Pam Dudziak, Planner e V Date: December 13, 2007 Subject: Setbacks Building Inspections received a permit application for replacement of a deck a 3708 Denmark Court East. The house is situated at a higher elevation than the driveway and the street. The deck is located on the front of the house, with a staircase down to the driveway. The deck does not meet typical front yard setbacks. The applicant provided a site plan (not a survey) showing distances to the curb. After checking the as-builts for right-of-way width and distance from curb to the edge of the right-of-way, we determined that the existing front setback on the house is -26 feet. The deck is set back -21 feet and the staircase is set back -16 feet. The property is zoned PD, Planned Development and was platted in 1974. The house was built in 1976 and it appears that the deck was constructed at the same time. The PD Agreement from 1974 states "setbacks along local public streets shall be at least 30 feet except where topography problems or the location of existing trees require a lesser setback, in which case the setback may be reduced by the Building Inspector to 20 feet. Any setback less than 20 feet shall require express approval by the City Council. " Based on the language in the applicable 1974 PD Agreement, and historical records indicating that the deck was built with the house originally, replacement of the existing deck is permitted, however, the deck cannot be enlarged. s I cV l?i ? WITNESSETH WHEREAS, developer proposes a Planned Development in Eagan to be known as Pilot Knob Properties containing 90 acres more or less, and legally described as the Pilot Knob Heights 1st Addition, 2nd Addition and 4th Addition more particularly shown in Exhibits A, B, C and D attached hereto and incor- porated herein by reference, and WHEREAS, public services are needed by Developer from Eagan in order to proceed with said development, and WHEREAS, it is the intention of the Developer to proceed with said development in stages and to obtain final approval for each stage as said development progresses and to base its application for said final approval on the plans shown in said Exhibits, NOW THEREFORE, it is hereby agreed by and between the parties hereto as follows: 1. Sidewalks Concrete sidewalks shall be constructed along such streets in the development at the expense of the Developer, coincidently with the improvement of said streets as provided in or as required by ordinance or regulation of the City of Eagan at such time as development occurs in such subdivision. The City Council will consider reasonable exceptions to sidewalks required,-as plats are presented, with decisions as to said exceptions to be entirely within the discretion of Eagan. 13. Street Lights Developer agrees to comply with all Eagan Ordinances in effect at the time of development of each subdivision regarding street lighting. Developer agrees to provide a street lighting system to be approved by Eagan. The system shall be implemented under the following provisions: a. Developer shall payrall charges for each light installed as per the approved lighting plan. b. Developer shall pay operating costs of the street lighting system until each phase of development is complete and accepted by Eagan. c. Thereafter, Eagan will assume operating costs which will be billed equally to all the homes in the Subdivision and the Developer shall inform prospective purchasers of homes to this effect. 14. Building Setbacks Building setbacks shall be established by the City Zoning Ordinance except that the following deviations shall be permitted: a. Setbacks along local public streets shall be at least thirty (30) feet except where topography problems or the location of existing trees require a lesser setback, in which case the setback may be reduced by the Building Inspector to twenty (20) feet.
