My FHA Case # 217:143435 In March of 1977 I notified the President of the Timbershore Association, Mr. Ed Kenny that the walls and ceilings, and the walls and floors in some area's of my home were separating. I also told him that both bedrooms have a wall cracked from the floor to the ceiling. I further stated that my living room wall had cracked approx- imately three feet. The concrete around my house had separated from my porch and parts of my house. Cement in my garage had heaved up and crack- ed. My front door and the door to my garage also shifted, the front door jammed tight at the top and opened a full one half inch at the bottom ' right hand side. Now the wind blows in causing a large loss of heat and yet it is impossible to open the door. Fot the time being I have a blank- et covering the gap to help keep the draft out. Just the opposite has happened to my other door leading into the gar- age, it has shifted so much the door could not be closed or locked as the latch bolt was now about one half inch below the bolt hole. My garage door has shifted so much it does not open and shut properly. When clos- ed I can completely slide my whole hand under both sides of the garage door so my insulating the garage last summer is meaningless, plus some- times the garage door will not open at all. I feel that with none of my doors functioning properly, I have an extreme fire hazzard here.' Last year I was advised to contact a Mr. Joe Kelly with New.Horizon Homes. I called Mr. Kelly and explained to him what had happened and he made and kept an appointment to visit my home, which he agreed had consid- erable dammage and he said I had a legimate complaint. He said the freez- ing weather had caused the North-West corner of my house to heave causing all this dammage, and he said he would submit my complaint to New Horizon Homes and that it would be a few months before they received my ease, 6o I should just wait for an answer. No answer came, but another freeze did and the dammage this year is in the same places only considerably worse' then last year and a few more things have appeared, such as; bath room tiles separating from the wall, and the baseboard in the bath room has -2- split in half, and my landing has separated from the wall by a full half inch. Once again this year I called for Joe Kelly with New Horizon Homes, it seems tor. Kelly is now in a different department. I related these en- closed facts to Mr. Kelly's replacement, I assume, a man called Denny. This conversation took place on January 30, 1978. Denny took my phone number and said he would talk with Joe Kelly, and New Horizon and then he would get back to me. Denny returned my telephone call on February 1, 1978 and said he had talked with Joe Kelly and New Horizon and they feel when they built the house it met all V.A. and F.H.A. specifications and they would not consider my complaint, and I could take whatever course of act- ion I chose to, as they were no longer concerned. This brings us up to date. I would now like to add we were not informed of this problem, or even the possibility of this problem when my wife and I purchased our home in June., 1976. Futhermore this same problem has occured in several other homes out here in the Timbershore area, for instance two homes across the street from ours had the same type of dammages caused from the freezing weather, and rumored underground streams, but their homes were repaired last year, and I believe New Horizon suffered the expenses. To get the full impact of what I have written, this dammage should be inspected as soon as possible as when it warms up the house shifts back. I know you will be able to help me, and I would appreciate it, if you would please acknowledge my letter and advise me as soon as possible as I an anxious to take the proper steps to rectify this situation.
