member Miller.
Mr. Bertz stated that he has lived in the City of Eagan for 16
years. He explained that the reason he is requesting this waiver is
that he is cut of work and must split the parcel in order to pay off
pa*t of nortgage. If the waiver is not approved, he will lose his
home. Nr. Bertz mentioned that he is not splitting the parcel to make
money so he can go on a trip, etc.
N,e-ber Merkley stated that Mr. Bertz has a"right" to split his
parcel and that all width and size codes are met.
He}•1 moved, Merkley seconded, the motion to approve a Waiver of
Plat to split Lot 32, Block 2, Lakeside Estates, into two parcels
located along the south side of Atlantic Aills Drive in the SE 1/4 of
Section 25, subject to the following conditions:
1. The standard conditions of plat approval as adopted by
Council action on February 2, 1993:
A1, B1, B2, B3, B4, C1, C2, D1, E1, F1, G1 and H1 •

2. The City Council shall approve a variance of SO' to the
required 30' minimum building setback from public R.O.W. for
Parcel B.

4. The developer shall submit a grading plan with the proposed
b::?lding permit application.
5. The final grading plan shall protect a 25 foot wide buffer
strip alonq the edge of Pond LP-31.
6. The Developer shall be responsible to install a 4" sanitary
se,,.•er service and a 1" water service to the new lot and the
Deve;oper shall obtain a Work Within the Right-of-Way Pera;it
Fr`_c: to the installation of the utility services.

At the April 27, 1993 Advisory Planning Commission meeting, the Waiver of Plat in order
to split Lot 32, Block 2, Lakeside Estates Addition, was approved unanimously. There
was one resident in attendance that lives across the street who did not support this
application as she felt the new home could block their view of Hay Lake. A separate
application requesting a 10' front yard setback was not acted on by the Commission.
Hay Lake is classified as a"General DevelopmenY' lake and as a resutt, has a 50' building
setback to the Ordinary High Water Mark. The applicant has submitted a letter detailing
the reasons for requesting the Waiver of Plat and VerianCe, attached.

Dear Tom,
Because of my continuing health problems, we find it nectssary to subdivide our lot at 550
Atlantic Hills Drive (Lot 32, Block 2, Lakeside Estates Division). The resulting lots will
meet the minimum front footage and area requirements.
The existing storm sewer main on the property is located in such a way that subdividing
the lot is impractical. It has been brought to our attrntion that there is no easement for the
sewer. We therefor request the sewer be relocated to the eastem boundary ofthe existing
lot 7his location will not imerfere with the placement ofa new home on the property.
N'e are afso requesting a variance on the front setback requirement to twenty feet from the
, propeny line This setback is necessary to accommodate the style of home we have chosen
and is necessary because of the DNR required fifty foot setback from Hay Lake. Other
homes in the immediate vicinity of the property have been ganted a similar setback
variance due to the location of a power line easement at the rear of the ef3'ected properties.
The cune of Atlantic Hills Drive will make the twenty foot setback less noticeable.
Vl e have enclosed a check in the amount of three hundred doilars, the Waiver of Plat,
Variance Request, 350 Foot Abstractor's List and Survey in accordance with city
directives as noted in two preliminary meetings with planning and engineering staff.

through are tbe APC minutes relative to this item. The APC is recommending
approval. Please note that the Commission added Conditions 6 and 7 relative to a turn
around driveway and building pe t review relative to drainage not included in the staff
report. Also enclosed on pages ?through _ is a supplemental staff inemorandum
covering conespondence recerved of Dakota County relative to a Plat Commission
recommendation that the preliminary plat be denied and the driveway access not be given
onto Pilot Knob Road. Although a curb cut was provided for the second lot at the time
Pilot Knob Road was upgraded, the Counry Plat Commission has found that the proposal
does not meet current spacing guidelines and as such is recommending denial. At the
present time, the conditions of approval include an obligation oa tbe part of the applicant •
to resolve this issue with Dakota County prior to final plat approval.
ACTION TO BE CONSIDERED ON TEIIS I1'EM: To approve or deny a preliminary plat
