The application of Jon Foley and Casco Bernardi for conditional use permi[
for 3.2 heer and wine license for 1985 Silver Be11 Road in the Silver Bell Shopping
Center was next considered. Mr. Foley was present and stated the name of the restauran
crould be the Briar Patch Tavern in bay 19 of the Silver Bell Center. It was noted
no wine application was cequested at the present [ime although included in the
conditional use permit request. Egan moved, Wach[er seconded the motion to approve
the conditional use peLmit according to the following recomuendations:
1. Compliance with the hours stated by Mr. Foley.
2. That the licensing process including the approval hy the Police Chief be
complied with.
3. That the applicant comply with all other applicable ordinances.
All members wted in favor. Then Smith moved, Parranto seconded the motior., [o
' amend the conditions to res[rict operating hours to those provided under the
ordinance because of concerns about policing the hours other than those provided
under the ordinance. All voted in favor.

Mr. Hussein Ansari appeared on behalf of. his application for conditional use
permit and for 3.2 beer and wine license, pylon sign permit, cigarette permit, on-
sale wine and beer licenses for the Hediterranean Cruise Restaurant located in the
former Country Kitchen Restaurant on Highway I113. There would be no bar and there
would 6e 86 seats in the restaurant. The APC recommended aaproval of the conditional
use permits subject to conditions. Parranto moved, Smith seconded a motion to approve
the conditional use permit subject to the following with the understanding that the
hours would be permitted pursuan[ to ordinance provisions:

ASSESSMENT DEFERRAL AGREEMENT
THIS ASSESSMENT DEFERRAL AGREEMENT ("AgreemenP') is made this/24 day
of lV-ll 2005, by and between JAMAL D. ANSARI, a single person,
(hereinafter " ANDOWNER") and the CITY OF EAGAN, a Minuesota municipal corporation
(hereinafter the "CITY"). (Landowner aud City are collecYively referred to as the "Parties.")
WHEREAS, Landowner is the fee owner of certain property in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:
Lot 5, Block 1, BARTON McGAAY ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota.
(hereinafter the "Property"); and
WHEREAS, as part of Public Improvement Project No. 800R (hereinafter the "Project")
the City is proposing to assess the Property for street improvement costs in the amount of
$6,225.66; and
WHEREAS, the City is willing to defer the assessment for a limited time in anticipation .
oP redevelopment of the Property; and
WHEREAS, Landowner is willing to accepY the defermenC and pay the assessment all
upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of wliich are hereby acknowledged,
the Parties do agree as follows:
1. DeFEctxeD AssessMtN'r. The Parties agree that the street improvement
costs under die Project in the amount of $6,225.66 shall be deferred
without interest until the earlier of the following:
A. The Property is sold; UTE RECEIVED 7an/E /S, zW,,r
B. The Property is subdivided; DAKOTA COUNTY
TREASURER-AUDITOR A:.
C. The Property is platted; or
D. June l, 2008.
At such time, the deferred assessment shall be payable in equal
installments over a period of ten years with interest thereon at interest of
seven percent (7%) per annum.
2. WnivER. The Landowner hereby accepts the deferred assessment for
street improvement costs in connection with the Project in the total
amount of $6,225.66. The Landowner hereby waives the right to object or
appeal the assessments pursuant to MINm. SI'nT. § 429.081 and further
waives notice of hearing on this Agreement.
3. B1NDiNG EFFeC'r. This Agreement shall be binding upon and inure to the
benefit of the Parties' heirs, successors and assigns and sUall run with the
land.

The Mediterranean Cruise Cafe has been given Administrative approval to operate a one
time outdoor food sales event to run from August 4 through August 13, 1995. The
outdoor food event shall be contained within a 20' x 30' tent area located in the corner
of the southwestern most parking area. The subject event shall meet the following
requirements:
1. The tent structure shall be erected on August 4, 1995 and shall be taken down no later
than August 13, 1995.
2. All outdoor sales, displays, and seating shall be contained within the tent area.
3. The tent area shall not exceed 600 square feet and shall be located in the
southwestern most parking area closest to the building.
4. Outdoor sales shall be limited to food only; liquor sales from a temporary structure are
prohibited by City Code.
5. All signage associated with this temporary outdoor sale shall adhere to City Code
Section 4.20, Subdivision 7, J. limiting any temporary sign, or combination of signs, tor
special business sales to no more than 25 square feet.

MEDITERRANEAN CRUISE '
Mr. Hussein Ansari appeared on behalf of his application
for conditional use permits and for 3.2 beer and wine license,
pylon sign permit, cigarette permit, on-sale wine and beer licenses
for the Mediterranean Cruise Restaurant located in the former
Country Kitchen Restaurant on Highway 13. There would be no bar
and there would be 86 seats in the restaurant. The APC recommended
approval of the conditional use permits subject to conditions.
Parranto moved, Smith seconded a motion to approve the conditional
use permits for the on-sale 3.2 beer and wine license subject to
the following with the understanding that the hours would be
permitted pursuant to ordinance provisions:
1. Compliance with the hours stated by Mr. Ansari.
2. Subject to approval of the necessary licenses by
the City Council.
3. Compliance with all required ordinances.
All voted yes.
Parranto moved, Wachter seconded a motion to approve

The application of Jon Foley and Casco Bernardi for conditional use permit
for 3.2 beer and wine license for 1985 Silver Bell Road in the Silver Bell Shopping
Center was next considered. Mr. Foley was present and stated the name of the restauran
would be the Briar Patch Tavern in bay 19 of the Silver Bell Center. It was noted
no wine application was requested at the present time although included in the
conditional use permit request. Egan moved, Wachter seconded the motion to approve
the conditional use permit according to the following recommendations:
1. Compliance with the hours stated by Mr. Foley.
2. That the licensing process including the approval by the Police Chief be
complied with.
3. That the applicant comply with all other applicable ordinances.

there were concerns about such permits and use in neighborhood areas. Smith moved,
Wachter seconded the motion to continue the application and to request the staff
to acquire background information including procedures and submit the recommendations
to the Council. All voted in favor.

ASSESSMENT DEFERRAL AGREEMENT
THIS ASSESSMENT DEFERRAL AGREEMENT ("Agreement") is made this day
of Ift 2005, by and between .IAMAL D. ANSARI, a single person,
(hereinafter " ANDOWNER") and the CITY OF EAGAN, a Minnesota municipal corporation
(hereinafter the "CITY"). (Landowner and City are collectively referred to as the "Parties.")
WHEREAS, Landowner is the fee owner of certain property in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:
Lot 5, Block 1, BARTON McGRAY ADDITION, according to the recorded plat
thereof, Dakota County, Minnesota.
(hereinafter the "Property"); and
WHEREAS, as part of Public Improvement Project No. 80OR (hereinafter the "Project")
the City is proposing to assess the Property for street improvement costs in the amount of
$6,225.66; and
WHEREAS, the City is willing to defer the assessment for a limited time in anticipation
of redevelopment of the Property; and
WHEREAS, Landowner is willing to accept the deferment and pay the assessment all
upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do agree as follows:
1. DEFERRED ASSESSMENT. The Parties agree that the street improvement
costs under the Project in the amount of $6,225.66 shall be deferred
without interest until the earlier of the following:
A. The Property is sold; DATE RECEIVED la l IdL lw
B. The Property is subdivided; DAKOTA COUNTY
C. The Property is platted; or TREASURER-AUDITOR ,
D. June 1, 2008.
At such time, the deferred assessment shall be payable in equal
installments over a period of ten years with interest thereon at interest of
seven percent (7%) per annum.
2. WAIVER. The Landowner hereby accepts the deferred assessment for
street improvement costs in connection with the Project in the total
amount of $6,225.66. The Landowner hereby waives the right to object or
appeal the assessments pursuant to MINN. STAY. § 429.081 and further
waives notice of hearing on this Agreement.
3. BINDING EFFECT. This Agreement shall be binding upon and inure to the
benefit of the Parties' heirs, successors and assigns and shall run with the
land.

RE: Temporary Outdoor Sales; Summer Food Festival
The Mediterranean Cruise Cafe has been given Administrative approval to operate a one
time outdoor food sales event to run from August 4 through August 13, 1995. The
outdoor food event shall be contained within a 20' x 30' tent area located in the corner
of the southwestern most parking area. The subject event shall meet the following
requirements:
1. The tent structure shall be erected on August 4, 1995 and shall be taken down no later
than August 13, 1995.
2. All outdoor sales, displays, and seating shall be contained within the tent area.
3. The tent

not exceed
600 square feet and shall be located in the
southwestern most parking area closest to the building.
4. Outdoor sales shall be limited to food only; liquor sales from a temporary structure are
prohibited by City Code.
5. All signage associated with this temporary outdoor sale shall adhere to City Code
Section 4.20, Subdivision 7, J. limiting any temporary sign, or combination of signs, for
special business sales to no more than 25 square feet.

MEDITERRANEAN CRUISE
Mr. Hussein Ansari appeared on behalf of his application
for conditional use permits and for 3.2 beer and wine license,
pylon sign permit, cigarette permit, on-sale wine and beer licenses
for the Mediterranean Cruise Restaurant located in the former
Country Kitchen Restaurant on Highway 13. There would be no bar
and there would be 86 seats in the restaurant. The APC recommended
approval of the conditional use permits subject to conditions.
Parranto moved, Smith seconded a motion to approve the conditional
use permits for the on-sale 3.2 beer and wine license subject to
the following with the understanding that the hours would be
permitted pursuant to ordinance provisions:
1. Compliance with the hours stated by Mr. Ansari.
2. Subject to approval of the necessary licenses by
the City Council.
3. Compliance with all required ordinances.
All voted yes.
Parranto moved, Wachter seconded a motion to approve
the conditional use permit application for pylon sign subject to
the following conditions:
1. The pylon sign is allowed in lieu of a free-standing
ground sign and only one pylon sign is allowed per building.
2. The pylon sign shall not be located within 300 feet
of any other pylon sign, measured on the same side of the street.
3. The pylon sign shall not project more than 27 feet
above the lot level.
4. The pylon sign shall not exceed 60 square feet in
area.
5. The sign shall not be located nearer than 20 feet
from any street or highway right-of-way, nor nearer than 10 feet
from any property or dividing line.
6. The sign shall be in conformance with all other
applicable ordinance requirements under Ordinance 16.
All voted yes.
Then Parranto moved, Egan seconded the motion to approve
the application for 3.2 on-sale beer and wine licenses and for
cigarette license according to ordinance requirements. All voted
yes.
