The pool is located in such a way that it encroaches upon the adjacent lot which is legally described as Lot 9, Block 1, Chatterton Ponds. While the pool was installed in 1988, the encroachment was not discovered until the summer of 1991 when the adjacent lot was being prepared for the construction of a home: They estimate that the cost of correcting the improper installation is approximately $4,000.00 and the cost of installing the pool in the proper location is likely to exceed $14,000.00.
