SUBJECT: LAND GRADING
THIS IS TO INFORM YOU THAT THE LAND GRADING OF THE WEST SIDE OF OUR HOME IS NOT
SATISFACTORY AND SHOULD BE REGRADED. WE UNDERSTAND THAT OUR NEIGHBOR TO OUR WEST,
JOHN AND MARY GAl1DETTE, HAD VOICED A CAMPLAINT TO THE CITY LAST SUMMER BECAUSE OF
WATER DRAINING INTO THEIR YARD.
OUR HOME WAS BUILT LAST JULY. WHEN THE DEVELOPER, TRILAND, CAME FOR THE FINAL GRADING,
OUR NEIGHBOR STOPPED THE GRADING UNTIL THE WATER DRAINAGE PROBLEM COULD BE RESOLVED. I
SPOKE WITH THE CITY ENGINEER, CRAIG KNUTSON, AT THIS TIME AND HE SUGGESTED THAT A SWAIL
BE PUT BETWEEN THE TWO YARDS ON THE PROPERTY LINE SO THE WATER WOULD RUN INTO THE STREET.
THIS WOULD MEAN THAT OUR NEIGHBOR WOULD NEED TO MOVE HIS GARDEN AND SWINGSEf/SANDBOX
THAT NOW SRS ON THE PROPERTY LINE. OUR NIEGHBOR WAS WILLING TO MOVE THE GARDEN AND
SANDBOX AND AGREED THAT A SWAIL SHOULD BE PUT IN. HOWEVER, HE DID NOT BEIIEVE THAT HE
SHOULD INCUR THE COST FOR THIS. WHEN TRILAND CAME FOR FINAL GRADING IN SEPTEMBER THEY
PUT THE SWAIL FIVE FEET FROM OUR HOUSE. WE WERE NOT INFORMED THAT THE SWAIL WOULD NO
LONGER BE ON THE PROPERTY LJNE, AND WERE ANGRY THAT IT WAS LOCATED SO ClOSE TOOUR
BASEMENT WALLS. WE WAITED TO SEE HOW EFFECTNE THE SWAIL WOULD BE. SINCE IT DID NOT RAIN
MUCH IN OCTOBER AND THEN WINTER SET IN, WE WAffED UNTIL SPRING TO SEE THE RESULTS.
THE WATER STILL DRAINS INTO OUR NEIGHBOR'S YARD. THE DIRT HAS WASHED AWAY ALONG THE
WEST SIDE OF THE HOUSE REVEALING THE TAR ALONG THE CEMENT BLOCKS. MUCH OF THE SWAIL HAS
ALSO WASHED AWAY.
WE CONTACTED CRAIG KNUTSON AGAIN ON APRIL 4 REGRADING THE SWAIL AND HE SAID THE SWAIL
NEEDS TO 8E THERE OR ELSE WE NEED TO COME UP WffH SOME OTHER GRADING PLAN SO WATER
DOESNT DRAIN INTO OUR NEIGH80RS. IF, INDEED, THERE MUST BE A SWAIL ON THE WEST SIDE OF OUR
HOUSE, IT IS ONLY FAIR THAT IT BE ON THE PROPERTY LINES AS IT WAS ORIGINALLY PROPOSED BY
CRAIG.
WE SPOKE WITH OUR NEIGHBOR THIS WEEK ABOUT THE GRADING AND WE BOTH AGREE THAT THE SWAIL
IN THE PRESENT LOCATION IS NOT EFFECTIVE. HE IS STILL IN AGREEMENT THAT A SWAIL 8E PUT ON
THE PROPERTY LINES BUT IT WOULD MEAN BUILDING UP 1HE EDGE OF HIS PROPERTY SINCE HIS LOT IS
SO MUCH LOWER THAN OURS. HE IS WILLING TO HAVE HIS GARDEN AND SANDBOX TO ACCAMPLISH
THIS.
WE ARE ALSO IN AGREEMENT THAT THE TWO LOT LINES DO NOT CURRENTLY MATCH UP PROPERLY. HIS
DEVELOPER WAS ROTLUND AND OURS WAS TRILAND.
ATTACHED IS THE GRADING PLAN GNEN TO US BY OUR CONTRACTOR BEFORE OUR HOME WAS BUILT. WE

DRAINS INTO OUR BACKYARD. LAST SUMMER WATER SAT IN OUR BACKYARD AND FORMED AN ALGEA
SWAMP. TRILAND CHANGED THE GRADING OF OUR BACKYARD BY SLOPING THE LAND TOWARDS THE
EAST RATHER THAN THE WEST AS ff WAS ORIGINALLY IN THE LAND GRADING PLAN. THEY DID THIS THE
SAME DAY THEY PUT THE SWAIL ON OUR WEST SIDE.
SINCE THE CRWDING OF THE WEST SIDE OF OUR HOME EFFECTS THE NEIGHBOR'S YARD, AND WAS
DECIDED ON BY THE CITY ENGINEER AND TRILAND, THE CAST INCURRED TO CARRECT THE SWAIL SHOULD
NOT BE OUR RESPONSIBILJTY.
IF TRILAND IS UNWILLING TO CHANGE THE GRADING, WE WILL HAVE OUR OWN LANDSCAPER MOVE THE
SWAIL TO THE PROPERTY LINE AND GRADE FOR HALF OF THE SWAIL THE OTHER HALF OF THE SWAIL
WILL BE ON THE NEIGHBOR'S PROPERTY AND IT IS UP TO HIS DEVELOPER TO FINISH CREATING THE
SWAIL.
