The City of Eagan actively manages its right-of-ways and, by ordinance, regulates
the installation and maintenance of trees, shrubs and landscaping within or
affecting these areas. The ordinances are intended to protect and promote the
safety and welfare of the general public.
Please be on notice that your property located at 4369 Diamond Drive has been
found to be in violation of the City ordinances pertaining to the installation and
maintenance of trees, shrubbery or landscaping within the street right-of-way:
Eagan City Code, Section 7.08, provides, in part:
Subd 1. D.3 Any trees, shrubs or landscaping planted or installed within a street
right-of-way shall be at least ten (10) feet from the back of the curb or twenty
(20) feet from the edge of the road surface where no curb or gutter exists.
Subd. I.D.4 Trees, shrubs and landscaping shall not be planted or maintained
on public or private property in such a manner as to obscure or impede the
visual sight lines required to ensure the safe and efficient circulation of vehicles
and pedestrians on streets, intersections, trails, and sidewalks. Trees, shrubs or
landscaping shall not be planted as to block the visibility of any regulatory,
warning or street identification sign or block the illumination of streetlights...

Specifically, the bushes on your south property line, along Shale Lane are planted
in the City right-of-way. This area is typically reserved for public utilities, snow
storage, safety setbacks and sight clearances. In order to insure that the public
needs are protected, the City of Eagan has adopted a City Code (see excerpts
above) that regulates the uses permitted within this public right-of-way. During a
recent review of the intersection it was determined that 8 shrubs need to be
removed (or relocated further back in your yard) in order to maintain acceptable
sight clearances at the intersection. I have included a photo of your property
showing the specific shrubs that need to be removed.

A short time ago, you received a notice from the City of Eagan of a violation of
the City ordinance pertaining to the installation and maintenance of trees,
shrubbery or landscaping within the street right-of-way for your property located
at 4369 Diamond Drive. The purpose of this letter is to inform you that a follow-
up inspection was recently performed by City staff and as of the date stated
above, your property is now in compliance with City Code.
For the safety of the traveling public, I ask that you periodically monitor your
trees/bushes/landscaping in the future and maintain them in such a manner as to
keep any vegetation out of the clear zone.

City administrator In late 2006 I contacted you regarding the bushes planted along Shale Ln. in the
front/side portion of your property. By mid-2007 you had the issue was resolved.
Now, 5 years later, I regret to inform you that we have received a complaint that
the bushes have grown to a point that they are once again causing a sight and
safety obstruction in the area of the intersection. I've included copies of our

City Administrator I regret to inform you that the bushes along Shale Ln., which are located along the
side/front of your property continue to cause sight issues for motorists and must
either be trimmed and maintained so there is nothing growing above 2.5 feet
above the street surface (as specified by City Code) or removed completely from
the right-of-way (ROW).
Municipal Center As you know, we've been dealing with this issue for 7 years now and your bushes
are clearly planted within City ROW; this violates several sections of the City
3830 Pilot Knob Road Code. We've tried different alternatives in an effort to reach some common
