WHEREAS, a regular meeting of the City Council of the City of
Eagan, Dakota County, Minnesota, was held on the 17th day of
November, 1992, at 7:00 o'clock p.m. at the City Hall located at 3830
Pilot knob Road, Eayan, ?•Iinnesota; all members being pres=_nk; and
WHEREAS, pursuant to M.S.A. Section 412.851, the Mayor convened
the public hearing to consider the proposed vacation of certain
drainage and utility easements lying over and across the following
described property:
That part of Lot 9, Block 1, Chatterton Ponds, according to the
recorded plat thereof, Dakota County, Minnesota, described as
follows:
Commencing at the southeast corner of said Lot 9; thence North 35

WHEREAS, an Affidavit of Publication of notice of hearing in the
Dakota County Tribune, dated October 29 and November 5, 1992,
relative to the proposed vacation was submitted; and
WHEREAS, said Notice of Hearing was posted at the City Hall on
the 23rd day of October, 1992; and
WHEREAS, there appearing no objections to said vacation and the
Council desiring to vacate said drainaqe and utility easements; and
WHEREAS, it having been determined that other than petitioner,
there are no other parties, including public utility companies,
havinq an interest in said drainage and utility easements, and it
appearing that it is in the public interest to vacate such easements,
and there being no objections;
NOW THEREFORE, upon motion by Councilmember Pawlenty, seconded by
Councilmember Wachter, all members voting yes, it was RESOLVED that
the certain drainage and utility easements lying over and across the
following described property is hereby vacated:

I represent Mr, and Mts. Gene Studt who live at 1353 -,-?
Chatterton Road in the City of Eagan. Notice is hereby given (? ' U
on behalf of Mr. and Mrs. Studt to the City and to the
Inspector whose initials are identified on the enclosed copies
ftom your permit file that my clients have a claim against the
City and its Inspector for negligent inspection of the
installation of a swimming pool on my clients' property. The
pool is located in such a way that it encroaches upon the
adjacent lot which is legally described as Lot 9, Block 1,
Chatterton Ponds.
While the pool was installed in 1988, the encroachment
was not discovered until the summer of 1991 when the adjacent
lot was being prepared for the construction of a home: They
estimate that the cost of correcting the improper installation
is approximately $4,000.00 and the cost of installing the pool
in the proper location is likely to exceed $14,000.00.

This correspondence is a follow-up to our telephone
conversation of 1-31-92 concerning the above captioned
claim where your client is alleging negligent inspection
of the installation of his swimming pool.
Our investigation reveals that the City is not liable for
your client's damages. The City does not owe any duty in
recards to the inspection and location of your clients
swimming pool. Therefore, I will not make any payment on
this claim.

Dear Property Owner:
Recently, you may have read an article in the local Eagan Chronicle
expressing the City's concern over the dike/dam that is constructed
around the pond outlet located between Lots 11 and 12 on the
eastern end of the pond. Further research into this matter has
indicated that the construction of this outlet restriction was
performed at the time of the City approved dredginq of the pond by
the developer and adjacent homeowners during the spring of 1989.
Therefore, before the City would proceed with any adjustment to the
present situation, we will reevaluate the hydrologic and hydraulic
design of the storm sewer system to determine if this restricting
outlet structure would have to be removed. If, as a result of this
additional evaluation, it is determined that its removal or
modification is required, a written notice will be sent to the
attached mailing list so informing them of the proposed action and
the reasons for it.
If, however, the results of this additional evaluation determines
that no adjustment is necessary, there will be no action taken by
the City.
Therefore, please be assured that the City will fully reevaluate
the situation and inform all affected property owners if there are
any changes proposed.
