acquisition of easements and $2,500 from you and yopr wife for a total of $6,960. According
to the agreement, this amount was to be held until the levy of assessments for Project 607.

As you are aware,the reconstruction and upgrading of County Road 30 (Diffley Road) has
been completed. All the costs have now been tabulated and the final assessment-roll
prepared. We are planning to present this roll to the City Councii for consideration at a
public hearing scheduled to be held at 7:00 p.m. on Tuesday, October 18, at the
Municipal Center.
This was a very large and compiex project that also included the installation of utilities
providing service to adjacent properties. Your proposed final assessment for the various

Dear Gene:
We discussed this matter by phone several days ago. Mr. Carl
Case resides at 540 County Road 30. His wife is a resident of
the Sanford Nursing Home in Farmington.
Mrs. Case (Mildred K.) has very recently been approved for County
Medical Assistance which is the basic concern in this matter.
The County is to pay $4,460 to the Cases for a right-of-way
transaction on the above-referenced project. The approximate
special assessments which will be levied by the City on the
snbject proper*_y for said project are $23,807_ The levy w311
occur in either 1994 or 1995 for this 1993 highway project.
The medical assistance representative and Mr. Case agree that,
considering the interest of the property owner, their office and
the City, the County should deposit its right-of-way payment of
$4,460 in an interest bearing escrow account with the City of
Eagan. The escrow should be in the name of the City and Mr. Carl
Case. At such time as the special assessment for highway project
C.P. 30-06 is levied on the subject property, the entire
principa2 and accrued interest should be released from the escrow
account and paid to the City on the special assessment for Mr.
Case. Also, the medical assistance representative and Mr. Case
agreed that Mr. Case will, for the initial deposit to the escrow,

$4,460 from the County. The total deposit of $6,960 shall
henceforth be treated as a single deposit. At the time the total
principal and interest is released from the escrow and paid to
the special assessment, it will be treated as a single payment

if the above scenario is workable and we will initiate the County
check for $4,460 and I will get the check for $2,500 from Mr.
Case and deliver both checks to you for deposit in escrow.

and it is kept in an orderly way. The intent of the Board of Supervisors
conditions has been met as indicated in the September 5, 1972 minutes.

Council approval was granted on September 5, 1978. The fbnditional IIse
permit is Iimited to five years because the development of the area was

been done, but nothing else. However, Mr. Neisius must resppear before the
City Council in September of 1983.

THIS EASEMENT, made thisog??day of , 1993, between
the STATE OF MINNESOTA, herein referred to as "Landowner" and the
CITY OF EAGAN, a municipal corporation organized under the laws of
the State of Minnesota, hereinafter referred to as the "City".
W I T N E S S E T FI:
That the Landowner, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and
convey unto the City, its successors and assigns, a permanent
drainage and utility easement, over, across and under the following
described premises, situated within Dakota County, Minnesota, to-wit:
That part of Lot 3, Auditor's Subdivision No. 42,
Eqan, according to the recorded plat thereof,
Dakota County, Minnesota lying westerly of the
westerly right-of-way line of State Highway No. 3,
! as described on the final certificate in Book of
Miscellaneous Records - No. 64, Page 250, Dakota
County, Minnesota, and easterly of a line 35.00
feet westerly of and paraiiel with the westerly
right-of-way line of said State Highway No. 3.

The grant of the foregoing permanent easement for drainage and
utility purposes includes the right of the City, its contractors,
agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes,
conduits and mains; and the further right to remove trees, brush,
undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore
the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of
trees, brush, undergrowth and other obstructions.
And the Landowner, its successors and assigns, does covenant with
the City, its successors and assigns, that it is the Landowner of the
premises aforesaid and has good right to grant and convey the
easement herein to the City.

On 7anuary 15, 1993, the Ciry received $4,460 from Dakota County; proceeds from the
acquisition of easements and $2,500 from you and your wife for a totai of $6,960. According
to the agreement, this amount was to be held until the levy of assessments for Project 607.
Your escrow account has been credited with $762.78 of interest for the time your deposit
has been held by the City. The City has applied the total balance in your account $7,722.78
as a prepayment against the assessmenu levied on your property. According to the City's
records, $20,224.79 was levied on October 18, 1994. The City staff has applied the payment
to SA #102558 $5,186.85; SA #102559 $449.96; SA #102560 $748.00; and SA #102557
$1,337.97. There remains a balance of $12,502.01 payable on your property.
