At the November keeting the possibility of the city giving the road some care and charging the property owners was indicated as a way to go. I have checked with a few of the property owners about this and they indicate they would be happy to have this arrangement with the city so that once a year there might be some grading and some toping put on. If this is a possibility we would like to know some ball park . figures on cost.. etc. If I (or we-the property owners) can supply additional informatiion of be of help in appearing before you we would be pleased to do so. EXCEPT, for one thing which should not have happened. That one thing happens to be the location of the horse operation on Pilot Knob road. Here are one humdred horses on about six acres of land. The land has become an eye sore, being trammeled and eroded over a short period of time. It has become objectionable to both eye and nose. The thing which prompts this letter is the beer sign, lighted, which is offensive to the entire setting. Here is a recreational spot for familes with small children, adjacent to a beautiful county park system, on a main, beautiful road right through Eagan. The horse operation when on county 32 was sloppy, and the change of location has not done anything to make it better - just more visible! We wonder if the lighted sign meets code? Is there some limitation on the signage permitted at this spot? Is there any control on the number of horses allowed on a certain amount of land? Can horse be licensed just like dogs? And like cross country skiers on the county trails - can a permit be required for horse riders to help pay some of the cost of cleaning up after them? However, I think the best solution would be to buy the land and convert the buildings to warming houses for athletics in the winter and activities in the summer. I should have added before taht the grounds used for hay storage is left in shambles with junk all around, hay falling off big wagons into messy mountains, and everything just plain tragedy. If I can help further to solicit signatures on a petition for any possible changes to the above I would be pleased to do so. Thank you for looking into what might be done. t Sincerely, A. C. The amount of assessments set forth in the notice of assessments sent to the Landowner by the City against said property is $4617.36, which is attached hereto as Exhibit A and is incorporated herein by reference. 3 The City's assessments that are the subject of this proceeding relate to proposed improvements of Project 905R. 4) Within the time limited by law, Landowner filed a written notice of objection to the proposed assessments in accordance with the requirements of Minnesota Statute Section 429-031(1), which is attached hereto as Exhibit B and is incorporated herein by reference. 5) The action of the City in adopting the assessments is contrary to law for the following reasons: A) With regards to the construction of Project 905R, landowner believes that it received no special benefit equal to or greater than the amount of the assessment; B) The City failed to comply with the provisions of Minnesota Statute Section 429, as amended; C) The criteria and method used to determine the assessments upon said property are not proper for the imposition of assessments, are not in accord with constitutional, statutory or municipal assessment policy requirements and are, therefore, arbitrary and capricious and thus, deprive the property owner of property without due process of law, contrary to the requirements of the United States and Minnesota Constitutions; D) The improvements in Project 905R are excessive in scope and are designated to favor other landowners who are not being similarly assessed; E) The assessments as adopted by the Eagan City Council are contrary to and in violation of Landowner's substantive and procedural rights and the following constitutional, statutory and ordinance provisions: i) United States Constitution, Amendment V; ii) United States Constitution, Amendment XIV; iii) Minnesota Constitution, Article 1, Section 7; iv) Minnesota Statute Section 429.01, et seq.; and v) City of Eagan Ordinance, Resolutions, and Policies regarding Assessments.
